BACKGROUND
This appeal concerns proposed modification to the approved grading plan for a planned unit, hillside
development project located to the west of the City of San Ramon. The project allowed for mass
grading, but prohibits any import or export of earth material from the site. The project is approximately
half complete. As a result of largely unexpected conditions, the project has produced excess fill
material that was placed in a portion of the site that is in a visually sensitive location.
The San Raman Valley Regional Planning Commission heard this project in November (on appeal
from the Zoning Administrator approval). In order to make the necessary legal findings, the
Commission felt compeller) to further restrict the heights of future residential development along the
perimeter of the project (beyond the design restrictions imposed by the Zoning Administrator).
The Subdivision Developer appealed that decision to the Board. However, more recently,afterfurther
studying the matter,the Subdivision Developer determined that they are able to accept the restrictions
of the Planning Commission decision and has withdrawn their appeal.
Actions Leading Up to this Development Permit Application
In 1992,the Beard of Supervisors approved the Wiedemann Ranch Residential Community
project as a Planned Unit(P-1)clustered development on 1100 acres for 371 residential lots
and three agricultural parcels, located to the west of the City of San Ramon, and east of
Alameda County, on the south side of Norris Canyon Road. The project involves a mass-
graded hillside development.
Prior to approving the project, the County prepared an Environmental Impact Report that
analyzed the project for possible environmental impacts. One portion of that analysis
considered the potential for aesthetic impacts of developing this hillside project. A major part
of that analysis considered the visual effects of development of portions of the site that would
be more visible from off-site vantage points, including a portion of the eastern perimeter that
has come to be identified as the Cross Valley Ridge. The EIR analyzed the visual impacts of
the development as seen from off-site long-range vantage points (San Ramon Valley), and
from short-range vantage points (Bishop Ranch Open Space). The report acknowledged
that development on the Cross Valley Ridge would be seen but would not significantly affect
views from the San Ramon Valley due to the distance of the site from the Valley that would
make development barely perceptible.
The project was subsequently renamed the Norris Canyon Estates project. In 1995, the
subdivision developer entered into an Amended Development Agreement with the County
that vested the developer with the right to complete the project. The Amended Agreement
also includeda condition to require that the project provide for on-site balancing of fill
material (no import or export allowed).
After obtaining a grading permit in 1998,the subdivision developer(at that time, HCV Pacific
Partners was still the developer) obtained grading permits and proceeded to complete the

rough grading for the project. Furthermore, three phased find maps have been recorded,
and approximately one-third of the residences have been built.
As a result of several factors in the development including localized soil failures,the project
generated excess soil. The applicant placed excess earth material along a portion of the site
identified as the Gross Valley Ridge,located on the eastern perimeter of the project, adjacent
to the Bishop 'Ranch Open Space. The County Grading Inspectors discovered that the
grading conditions for this portion of the site did not match the approved grafting plans. Staff
advised the applicant that they would need to obtain an amendment to the Final
Development Plan to allow the added earth material to remain in this visually sensitive
portion of the site.
Review of Application to Amend the Final Development Man
In 2001, HCV Pacific Partners applied to the County to amend the Final Development Plan to
allow the excess grading material to remain in place along the Cross Valley Ridge. The
added fill increased the pad heights to 5 feet above the approved pad height elevations.
Sometime after the application was filed, the property was conveyed to the current
developer, Toll Brothers.
Staff studied whether the added fill would create any significant visual effects of the grading
change. Special attention was given to potential view effects of the proposed change as
seen from Derby drive. The views from several representative vantage points along Derby
Drive were studied, and staff determined that the proposed changes would not result in
development that would be visible from those vantage points. Staff also determined that the
change in pad heights would not allow for a perceptible difference in visibility as seen from
various San Ramon Valley vantage points, and only a minor increase in visibility from the
nearby Bishop Ranch Open Space.
October 6, 2004 Zoning Administrator Hearing,
After exploring a range of alternatives with the applicant, staff determined that the
Developer's proposal made the most sense, and recommended approval of the modification,
but subject to conditions that limited the heights of some residences along the Gross Valley
Ridge. The Zoning Administrator conducted a hearing on this matter on October 6, 2004 at
the Board Room of the San Ramon Valley Unified School District in Danville. Several
neighbors testified in opposition to the application. After taking testimony, the Zoning
Administrator concurred with the staff findings and approved the recommendation.
Citizen Appeal of Zoning Administrator Decision
In a letter dated October 16, 2004, Jim Blickenstaff appealed the Zoning Administrator
approval; the,appeal opposed granting the proposed amendment that would allow the pad
heights along the Gross Valley Ridge to be increased.

November 17,2004 Planning Commission Hearing
The Sen Ramon Valley Regional Planning Commission conducted a hearing on the
Blickenstaff appeal on November 17, 2004. After taking testimony, the Planning
Commission also agreed with the Zoning Administrator finding that the visual analysis of the
selected vantage points from Derby Drive indicated that the proposed change in grading
would not result in development that would be visible from those vantage paints. However,
the Commission determined that additional development restrictions were necessary in order
to make the required ordinance findings. As a result,the Commission further restricted the
height of residential development alone the Cross Valley Ridge, beyond the restrictions
required by the Zoning Administrator.
Subdivision Developer Appeal of Planning Commission Decision
The period for filing an appeal on the Planning Commission decision extended to November .
29, 2004. Ina letter dated November 29,2004,the Subdivision Developer filed an appeal of_
the Planning Commission decision to impose additional restrictions. This was the only
appeal timely filed on the Commission decision.
Receipt of Recent Utter from Subdivision Develooer Withdrawing their Appeal
After further study, the Subdivision Developer determined that they could accept the
Planning Commission decision including the height restrictions on residential design. in a
letter dated December 9, 2004, the subdivision developer has withdrawn their appeal.
DISCUSSION
This appeal hearing had been scheduled on this agenda and the notices for the Board's
hearing were issued prior to receipt of the letter from the Developer withdrawing their appeal.
Insofar as the Developer's appeal is the only condition that prevented the Planning
Commission decision on the application from becoming final, the recent withdrawal of that
appeal causes the November 17, 2004 Planning Commission decision to become final.

#DPO13062: A hearing on an appeal of the San Ramon Valley Regional Planning
Commission decision to grant an amendment to the Norris Canyon Estates (aka
Wiedemann Ranch Residential Community) Final Development Plan to allow excess
fill (presently in place) within a portion of a partially developed phase of the project,
Final Subdivision Map (FSM) 7996. The location of the amendment is on the eastern
perimeter of the project,along the so-called Cross Valley Ridge. The added fill results
in an increase in pad elevations from what is shown on the approved development
plan.. In addition, the applicant is requesting to place excess fill in a shallow Swale that
is approximately one-acre in area in the designated open space area below Lots 17-21
in FSM 7996. The subject site encompasses approved residential lots on either side of
Ashbourne Circle, southeast of Camberly Court in the San Ramon area) (Refer to
Exhibits A and B)for location of project site. (CT: 3451.98)(Parcel#: 209-050-042 and

An addendum to the 1992 Final Supplemental Environmental Impact Report to this
project has been completed and concludes that no new significant environmental
impacts would result from this project.
