BARRY, AICP Community Development Director County DATE: February 10, 2004 SUBJECT: AUTHORIZATION FOR SIGNING THE STANDARD AGREEMENT WITH THE STATE WATER RESOURCES CONTROL BOARD PERTAINING TO THE PROP 13 GRANT FOR THE CONTRA COSTA COUNTY WATERSHED ATLAS AND CREEK RESTORATION STRAGEGY SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS AUTHORIZE the Community Development Director or his designee to sign the Standard Agreement provided by the State Water Resources Control Board to administer and receive the Prop 13 grant that the Community Development Department was awarded in 2001 for the Contra Costa County Watershed Atlas and Creek Restoration Strategy(Atlas). FINANCIAL IMPACT No financial impact to the County. By signing the Standard Agreement, the Community Development Department will be able to receive up to $80,000 for the purposes described above. REASON FOR RECOMMENDATION/BACKGROUND In May 2001,the State Water Resources Control Board(State Board)selected the Atlas project proposal submitted by the Community Development Department,for an award under the Proposition 13 grant. Since then, staff from the Community Development Department has worked closely with the staff from the State Board to finalize the contract. The Standard Agreement was developed by the State Board in an effort to streamline the grant contracting process. This idea Was greatly supported by the Contra Costa Watershed Forum,a group ofpeople whose work is to restore creeks in the County. In February 2001,the staff submitted the grant application. The first phase of the Atlas project was lead by two graduate students in 2001. The second phase was lead by staff from the Community Development in 2002 and 2043. Scientific data on local creeks were collected and old paper maps were digitized. Finally, the Contra Costa County Watershed Atlas was published on November 12,2003 at the Contra Costa County Creek and Watershed Symposium. The first 300 printed copies of the Atlas were sold out within a month. Due to increasing demands from the public and agencies all over the Bay Area,the Department printed 300 more copies in January 2004. Signing the Standard Agreement will enable the Department to receive the$80,000 awarded by the State Board to pay for a large portion of the cost associated in creating the Atlas. The term of the contact with the State Board began on June 16,2003. While the term will end on March 31,2005,it is crucial that all necessary documents, such as the Standard Agreement are signed to receive the funds to pay for the already completed project. BACKGROUND AND GOALS Creeks in Contra Costa County have been drastically and repeatedly modified over the last 150 years. The Army Corps of Engineers and Flood Control District have controlled flood risks by transforming miles of creek into concrete u-shaped channels, by building bigger levees and by developing energy- dissipating drop structures. Rapid urbanization has dramatically increased nonpoint source pollution and impervious surfaces. Urban settings in Contra Costa County foster a thousand points of nonpoint source pollution,with substantial cumulative impacts. Important water-dependant terrestrial habitat has been lost and fragmented. The loss of habitat and habitat connectivity disrupts ecological functions,threatens wildlife and obscures natural scenery. The county's urban growth will continue. Careful planning will be necessary to incorporate creek enhancements as features in revitalization strategies. Otherwise, creeks may be viewed as obstacles to housing. This project will be a substantive first step toward comprehensive and coordinated enhancement of creeks and water quality In the watersheds of Contra Costa County. Through this Agreement, Contra Costa County,working with the Contra Costa Watershed Forum and the Watershed Mapping Subcommittee of the Watershed Forum,seeks to aid and expand county-wide efforts to restore creeks and control nonpoint source pollution by developing an Atlas and watershed GIS that will document existing conditions,facilitate watershed planning,and enable identification of future restoration needs and opportunities. This Agreement will also support a volunteer-based creek survey program that uses GPS technology to document in detail the physical conditions of creeks in the county,improving baseline information while also increasing public awareness and involvement in creek and watershed issues. B. WORK TO BE PERFORMED The Contractor shall be responsible for the performance of the work as set forth herein and for the preparation of products and a final report as specified in this Exhibit. The Contractor's Project Representative shall promptly notify the SWRCB's Project Representative of events or proposed changes that could affect the scope, budget,or schedule of work performed under this Agreement. Unless otherwise specified in the Agreement, all deliverables shall be provided to both the Program Analyst and Contract Manager. Task 1. Project Administration 1.1 Provide all technical and administrative services as needed for Agreement completion; review all work performed;and coordinate budgeting and scheduling to assure that the Agreement is completed within budget, on schedule,and in accordance with approved procedures,applicable laws,and regulations. 