BACKGROUNDIREASON(Sl FOR RECOMMENDATION(S): Landlord/tenant and fair housing counseling services are critical services to many low- income households throughout Contra Costa County. For many years, Contra Costa County has provided Community Development Block Grant (CDBG) funds to multiple agencies to provide these services. There is a lack of coordination between the landlord/tenant and fair housing counseling agencies that have been funded with CDBG funds. The proposed RFP would be open to any organization, including those who are currently funded with CDBG funds to provide these services who can provide both landlord/tenant and fair housing services on a countywide basis. A total of approximately$90,000 of CDBG funds would be available to one agency or a collaboration of multiple agencies to provide comprehensive landlord/tenant and fair housing services for FY 2005/06. In May 2004, the Board of Supervisors directed staff to return to the Family and Human Services (FHS) Committee to consider the RFP for these services. FHS COMMITTEE MEETING The Committee met on August 9, 2004 to consider the RFP for countywide landlord/tenant and fair housing services. Various agencies who currently provide landlord/tenant and fair housing services in the Bay Area, including those who are currently funded with County CDBG funds, were invited and encouraged to attend the meeting. Representatives from three agencies, Bay Area Legal Aid (BALA), Pacific Community Services, Inc. (PCSI), and Housing Rights attended the meeting. BALA, PCSI, and Housing Rights are currently funded with CDBG funds, BALA is funded to provide both landlord/tenant and fair housing services. PCSI is funded to provide landlord/tenant services. Housing Rights is funded to provide fair housing services. During discussion, several questions and/or concerns regarding the RFP were discussed. Questions or concerns raised during the Committee meeting included: Does the RFP call to eliminate other aspects of housing counseling services or other housing activities (i.e. mortgage/default counseling, predatory lending counseling, etc.)? No. Although the RFP has a specific focus on landlord/tenant and fair housing counseling services, it in no way eliminates nor discourages other aspects of housing counseling services or other housing activities. Respondents to the RFP can incorporate other housing related services in their overall proposal(s) or can apply for other housing counseling services or housing activities during the normal CDBG funding cycle. Why is the RFP focused on landlord/tenant and fair housing services? Landlord/tenant and fair housing services are critical services that help reduce the incidence of civil rights abuses and homelessness. Housing counseling is one of the County's Priority Needs within the Consolidated Plan (CD 4D). Although landlord/tenant counseling is just one aspect of housing related services, it is one of the most relevant to low-income households. According to the 2000 Census, 61% of all renter occupied households in Contra Costa County earn an income less than $50,000. The median income for all renter occupied households in Contra Costa County is $40,174 or 50% of the area median income. According to one housing counseling agency, approximately 80-85 percent of their caseload are landlord/tenant complaints/calls. In addition, landlord/tenant and fair housing services are integrally linked to each other. For example, out of all renter occupied households in Contra Costa County, 55% are occupied by racial/ethnic minorities. Landlord/tenant and fair housing complaints can initially be difficult to decipher from one another. Many times callers/consumers believe they have a fair housing complaint; however, it may in fact be a landlord/tenant complaint, or vise versa. Given the regularity of this occurrence, it is much more efficient to have one entity/organization providing both of these services, as it would eliminate an agency referring to another agency and would reduce the potential of callers falling between the cracks. The County is required by the Department of Housing and Urban Development (HUD) to affirmatively further fair housing, which we achieve by funding fair housing services. In December of 2001, the Board of Supervisors adopted the Analysis of Impediments to Fair Housing Choice (AI), which provides an overview of laws, regulations, conditions, or other possible obstacles that may affect an individual or a Page 3 household's access to housing. The document provides recommendations to help address fair housing issues identified in the document. The use of CDBG funds to provide fair housing counseling and legal services directly addresses the recommendations in the Al, including Actions 7.1, 7.2, 8.1, 9.1, 10.1, and 13.2. Does the RFP exclude or cater to certain agencies? Does the RFP try to eliminate any