County DATE: January 6, 2004 '`/'' SUBJECT: Approval of Agreement to Use Property with Peter Zaayer SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: APPROVE and AUTHORIZE the Fire Chief to execute an Agreement to Use Property (non-monetary) between Contra Costa County Fire Protection District and Peter Zaayer for the Fire District's use of his property at 1251 Mountain View Boulevard in Walnut Creek for conducting firefighting training exercises. FISCAL IMPACT: None. BACKGROUND/REASONS FOR RECOMMENDATION: The owner plans to tear down the subject property in the future, and this provides the Fire District with an excellent opportunity to conduct firefighting training exercises involving both destructive training activities (e.g., cutting holes in roof and walls to practice ventilation procedures) and non-destructive training activities (e.g., practicing interior search and rescue operations). This agreement sets forth the terms and conditions under which the Fire District can use the property for training purposes and contains an indemnification provision in favor of the owner. District shall conduct its training exercises in as safe a manner as passible. Owner shall not be liable for any injury, death or liability during the period, including District personnel, or the property of any person during the period of District's use of the property, as specified in Paragraph 1 hereof. District agrees to save, defend, indemnify and hold harmless Owner from any and all Claims, costs and liability for any damages, injury or death of or to any person or the property of any person whose injury, death, damage, claim or liability arises or occurs during or as a result of District's use of the property. 5. RichterCosta Centra Costa County Fire Protection District ` County DATE: January 6, 2004 s>q 17 SUBJECT: Purchasing Contract with TriTech for Replacement of the District's CAD System SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: APPROVE and AUTHORIZE the County Purchasing Manager, General Services Department, to execute a Purchasing Contract between the Contra Costa County Fire Protection District and TriTech in the amount of $1,998,167 for the replacement of the District's Computer Aided Dispatch (CAD) System. FISCAL IMPACT: Nearly all of the $1,998,167 contract amount is included in the District's FY 2003-04 budget as the result of an encumbrance or carry-over from prier FY 2002-03. BACKGROUND/REASONS FOR RECOMMENDATION; In addition to the Contra Costa County Fire Protection District, the District's Communications Center provides emergency dispatch and communications services to the following five ( )fire agencies: Crockett-Carquinez, East Contra Costa, Moraga-Orinda and Rodeo-Hercules Fire Protection Districts as well as the City of Pinole Fire Department, The District's existing CAD System is approximately 14 years old and in need of replacement as the current system lacks essential functionality, present in most modern CAD systems, such as dynamic dispatch, closest unit recommendations and automated unit move-up abilities; current system requires a specialized skills set to support its non-standard application and operating system; and current system's support arrangement is substandard and the System has several potential points of failure. To help procure a new CAD system, the District enlisted the services of La Loba International, a consulting firm, to assist with the following activities: preparing a Request for Proposal (RFP); assisting in the bidding process and selection of a vendor; and completing post-RFP work. The District began working with the consulting firm in May 2002, approximately 1-Y2 years ago, and is now at the point where we are ready to award the contract. The County Purchasing Manager provided assistance with SBE and Outreach Program solicitation efforts and reviewed and made recommendations with respect to the following: RPP; terms and conditions of purchasing contract; hardware and software maintenance and support agreements; "supplier master preferred source code escrow" agreement; pricing and payment schedule; and statement of work. County Counsel reviewed language in the purchasing contract, particularly with respect to the indemnification and warranty provisions. A total of nine (9) vendors submitted bids. After reviewing the bids and taking into account factors such as cost, features and functionality, reliability and corporate stability, the District decided to award the contract to TriTech. Of the $1,998,167 amount, $106,731 is planned to be spent on capital equipment, $165,748 on non-capital equipment, $1,182,229 on software and $543,459 on professional services related to the installation of new CAD system and the training of District personnel on its operation.
