(Cities Stormwater Utility Fee Assessments)(All Districts) Project No.0929 6x7053 SPECIFIC REQUESTS)OR RECOMIvIENIDATION(S)&BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE and AUTHORIZE the Chief Engineer, Flood Control and Water Conservation District on behalf of the Contra Costa Clear}Water Program, or designee, to execute an agreement with the Central Contra Costa unitary District, the Delta Diablo Sanitation District and the East Say Municipal Utility District on behalf of the following fifteen Contra Costa Clean Water Program members: Antioch, Clayton, Concord, Danville, El Cerrito, Lafayette, Martinez, Moraga, Oakley, Orinda, Pinole, Pittsburg, Pleasant Hill, San Ramon, and Walnut Creek, to provide stormwater inspection and illicit discharge control services for the period July 1, 2003 through June 30,2005, with options to extend two times, at two year intervals, up to June 30, 2009, Countywide. (Cities Stormwater Utility Fee Assessments)(All Districts) Project No. 0929 6x7053 BATE: October 28, 2003 PAGE: 2 IL Fiscal Impact: The cost shall be funded by stormwater utility fee assessments collected by the cities proportioned to their respective populations. III. Reasons for Recommendations and Background: The United States Environmental Protection Agency issued the National Pollutant Discharge Elimination System (NPDES)Regulation for municipal stormwater discharges on November 16, 1990 requiring Contra Costa County,nineteen(19) of its incorporated cities and the Contra Costa County Flood Control and Water Conservation District to obtain a Joint Municipal NPDES permite from the San Francisco Bay and Central Valley Regional Water Quality Control Boards. The Permits require municipalities to eliminate all pollutants from entering the municipal storm drain system. IV. Consequences of Negative Action: If the agreement with the Central Contra Costa Sanitary District,the Delta Diablo Sanitation District, and the East Bay Municipal Utility District is not approved, then municipalities will be in non- compliance with the Joint Municipal NPDES permits issued by the San Francisco Bay and Central Valley Regional Water Quality Control Boards. Potentially,fines totaling$10,000 per day and$10 per gallon of stormwater discharge for all affected entities could be imposed.
