BACKGROUND / REASONS FOR RECOMMENDATION On December 16, 2003 the Board of Supervisors opened the public hearing on the three related actions related to the ALUC Airport Land Use Compatibility Plan: • Airport Land Use Compatibility Plan General Plan Amendment (County File: GP#02-0001). • County initiated Rezoning for conformance with the ALUC Airport Land Use Compatibility Pian. • County initiated repeal of the Airport Zoning Ordinance,Chapter 86-4,County Ordinance Code (County File: ZT#02-0004) This matterwas continued to a fixed hearing date at 1:00 p.m., March 23,2004 and the Board granted a further continuance of the public hearing to 1:00 p.m., April 27, 2004 in order to review matters pertaining to the proposed rezoning of property near the Byron Airport,as recommended in the Airport Land Use Compatibility Plan, with the ALUC. It was continued again to June 15, 2004 at the request of the ALUC in order to review new information from the updated California Airport Land Use Planning Handbook, as submitted to them from the County, which relates to the appropriate zoning and densities for certain properties adjacent to the Byron Airport. The ALUC met on Wednesday, June 9, 2004 at which time they determined that they will conduct a hearing to consider a revision and update to the Airport Land Use Compatibility Plan for a compatibility zone around the Byron Airport, as requested by Contra Costa County. It is expected that the ALUC will conduct this hearing in July or August. Therefore, it will be necessary to continue the Board's public hearing on the three actions to bring the County conformity with Airport Land Use Compatibility Plan in September. Staff is recommending that the public hearing be continued to the Board's September 28, 2004 meeting at 1:00 p.m. This will provide sufficient time for the ALUC to conduct its hearing to revise and update the Airport Land Use Compatibility Plan. Should the ALUC revise and update the Airport Land Use Compatibility Plan, as requested by the County, the Board would no longer need to overrule the ALUC in order to approve the County Planning Commission recommendation to retain the A-2: General Agricultural District for certain properties adjacent to the Byron Airport.