1.2 Ensure that the Agreement requirements are met through completion of quarterly progress reports submitted to the SWRCB's Project Representative by the tenth (1 e)of the month following the end of.the calendar quarter(March,June,September,and December)and through regular communication with the SWRCB's Project Representative. The progress reports shall describe activities undertaken and accomplishments of each task during the quarter,milestones achieved,and any problems encountered in the performance of the work under this Agreement. The description of activities and accomplishments of each task during the quarter shall be in sufficient detail to provide a basis for payment of invoices and shall be translated into percent of task work completed for the purpose of calculating invoice amounts. County of Contra Costa SWRCB Agreement Number 02-207-552-0 Page 2 of 8 EXHIBIT A-1 (Standard Agreement) 1.3 Disclosure Requirements-Include the following disclosure statement in any document,written report,or brochure,prepared in whole or in part pursuant to this Agreement: "Funding for this project has been provided in full or in part through an Agreement with the State Water Resources Control Board (SWRCB)pursuant to the Costa-Machado Water Act of 2000 (Proposition 13)and any amendments thereto for the implementation of California's Nonpoint Source Pollution Control Program. The contents of this document do not necessarily reflect the views and policies of the SWRCB, nor does mention of trade names or commercial products constitute endorsement or recommendation for use." The Contractor shall include in each of its subcontracts for work under this Agreement a provision that incorporates the requirements stated within this subtask. 1.4 The Contractor shall notify the SWRCB's Project Representative at least ten(10)working days prier to any public or media event publicizing the accomplishments and/or results of this Agreement and provide the opportunity for attendance and participation by SWRCB representatives. 1.5 Complete a one(1)page contract summary form (form to be provided by the SWRCB)within three(3)months of the Agreement execution. 1.6 Award subcontract(s)to appropriate organization(s)to perform tasks as outlined in this Agreement. Document steps taken in soliciting and awarding the subcontract and submit them to the SWRCB's Project Representative for review prior to subcontract award. Provide SWRCB's Project Representative with a copy of the awarded subcontract. Document all subcontractor activities and expenditures in progress reports. 1.7 Every six(6)months during the term of this Agreement,the Contractor shall develop and submit to their assigned SWRCB Program Analyst expenditure/invoice projections to enable funding to be available for payment of invoices. 1.8 At the completion of this project and prior to final payment,the Project Director shall fill out and provide a project survey form to the SWRCB's Project Representative. Task Deliverables: 1.2 Quarterly progress reports; 1.5 Contract summary form; 1.6 Subcontractor documentation,signed subcontract agreements; 1.7 Expenditure/invoice projections;and 1.8 Project survey form. Task 2. Adjoining Landowner Notification 2.1 Develop and mail a written summary of this project to the Watershed forum mailing list,which includes approximately two hundred(200)individuals. For the purpose of this notification,the Watershed Forum represents the general Contra Costa County public. Task Deliverables: 2.1 Written summary,Watershed Forum mailing list. Task 3. Collect Existing Information from"Local Experts"--Private Citizens and Creek Groups The purpose of this task is to obtain and catalog information about approximately fifteen (15)major creeks in Contra Costa County,their watershed health and history from local citizenry and creek groups. This information shall be included in the text of the Atlas. The existing Contra Costa County Watershed Forum has an extensive membership of technical experts and governmental representatives and will provide much of the requested information in this task. Currently,this information is not catalogued or organized in any central location. County of Contra Costa SWRCB Agreement Number 02-207-552-0 Page 3 of 8 EXHIBIT A-1 (Standard Agreement) 3.1 Develop a list of approximately twenty-five(25)Watershed f=orum members who shall be able to provide historic and current creek and watershed data. 3.2 Develop a survey form/questionnaire requesting information about the Contra Costa County creeks and watersheds. The questionnaire shall ask for information to be provided about location of minor tributaries,channel conditions, history of restoration work,current restoration efforts, proposed restorationprojects,and history of people who were involved with the restoration work and/or public involvement/education efforts related to improving the quality of local creeks. 3.3 Distribute the survey'form/questionnaire to the list developed in Task 3.1. 3.4 Collect results from survey/questionnaire,and sort collected information into the following categories for each watershed: past watershed restoration projects,on-going;watershed restoration projects, proposed watershed restoration projects,existing reference materials on watersheds, organizations active in the watersheds,and locations of creeks and channel conditions. Task Deliverables: 3.1 Gist of people to be contacted to gather data; 3.2 Survey/questionnaire form;3.4 twist of categories of information collected. Task 4. Collect Existing Information from Government Agencies The purpose of this task is to obtain and catalog scientific and statistical information about the creeks and watersheds in Contra Costa County. This task complements Task 3 and supports performance of Task 5 by incorporating existing agency expertise and information into the baseline of watershed information. Findings shall be included in the text of the Atlas. 