SUBJECT: SHERIFF'S PROPOSED USE OF AB 3229 FRONT LINE LAW ENFORCEMENT FUNDS
(Chapter 134,Statutes of 1996)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. RECOMMENDATION ACTION:
1. HOLD a scheduled public hearing as required by AB 3229 on Sheriff's request for Government Code
Section 30061(b)(3) Front Line Law Enforcement funds.
2. APPROVE the Sheriff's request to continue funding the Air Support Unit with Government code
30061(b)(3)funds; and
3. APPROVE the Sheriff s request to spend the $30,000 prior year fund balance on a Resident Deputy/
Community Policing program in the Rodeo area.
II. FINANCIAL IMPACT:
NONE. The recommended Board Action will have no impact on the County General Fund. The funds
from the State of California under AB 3229 are restricted funds that may only be used as prescribed by
Government Code Section 30061(b)(3), requested by the Sheriff and approved by the Board.
III, BACKGROUNDIREASON(S) FOR RECOMMENDED ACTION(S):
The States'fiscal year 2004/05 budget Continues the program authorized by the Local Law Enforcement
Supplemental Funding Act (AB 3229) by appropriating restricted funds for three separate programs: 1)
$286,147 to the Sheriff's Office for jail construction and operations; 2) $286,147 to the District Attorney's
Office for criminal prosecution; and 3)$2,411,520 allocated to County unincorporated law enforcement
and city police departments on the basis of population (of this amount, $231,105 is available for front line
enforcement services in the Countys unincorporated areas). The three County programs referred to
above have been included in the adopted final County budget for FY 2004/05 in Budget Units 0262, 0241
and 0263, respectively.
Regarding the Sheriff's use of$231,105 in front line law enforcement funds, Government Code Section
30061(e)(1), requires that the Board of Supervisors hold a public hearing on the Sheriff's requested use of
these funds in each year in which the State provides such funds. Fiscal year 1996/97 was the first year of
this program and your Board approved the Sheriff's request to use these funds to initiate a law
enforcement Air Support Unit and later a Resident Deputy, Community Policing program in the Rodeo
area. As indicated in the attached, the Sheliff requests that funds available for the current fiscal year be
used for the Air Support Unit; and, the prior year fund balance available of$30,000 be used for a
Resident Deputy/Community Policing program in the Rodeo area.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Failure to approve the Sheriff's requested use of these funds would be detrimental to the Air Support Unit.
Furthermore, failure to use these funds could result in forfeiting the funds to the State.

Subject: Ike se of rc�nt-line Law Enforcement Funds
Funding provided by Assembly Bill 3229 for front-line law enforcement services,
commonly referred to as Supplement Law Enforcement Services Funds (SLESF), is
used by the Sheriffs Office to support the Sheriff s Office Air Support Unit. The Air
Support Unit began in 1996 with the support of the Board of Supervisors by using these
funds and has continued with these funds and through partnerships with other law
enforcement agencies.
The Air Support Unit, which has two helicopters, is an integral tool for providing law
enforcement services in Contra Costa County. During fiscal year 2003/04, the Air
Support Unit logged the following activity:
Marine Patrol hours over the Delta Waterways 152
Calls for service 409
Assistance to agencies outside Contra Costa County 186
Arrests resulting from Air Support services 14
Arrest assists 32
Pursuit assists 17
Missing person details 5
Captures using the `forward-looking infrared' equipment 10
Attached to these statistics is a host of real-life situations wherein the Air Support Unit
provided public safety services to law enforcement officers and the communities we
serve. These situations include spotting vessels in distress and coordinating rescue
efforts; tracking fleeing murder or robbery suspects; locating missing children or elderly
persons; providing overhead cover in hostage situations; and the list goes on and on.
The amount of Supplemental Law Enforcement Services Funds used for our Air
Support Unit during fiscal year 2003104 was $241,158 and $36,863 was used for the
Rodeo Resident Deputy from July through September, 2003. The fiscal year 2004/05
SL.ESF allocation for front line law enforcement will be $231,105. It is the Sheriff's
Office intention to use the full fiscal year 2004/05 allocation for the Air Support Unit.
The Sheriff's Office also intends to use $30,000 in prior year fund balance for the
Rodeo Resident Deputy.

ADDENDUM
TO SD.2 DECEMBER 7, 2004
On this day the Board considered holding a hearing as required by AB 3229 on the
Sheriffs request to continue to fund with Front Line Law Enforcement funds the Air
Support Unit and to use onetime fund balance in the amount of$30,000 for the Resident
Deputy/Community Policing Program in the Rodeo area.
Supervisor Gayle B.Uilkema advocated that the priorities be reversed, saying that the Air
Support Unit should be second and a Resident Deputy should be first. She went on to say
Rodeo was the community that helped Contra Costa County receive Weed and Seed
money, being one of the most violent communities, in combination with the North
Richmond, and this is why the Sheriff s Office originally chose Rodeo as one of the
recipient communities for the Weed and Seed Program and the Resident Deputy.
Supervisor John Gioia commented on the funding sources that supported the Rodeo
Resident Deputy and inquired why this funding was recommended for a Resident Deputy
for the Rodeo area as opposed to other areas. He felt that North Richmond, which was
also part of Weed and Seed,had a higher crime rate, and the same applied to the Bay
Point Point Resident Deputy. He felt that communities that do not have return-to-source
funds like Rodeo should also be considered for new funding for community policing.
Supervisor Gioia expressed concern about the prioritization of funding one Deputy or
community over another.
Supervisor Mark DeSaulnier directed the County Administrator to look at different or
additional funding sources. He asked to have this done in an ad hoc fashion,realizing
that there are unique circumstances in each community, and felt there should be a policy
that is mutually acceptable to the Sheriff s Office and the Board.
Supervisor Federal D. Glover said he was not comfortable in supporting the proposal to
fund a Resident Deputy for the Rodeo area presently, and that the Board should develop a
policy and a process to prioritize the needs among the various communities. Supervisor
Glover requested the Finance Committee to examine the financing options available in
order to fund the community policing program Countywide.
After further discussion, Supervisor Glover entertained a motion to have the matter
referred to the Finance Committee for examination and report back to the Board.
The motion passed by a unanimous vote with all Supervisors present.
