RECOMMENDATION(S):
ADOPT Resolution No. 2004/661 for Minor Subdivision 91-00050,accepting completion of public and private
improvements(Oakvale Road)and accepting completion of warrantyperiod,for project being developed by Trilogy
Homes, Inc., Walnut Creek area. (District II)
FISCAL IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The developer, Trilogy Homes Inc., has installed the public and private improvements in a good workmanlike
manner as required by the improvement plans and in conformance with the County Ordinance Code.
CONSEQUENCES OF NEGATIVE ACTION:
The security bond will not be exonerated.

The Public Works Director has notified this Board that the improvements in Minor
Subdivision 91-00050 have been completed as provided in the Subdivision Agreement with Trilogy
Homes, Inc., heretofore approved by this Board in conjunction with the filing of the Subdivision
Map.

SUBJECT: Accepting completion of public and private improvements (Oakvale Road) and
accepting completion of warranty period, Minor Subdivision 91-00050, Walnut
Creek area. (District II)

BE IT FURTHER RESOLVED that the Fire Department turnaround and drainage
infrastructure improvements are ACCEPTED and DECLARED to be County roads;the right-of-
ways were conveyed by separate instrument, recorded on October 10, 2000, in Book 179 of Parcel
Maps on Page 36 and 37.
BE IT FURTHER RESOLVED that the private improvements have been COMPLETED
and are NOT ACCEPTED NOR DECLARED as County roads, at this time.
BE IT FURTHER RESOLVED that there is no warranty period required, and the Public
Works Director is AUTHORIZED to pay the Public Works Department the$1,000.00 cash deposit,
plus interest (Auditor's Deposit Permit No. 356137, dated September 14, 2000) per developer's
written permission dated November 18, 2004 and the Subdivision Agreement and Surety Bond,
Number 8660845, issued by Developers Insurance Co., are exonerated.