4.1 Develop a list of organizations and agencies who shall be able to provide creek and watershed data. Agencies included shall be the SWRCB,the United States Department of Agriculture, Resource Conservation Districts,the Contra Costa County Public Works Department,and the Contra Costa County'Community Development Department. 4.2 Send letters to,or make contact with,the list developed in Task 4.1 requesting access to retrieve the following types of data: soil types and locations,rainfall levels,stream flow,and impervious surfaces. 4.3 Collect results, and sort collected information into the following categories for each watershed: physical watershed attributes, constructed watershed attributes, and social attributes of the watersheds. Task 4 Deliverables: 4.1 List of organizations and agencies;4.2 Copy of written request for information;4.3 List of categories of information collected. Task 5. Baseline Watershed GIS and Statistical Database Based on the research done in Tasks 3 and 4,compile collected information into a centralized database. Baseline watershed GIS layers and statistical data shall be created and integrated to enable production of maps,tables and figures in Task 7. 5.1 Perform any necessary data entry on statistical information conducted during Tasks 3 and 4. County of Contra Costa SWRCB Agreement Number 02-207-552-0 Page 4 of 8 EXHIBIT A-1 (Standard Agreement) 5.2 Compile the statistical information collected in Tasks 3 and 4 into a statistical database of physical characteristics that shall include flow records, impervious surface acreage,land use acreage,and watershed area acreage. Statistical information shall be stored in the Microsoft Access 2000 format. 5.3 Integrate and overlay watershed GIS data collected in Task 4 by converting GIS layers into a common reap projection and table organization. GIS layers shall be stored in the Environmental Systems Research Institute file format. 5.4 Develop digitized GIS map layers and modify existing GIS map layers based on the non-digital, geographic information collected during Task 3 and 4 activities, such as locations of previously unmapped creeks and location of past, current, and proposed creek restoration projects. 5.5 Analyze what data is missing and determine what additional geographic information,available in paper format,would be the most valuable addition to the watershed GIS. 5.6 Based on needs assessed in Subtask 5.5,digitize at least two(2)additional data layers county- wide from existing paper maps. Task 5 Deliverables: 5.2 Matrix showing contents of statistical database„ 5.6 Print-outs(11x17 or smaller)illustrating contents of watershed GIS and newly digitized layers. Task 6. Training Volunteers for GPS Creek Survey Program The purpose of this task is to update and refine an existing volunteer data collection program that utilizes visual surveys and GPS technology to collect current data on physical attributes of creeks and watersheds, enabling identification of sources of impairments to beneficial uses and of restoration opportunities. Existing protocols shall be refined and the train the trainer program shall be updated and conducted. 6.1 Refine GPS survey protocols and volunteer training program manual. Includes refinements to the actual survey techniques and to the manual that is distributed to volunteer data collectors explaining the purpose and methods for collecting data. 6.2 Convene at least two(2)detailed train the trainer sessions,based on the refined GPS survey protocols and the volunteer training program manual created in Subtask 6.1,to train coordinators of volunteer organizations working on specific creeks and watersheds how to lead GPS survey teams. Not less than ten (10)coordinators shall be trained in each session. The training sessions shall be staggered in time and/or location to ensure that the training is available to as many different organizations as possible and that the coordinators'training is as current as possible. Task 6 Deliverables: 6.1 Refined GPS survey protocols, refined volunteer training program manual,6.2 List of training attendees. Task 7. Volunteer GPS Creek Survey Program The purpose of this task is to apply the protocol refinements and training conducted in Task 6 to conduct volunteer GPS surveys of creeks in Contra Costa County. Volunteers shall be trained by the coordinators trained in Task 6. The volunteers shall perform visual surveys and utilize GPS technology to collect digital geographic information on the physical attributes of creeks, including channel conditions, substrate composition,shade cover,and other attributes. County of Contra Costa SWRCB Agreement Number 02-207-552-0 Page 5 of 8 EXHIBIIT A-1 (Standard Agreement) 7.1 Develop an implementation plan and schedule to be used to coordinate the survey effort on creeks throughout the county. This plan shall coordinate when and where creek surveys take place so that contiguous reaches are surveyed,that past data collection efforts are complemented, and that data is collected in a useful order. 7.2 Obtain written landowner agreement forms to access any private lands for surveying. 7.3 Collect GPS data on five(5)or more creek segments. Creek segments shall be chosen in consultation with creek group coordinators and in accordance with the implementation plan developed in Subtask 7.1. 7.3.1 Train creek group volunteers on GPS protocols(developed in Task 61). Five(5)training sessions shall be conducted by creek group coordinators,one(1)session for each creek segment. 