(District II) FISCAL IMPACT: None. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): The developer, Trilogy Homes Inc., has installed the public and private improvements in a good workmanlike manner as required by the improvement plans and in conformance with the County Ordinance Code. CONSEQUENCES OF NEGATIVE ACTION: The security bond will not be exonerated. (District II) DATE: December 14, 2004 PAGE: 2 BE IT FURTHER RESOLVED that the Fire Department turnaround and drainage infrastructure improvements are ACCEPTED and DECLARED to be County roads;the right-of- ways were conveyed by separate instrument, recorded on October 10, 2000, in Book 179 of Parcel Maps on Page 36 and 37. BE IT FURTHER RESOLVED that the private improvements have been COMPLETED and are NOT ACCEPTED NOR DECLARED as County roads, at this time. BE IT FURTHER RESOLVED that there is no warranty period required, and the Public Works Director is AUTHORIZED to pay the Public Works Department the$1,000.00 cash deposit, plus interest (Auditor's Deposit Permit No. 356137, dated September 14, 2000) per developer's written permission dated November 18, 2004 and the Subdivision Agreement and Surety Bond, Number 8660845, issued by Developers Insurance Co., are exonerated.