current contractors that provide these services? Any qualified agency or collaboration of agencies can submit a proposal. The RFP encourages collaboration of agencies that currently provide these services, including all current CDBG funded agencies. Current contractors can collaborate with other contractors to submit one proposal or they can choose to submit a proposal as the sole agency. Staff is searching for the most comprehensive, efficient, and cost effective proposal to provide landlord/tenant and fair housing services countywide. Does the RFP require a main office and satellite offices? No, it is not a requirement. Although the number and location of offices is not a stipulated requirement, there must be adequate accessibility to services to all clients throughout the County. Home visits are also a means to serve clients throughout the County. Experience has shown that most consumers are provided assistance over the phone. Does the CDBG program fund agencies to remain viable or does it fund services that are vital to low-income residents of the County? The purpose of the CDBG program is to develop and preserve viable urban communities through a broad range of eligible activities. Although the CDBG program funds an array of public agencies and non-profits, the program is not intended to fund agencies just to keep them viable. Are the complaints that the County has received regarding inadequate provision of services anecdotal? The County has received specific complaints from Contra Costa Interfaith Supporting Community Organization (CCISCO), staff from other cities in the County, and individual consumers. Consumer complaints to the County have specifically been on the constant referral from one agency to another and on the different responses one agency gives compared to another. Following discussion, the Committee decided to forward the RFP to the full Board of Supervisors for consideration. ADDENDUM TO ITEM SDA September 2S, 2004 On this day the Board of Supervisors considered approving and authorizing the Community Development Director to issue a Request for Proposals for countywide landlord/tenant and fair housing services for fiscal year 2005/2006, as recommended by the Family and Human Services Committee. Supervisor Uilkema asked several questions of staff pertaining to funding from CBDG, how the money was being spent,whether the funds were monitored, and hove the department would ensure that the same level of services will be provided in all geographical areas of the County. Chair, Supervisor Glover asked for this matter to be brought back to the Board. He also commended CBDG for continuing to be visionary, and felt that the Board should encourage that incentives be put in place for agencies to collaborate. He further stated that he would not support this because it might discourage agencies that do not have the ability to put together RFP's for projects like this. Supervisor DeSaulnier was concerned that, at the risk of trying to do this collaboration, local ties and connections would be lost, and requested that some additional language be put in the RPF. The Board,discussed the history of the issue and requested clarifications of various related items from staff. The Chair invited comments from the public, and the following people spoke: Torn Laffleur, (PCSI) 329 Railroad Avenue, Pittsburg; Wanda Remmers, (Housing Rights)P.O. Box 12895, Berkeley, After further discussion,the Board took the following actions: • APPROVED and AUTHORIZED the Community Development Department to issue a Request for Proposals (RFP) for countywide landlord/tenants and fair housing services for FY 2005/06 as proposed by CDBG staff; • REFERRED the matter to staff and to the Family and Human Services Committee; • CLARIFIED that ancillary services are not excluded; • DIRECTED that the RFP require respondents to clearly identify how they would address all of the geographical issues. Supervisor Uilkema made a motion to approve this, and Supervisor Gioia seconded the motion. The vote was AYESJ, II, II,NOES: IV, V; ABSENT: Nene: ABSTAIN:None. Motion passed. 1 Y r ,w CONTRA COSTA COUNTY FY 2005/06 REQUEST FOR PROPOSALS: FAIR HOUSING & LANDLORD/TENANT SERVICES The purpose of this Request for Proposals {RFP} is to solicit proposals for Fair Housing and Landlord/Tenant Services in the Contra Costa Urban County. Currently,multiple agencies are contracted to provide Fair Dousing and Landlord/Tenant Services to Urban County residents. The County is seeking one agency or a collaboration of two or more agencies that can provide both Fair Housing and Landlord/Tenant Services. Included among the services that the selected agency or collaboration would be required to provide are. 1. Fair Housing Services ■ Investigate complaints of Dousing discrimination Conciliate cases with evidence indicating illegal discrimination, including