7.3.2 Following training,volunteers conduct visual surveys of creek segments and record observation with GPS. Volunteers shall survey physical attributes of creeks according to the protocols developed in Task 6. Physical attributes to be surveyed;include channel conditions,shade cover, substrate conditions,bank undercut, bank slope, invasive plant types and locations, vegetative cover, and constructed features such as bridges, outfalls, and drop structures. 7.4 Process the raw GPS data and import this data into the existing watershed GIS created in Task 5 so that this information can be incorporated into the Atlas. 7.5 Post draft results of GPS data collection surveys on the Watershed Forum's website. Task 7 Deliverables: 7.2 Landowner agreement forms for any private lands accessed; 7.4 Static image of the results of one of, the GPS data collection surveys;7.5 Website address where full GPS survey results will be posted. Task 8: Contra Costa County Watershed Atlas and Creek Restoration Strategy The purpose of this task is to incorporate the research findings from Tasks 3 through 7 into an Atlas. This shall be a reference document useful as both an educational tool and as a companion for active watershed restoration practitioners. The Contra Costa Watershed Forum shall review chapters of the Atlas and provide comments and suggestions. 8.1 Write outline and text for the Atlas. Chapters shall include a county-wide overview of watersheds, a guide to the origins and limitations of the data layers included in the Atlas,and a chapter for each of the approximately fifteen (15)major watersheds showing detailed information. Text shall include the natural history of Contra Costa County watersheds,overview of the watershed geomorphology,impervious surface and affects on the health of creeks and watersheds and contact information on local creek groups and relevant local agencies. Text also shall include information on the social and cultural history and farces in each watershed. 8.2 Compile the bibliography of existing reference documents for each watershed. 8.3 Create maps for the Atlas depicting the physical,social,and constructed attributes of watersheds in Contra Costa County. Use watershed GIS developed in Tasks 5 and 7 to make five(5)or more display maps for each watershed group and five(5)or more maps on a countywide scale (size:8 112x11 to 11x17). Print thirty(30)copies and distribute these to Watershed Forum members at one of the Forum's bi- monthly meetings to solicit their comments. 8.6 Review comments received from the Watershed Forum meeting participants as described in Subtask 8.5 on draft Atlas and prepare a final Atlas. 8.7 Publish and distribute up to three hundred and fifty(350)copies of the final Atlas. 8.8 Publish the Atlas on the Forum's website. REPORTS 1. For services satisfactorily rendered, and upon receipt and approval of the invoices, the State agrees to compensate the Contractor for actual expenditures incurred in accordance with the rates specified herein,which is attached hereto and made a part of this Agreement. DISPUTES: Not withstanding the provisions of the Department of General Services General Terms and Conditions(GTC),any dispute arising under or relating to the terms of this Agreement,or related to the performance hereunder,which is not disposed of by Agreement shall be decided by the SWRCB's Project Representative,who shall reduce such decision to writing and mail or otherwise furnish a copy thereof to the Contractor. The decision of the SW RCS's Project Representative shall be final and conclusive unless,within fifteen (15)calendar days from the date of receipt of such copy, the Contractor mails or otherwise delivers a written appeal to the SWRCB's Executive Director. The decision of the SWRCB's Executive Director, or authorized representative,on such appeal shall be final and conclusive unless determined by a court of competent jurisdiction to have been fraudulent,or capricious,or arbitrary,or so grossly erroneous as necessarily to imply bad faith,or not supported by any substantial evidence. In connection with any appeal under this Section,the Contractor shall be afforded an opportunity to be heard and to offer evidence and argument in support of the appeal. Pending final decision on any dispute hereunder, the Contractor shall proceed diligently with the performance of the Agreement work as directed by the SWRCB's Project Representative unless the Contractor has received notice of termination. Decisions on any disputes hereunder may include decisions of both fact and law; rop vided,however,that nothing herein shall be construed as making final any decision on a question of fact or law in the event of any subsequent legal proceeding before a court of competent jurisdiction. Authority to terminate performance under the terms of this Agreement is not subject to appeal under this Section. All other issues including,but not limited to,the amount of any equitable adjustment,and the amount of any compensation or reimbursement which should be paid to the Contractor shall be subject to the disputes process under this Section. RIGHTS IN DATA: The Contractor agrees that all data, plans,drawings, specifications, reports, computer programs,operating manuals,notes,and other written or graphic work produced in the performance of this Agreement are subject to the rights of the State as set forth in this section. The State shall have the right to reproduce, publish, and use all such work,or any part thereof; in any manner and for any purpose whatsoever. If any such work is copyrightable,the Contractor may copyright the same,except that, as to any work which is copyrighted by the Contractor,the State reserves a royalty-free,nonexclusive, and irrevocable license to reproduce, publish, and use such work,or any part thereof. INCOME RESTRICTIONS: The Contractor agrees that any refunds, rebates,credits,or Other amounts(including any interest thereon)accruing to or received by the Contractor under this Agreement shall be paid by the Contractor to the State,to the extent that they are property allocable to costs for which the Contractor has been reimbursed by the State under this Agreement. 