SUBJECT: Development of a Noise Ordinance for the Kensington Community
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
DIRECT County Counsel and the Community Development Department staff to provide
support to the Kensington Community Services District (KCSD) and the Kensington
Municipal Advisory Council in the development of a noise ordinance applicable to
Kensington that would be enforced by the Kensington Police Department.
FISCAL IMPACT:
Approximately$3,000 in staff costs could be incurred as an unfunded mandate.
BACKGROUND/REASONS FOR RECOMMENDATIONS:
In the last several years, there have been increasing complaints of noises infringing on
neighboring properties in the Kensington area. Recognizing that enforcement of a
Countywide ordinance would be expensive and extremely difficult, I have held discussions
with the Chief of Police of the KCSD and believe that the District is interested in the
adoption of a noise ordinance that they would be able to enforce. In order to ensure that
the ordinance meets all legal requirements, County staff should be involved in its
development and adoption.
