BACKGROUND/REASONS FOR RECOMMENDATIONS
In 1998, the owner (Peter Ostrosky) filed a tentative map application, (County Fila
#SD988263) with the County to subdivide 5.81-acres into three single-family residences
and a 10-unit, single story, townhouse development for seniors 55 years and older. This
project also included filing rezoning (from R-20 to P-1) and development plan applications
(County File #s RZ983069 and DP983025). The San Ramon Valley Regional Planning
Commission heard the matter in December of 2000, at which time, based on several
neighbors and some community opposition, stated the commission's intent to deny the
project and continued the hearing to a later date. The site is located on the north side of
Livorna Road, immediately east of Interstate 580 in the Alamo area.
The owner and applicant revised the proposed project, on the recommendation of the
planning commission, by reducing the number of townhouse units from ten to eight. On
May 16, 2001, the project was rescheduled and heard by the San Ramon Valley Regional
Planning Commission with the project revisions. The Commission took testimony on this
modified project and closed the public hearing. On June 20, 2001, the San Ramon Valley
Regional Planning Commission denied the subdivision application and recommended the
Board of Supervisors deny the rezoning and Final Development Plan applications.
The applicant then appealed the Planning Commission's decision to the Board of
Supervisors. On December 11, 2001, the Board of Supervisors upheld the appeal by Mr.
Ostrosky (owner) of the San Ramon Regional Planning Commission's denial of the project
and approved the vesting tentative map and Final Development Plan under the Planned
Unit District (P-1) for the Alamo Gardens project. This authorized the establishment of
three single-family residences and a cluster development for seniors age 55 or older with
eight attached "duet" units,
The approval of the tentative map triggered a three-year period under provision of the
subdivision ordinance for filing a final map. In a letter dated September October 6, 2004,
the representative for the property owner has requested a one-year extension of the period
for filing a final map.
DISCUSSION
Government Code Section 66452.6(e) of the Subdivision Map Act allows a subdivider to
apply to the County for extending the period for filing map for up to 5 additional years
beyond the initial period allowed by ordinance.
It should be noted that under Section 65863.9 of the Government Code, any extension of
the period for filing the final map automatically extends the filing period for acting on the
Final Development Plan of the Planned Unit Development for this site.
Staff sees no reason why the subject request should not be granted. If the request were
granted, the subdivider would retain the right to file for an additional four-year request prior
to expiration of the extended 'I-year period.

Gentlemen:
On behalf of Peter Ostrosky, the owner of the property for the Alamo Gardens
Subdivision No. 8263, I am requesting a one-year extension of the approval of the
tentative map, and the Final Development Plan under the Planned Unit District for the
development of three single-family'residences and an 8-unit cluster development as
approved by the Board of Supervisors on December 11, 2001, which will expire on
December 11, 2004.
We have submitted all plans and maps and have gone through two plan checks. We
are anticipating approval and recording shortly. However, Mr. David Bruckbank
suggested we should be safe rather than sorry, and should request the automatic one-
year extension to December 11, 2005.
It is our understanding that based on preliminary conversations with David Bruckbank,
County Planner assigned to this project, that this will be handled administratively and a
public bearing will not be required.