referral to appropriate legal services/remedies (DFEH, HUD,or private attorneys) Provide fair housing training and education/outreach 2. Landlord/Tenant Services ■ Provide landlord/tenant counseling including conciliation and dispute resolution Provide information and referral to other agencies in the community ■ Provide landlord/tenant training and education/outreach SECTION 1: ELIGIBLE PROPOSALS Fair Housing and Landlord/Tenant Services. The successful agency or collaboration must be able to provide adequate accessibility to services to all clients throughout the County. Agencies with satellite offices in multiple locations in the County are encouraged. Agencies will be required to demonstrate how they will address recommendations in the 2001 Analysis of Impediments to Fair Dousing Choice. ' The Urban County is the unincorporated area of the County as well as the cities of Brentwood,Clayton,Danville,El Cerrito,Hercules,Lafayette,Martinez,Moraga,Oakley,Orinda,Pinole,Pleasant Hill, San Pablo,and San Ramon, SECTION 2; FUNDING The County expects to have approximately $90,000 in Community Development Block Grant (CDBG) funds in FY 2005-2006 (beginning July 1.2005 and ending June 30, 2006)to provide fair housing and landlord/tenant services. The agency will have to adhere to all applicable federal guidelines. SECTION 3. EVALUATION CRITERIA Proposals will be evaluated for ability to address required provisions, completeness, accuracy, and quality. Included should be a short background of the interested agency, detailing experience in providing Fair Housing and Landlord/Tenant Services. Partnerships/collaborations between agencies are encouraged—include a copy of an MOU or other agreement with the application. All proposals should include a section on monitoring and evaluation that explains the methods that will be used to report the success of the program. The proposal should provide evidence of the agency's understanding of the program's purpose and objectives and knowledge of the field. A. Program Design This factor includes the ability of the applicant to measurably meet the need for Fair Housing and Landlord/Tenant(L/T) Services. The amount of benefit provided by specific services is very important and includes the total(unduplicated)number of Urban County residents to be served. Proposals must document and track specific results. Factors taken into consideration may include: 1. How does the organization propose to meet the fair housing & L/T service needs and fulfill its stated program service goals? For example,how does the agency plan to: • Provide outreach to inform housing consumers and housing providers of available services? • Respond to complaints of illegal housing discrimination in the Urban County? • Provide information to tenants and landlords on their rights and responsibilities? • Educate the community about fair housing and landlord/tenant laws? 2. How will the agency evaluate how well the services succeeded in meeting the identified need? What will be the measurable outcomes of the services? 3. How will clients receive legal services for fair housing and landlord/tenant issues? 4. How are services readily accessible to Urban County residents through the use of satellite offices or other means? What are the agency's office hours? How are services accessible to persons with disabilities? How will services accommodate clients' work. schedules? 5. Does the program serve clients up to 80% of area median income for tenant/landlord, and clients at all income levels for fair housing? How does the agency verify clients' income? 6. How does the agency propose to address the ethnicity/race diversity in the Urban County? Are multi-lingual services available? 7. Does the program address the relevant recommendations in the Analysis of Impediments to Fair Housing Choice? 8. Does the agency possess specialized experience with one or more of the protected classes? 2 B. Experience and Management Capacity 1. Is the agency well suited to undertake this program? What is the agency's record of achieving its program objectives in past years? 2. How long has the agency been in operation? Is it a fiscally and programmatically stable agency? 3. Has the agency completed a program such as the one being proposed? If not, can the agency demonstrate it has the ability to administer the proposed program? 4. Does the agency have the ability to maintain accurate and complete records, and to prepare clear and timely reports on program progress? 5. What is the agency's ability to properly administer and account for funds? What are the agency's internal control procedures and how accurate are its fiscal records?(as shown by audits and monitoring reports). Does the agency request reimbursement in a timely manner and with a minimum of errors? C. Cast Effectiveness of Proposal 1. The amount of funding requested by the agency should represent the proportionate amount of service provided by the program to Urban County residents. 