RECEIVE and CONSIDER oral and written testimony and other evidence from the county abatement officer, the property owner, and other persons, and CLOSE the hearing. FIND that the facts set forth below are true. AFFIRM the county abatement officer' s determination in the notice and order to abate by finding that the sub-standard structures (dock and sheds) , a singlewide mobile trailer has been placed and hooked to sewer, and electrical work without any permits. A house was moved onto the property, placed on blocks and connected to electrical and sewer. It was later relocated atop pilings and reconnected to electric and sewer without any permits. Junkyard conditions exist in the form of storage of wood and metal scrap, commercial equipment, and a mobile trailer. The above referenced real property is a public nuisance in violation. of Contra Costa County Ordinance Code section 74-1.002, 712-2.004, 76-12.202, 710--3.002, 78- 3.002, 84--38.402, 84-68.1402, 88-4.206. ORDER the property owner to abate the public nuisance by removing the sub- standard structures (dock and sheds) , the singlewide mobile trailer, the house, the junkyard conditions, wood and metal scrap, commercial equipment, mobile trailers, and electrical meter from the property within 30 days of the mailing of the Board's decision. DIRECT the county abatement officer to remove the sub-standard structures (deck and sheds) , the singlewide mobile trailer, the house, the junkyard conditions, wood and metal scrap, commercial equipment, mobile trailers and electrical meter from the property, and charge the cost of the work and all administrative costs to the property owner, if the property owner does not comply with the Board's order to abate the public nuisance. DIRECT the county abatement officer to send the Board's decision by first class mail to the property owner and to each party appearing at this hearing, and file the Board's decision with the Clerk of the Board of Supervisors. FISCAL IMPACT: The cost of removing the scrap metal :from the property is estimated to be $65, 000.00. if the county abatement officer performs the work of the abatement and the property owner does not pay, the actual cost the work and all administration costs may be imposed as a lien on the property. The above referenced property is located in an A-2 zoning district. Contra Costa County Ordinance Code section Title 8, Chapter 84-38.402, prohibits uses other than those allowed in an A-2 zone. Storage of scrap metal, wood and equipment not related to the uses of the property are not allowed. Contra Costa County Ordinance Code section Title 7, Chapter 74-1.002, Adoption of California Building Code. Requires a building permit for moving a house. Contra Costa County Ordinance Code section Title 7, Chapter 78-3.002, Adoption of California Plumbing Code requires a permit to do plumbing. Contra Costa County Ordinance Code section Title 7, Chapter 710-3.002, Adoption of California Mechanical Code requires a mechanical permit for mechanical work. Contra Costa County Ordinance Code section Title 7, Chapter 76-12.202, Adoption of California Electrical Code requires a permit for electrical work. Contra Costa County Ordinance Code section Title 7, Chapter 712-2.0, Adoption of Uniform Housing Code adopts the UHC rules on substandard structures. Contra Costa County Ordinance Code section Title 8, Chapter 88-4.206, Junkyard Conditions "junkyard" means any property used (whether or not for profit or gain) for (1) the dismantling or wrecking of automobiles or other vehicles or machinery, or (2) the storage or salvage of automobiles or other vehicles or machinery, scrap metal, or other scrap materials, including salvaged building materials. Contra Costa County Ordinance Code section Title 8, Chapter 84-68.1.402 Use for human habitation. No person shall locate, maintain or use for human habitation, including sleeping, a mobile home, trailer or camp car in any land use district except as provided in Articles 84-68.16, 84-68.18 and 84-68.20 and as follows: (1) In a lawful mobile home park or travel trailer park; (2) In a lawful recreational vehicle park or campground allowed by a land use permit in these districts only: A-2, A-3, RB, C, L-1 and T-1. The county abatement officer made an initial inspection of the above referenced property on April 4, 2003. The county abatement officer observed sub-standard structures (dock and sheds) . A singlewide mobile trailer had been hooked to sewer and electrical without any permits. A house was moved on the property and placed on blocks and connected to electrical and sewer without any permits. Junkyard conditions in the form of storage of wood and metal scrap, commercial equipment, and mobile trailers in violation of Contra Costa County Ordinance Code section 74-1.002, 712--2.004, 76-12.202, 710-3.002, 78-3.002, 84-38.402, 84-68.1402, 88- 4.206. Re-inspection of the property on November 8, 2003 showed that the property continued to be in violation of Contra Costa County Code section 74-1.002, 712- 2.004, 76-12.202, 710-3.002, 78-3.002, 84-38.402, 84-68.1402, and 88-4.206. The notice and order to abate was served on the property owner and all persons known to be in possession of the property by certified mail on January 8, 2004 and posted on the above referenced property on January 8, 2004. The property owner filed an appeal of the notice and order to abate on January 16, 2004 . Notice of this appeal hearing was sent to the property owner on January 26, 2004 The owner of the property has been notified of the violation(s) through written correspondence and certified mail. As of this date, compliance has not been gained. On January 8, 2004 the Building Inspection Department declared the property a public nuisance and posted a Notice Order to Abate under Title 1, Chapter 14-6.