4. DISCLOSURE REQUIREMENTS: Any document or written report prepared in whale or in part pursuant to this Agreement shall contain a disclosure statement indicating that the document or written report was prepared through Agreement with the State. The disclosure statement shall Include the Agreement number and dollar amount of all Agreements and subcontracts relating to the preparation of such documents or written reports. The disclosure statement shall be contained in a separate section of the document or written report. PERMITS,SUBCONTRACTING,WAIVER, REMEDIES AND DEBARMENT: The Contractor shall procure all permits and licenses necessary to accomplish the work contemplated in this Agreement, pay all charges and fees, and give all notices necessary and incidental to the due and lawful prosecution of the work. Any subcontractors,outside associates,or consultants required by the Contractor in connection with the services covered by this Agreement shall be limited to such individuals or firsts as were specifically identified and agreed to during negotiations for this Agreement, or as are specifically authorized by the SWRCB Project Representative during the performance of this Agreement. Any substitutions in, or additions to, such subcontractors, associates, or consultants, shall be subject to the prior written approval of the SW RCB Project Representative. Any waiver of rights with respect to a defautt or other matter arising under the Agreement at any time by either party shall not be considered a waiver of rights with respect to any other default or matter. Any rights and remedies of the State provided for in this Agreement are in addition to any other rights and remedies provided by law. Contractor shall not subcontract with any party who is debarred or suspended or otherwise excluded from or ineligible for participation in federal assistance programs under Executive Order 12549, "Debarment and Suspension". CONTRACT MODIFICATIONS: The SWRCB may,at any time,without notice to any sureties,by written order designated or indicated to be a"contract modification", make any change in the work to be performed under this Agreement so long as the modified work is within the general scope of work called for by this Agreement, including but not limited to changes in the specifications or in the method, manner,or time of performance of work. In no event can the contract modification have any impact on the budget specified in Exhibit B. If the Contractor intends to dispute the change, the Contractor must,within ten (10)days after receipt of a written"contract modification", submit to the SWRCB a written statement setting forth the disagreement with the change. 7. TERMINATION: Not withstanding the provisions of the Department of General Services General Terms and Conditions,the SWRCB may terminate performance of work under this Agreement upon 30 days written notice. Any termination shall be effected by written notice to the Contractor, either hand-delivered to the Contractor or sent certified mail, return receipt requested. The notice of termination shall specify the effective date of termination. For the purposes'of this grant application,Volunteer and Emergency Services Team in Action (VESTIA)will act as the fiscal agent for EHSD Service Integration Program,Verde Involving Parents Program (VIP). The funding will support VIP, a team effort of parents,teachers and county agency and non-profit staff who live and work in North Richmond. VIP supports two(2)United Way of the Bay Area target goals,preventing youth violence and parent &community involvement. The targeted program outcomes are to get children to school every day, on time and ready to learn. In doing so, children will have more time in safe and supervised community settings. Approval of Standard Agreement#29-441-25 will continue the County's CONREP Program through June 30, 2004. BACKGROUND The County frequently requites temporary help to assist County agencies, departments, or offices during peak loads, temporary absences and emergency situations. It is in the economic interest of the County to provide such temporary help by contract with temporary help firms since they include all insurance coverages in their rates and there are no fringe benefit costs, thus reducing future County liabilities and costs. Temporary help obtained under these contracts may not be used in place of employees in the case of a labor dispute or for more than 90 days for any single instance of peak load, temporary absence or emergency situations as governed by State law. FISCAL. IMPACT The renewal of the contracts with the temporary help agencies will benefit the County by ensuring that for the remainder of 2003-2004 Fiscal Year, the mark-up rates will remain at the current level established by the original contract in 1995 and the rates will not increase. A Request for Proposal (RFP) has been issued soliciting new firms; however, rates for the new contracts for FY 04-05 may increase.