2. The cost per unit of service (see Appendix H for definitions) should be reasonable and justifiable. 3. The administrative costs of the program should be reasonable in proportion to the direct cost of the service. Administrative costs are the salary and overhead of supervising and administering the program. SECTION 4: GRANT PROVISIONS A. Grant Amounts Currently,there is approximately$90,000 available in CDBG funds for this RFI'. B. Applicant Eligibility This grant will be awarded to an organization that qualifies for tax exemption under Section 501(c)(3) of the Internal Revenue Code. C. Audit and Internal Control Questionnaire Requirements Agencies that receive County funds must conduct and submit an annual audit to the County on a yearly basis in accordance with current County policy concerning subrecipient audits. Federal regulations also require any agency receiving more than$500,000 in Federal funds from any combination of sources to submit a single audit to the County. If additional expenses are incurred related to audit requirements. 3 D. Insurance Requirements Funded agencies must submit current Certificates of General Liability Insurance ($1,000,000 single limit)with Contra Costa County and its officers, agents, employees and members of County Board of Supervisors named as an additional insured. Agencies must also submit automobile insurance(single limit of$1,000,000)and current Worker's Compensation insurance. E. Reporting Requirements The successful agency will be required to submit quarterly client and service information including: 1. Unique client identifier 2. Mature of complaint 3. Type of service provided and outcome 4. Detailed client household income information based on HUD income levels of 30%, 50%, and 80% area median income (landlord/tenant only) 5. Detailed client racial and ethnic information 6. Client female head of household information 7. Disability status 8. Board meeting minutes F. Contract Dates Subject to Board of Supervisors approval,the successful Agency will receive CDBG funds beginning July 1, 2005. Contracts will be binding for one year,ending June 30, 2006. The agency-,hill have to adhere to all applicable federal guidelines. G. Contract Monitoring Fully executed contracts will be monitored by the Community Development Department to ensure compliance. The funded agency will be required to submit fiscal and program reports. Fair Housing Services and Landlord/ Tenant Services should be accounted for separately. Agencies will also be required to develop and implement performance and evaluation measures consistent with future HUD mandates. SECTION S: RFP AVAILABILITY AND SELECTION PROCESS A. RFP Availability Request,for Proposal materials are available at the County Community Development Department, 651 Pine Street, 5th Floor,North Wing,Martinez. RFP materials may be picked up between the hours of 8:OOAM to 5:OOPM Monday through Friday. Call (925) 335-1259 to request an application by mail. Electronic copies of the RFP(in Microsoft Word format)may also be downloaded at www.ccreach.org. While the County will make every reasonable effort to inform the community of this RFP,the County assumes no responsibility for failure to inform all interested parties of its availability. The County reserves the right to reject non-responsive proposals. This RFP is a solicitation of proposals only; no offer of contract is implied. Costs incurred by respondent in the preparation and completion of this RFP are not the County's responsibility, and may not be reimbursed through grant funds. 4 B. Proposal Submission Agencies must submit completed proposals by Tuesday,January 4,2005 by 4:00 PM to the Community Development Department. The person authorized to enter into a contract with the County must sign the completed proposal. Proposals must include complete and accurate responses to all sections. No faxes or emails will be accepted. Proposals will be date-stamped when received.All Proposals received after the submission deadline shall be rejected. C. Proposal Review The Community Development Department staff will review CDBG funding proposals in February and March 2005. Staff recommendations will be forwarded to the Family and Human Services Committee in March or April, and be sent to the Board of Supervisors for approval in May 2005. D. Please define separate goals for landlord/tenant and fair housing services. Call: Brief advice, counseling, or referral services to callers. Case: A case occurs when fair housing or tenant/landlord staff initiates an appropriate and proper investigation in response to a caller's particular situation. This may include advocacy,mediation, or Legal services. Outreach: To provide education and outreach services to Urban County residents.
