HomeMy WebLinkAboutMINUTES - 10282003 - C17 f V THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on October 28, 2003 by the following vote: AYES: SUPERVISORS GIOIA, UILK.EMA, GREENBERG, GLOVER AND DESAULNIER NOES: NONE ABSENT: NONE ABSTAIN: _NONE RESOLUTION NO. 2003/ 650 SUBJECT: Approve and Authorize the California Highway Patrol to enforce the California Vehicle Code on private streets in Gale Ranch Phase II, being developed by Shapell Industries of Northern California, a Division of Shapell Industries,Inc., as recommended by the Public Works Director, in the San Ramon(Dougherty Valley) area. (District III) IT IS BY THE BOARD RESOLVED that the California Highway Patrol is authorized to enforce the California Vehicle Code on private streets in Gale Ranch Phase II. The Contra Costa County Public Works Department received a petition dated September 25, 2003 from Shapell Industries of Northern California,a Division of Shapell Industries,Inc.requesting California Highway Patrol enforcement of the California Vehicle Code on private streets in Gale Ranch Phase II in the San Ramon(Dougherty Valley) area; and WHEREAS,under California Vehicle Code section 21107.5,the California Highway Patrol may provide vehicle code enforcement on private streets upon enactment by a county resolution; and WHEREAS, upon formal acceptance by the City of San Ramon of Gale Ranch Phase II streets as public roadways,the City of San Ranson Police Department will be responsible for the enforcement of the vehicle code; and NOW,THEREFORE,BE IT RESOLVED,that the Board of Supervisors of the County of Contra Costa does hereby approve and authorize the California Highway Patrol to enforce the California Vehicle Code on private streets in Gale Ranch Phase II subject to the following conditions: 1. All private streets must meet applicable traffic engineering standards. 2. The installation of signage indicating the private streets is subject to California Vehicle Code enforcement. September 25, 2003 Contra Costa County Public Works Department 255 Glacier Drive Martinez, CA 94553-4825 Attention: Mr. Larry Theis Re: Gale Ranch Phase H; CHP Enforcement Dear Mr. Theis: Shapell Industries of Northern California hereby requesting the County to provide CHP enforcement of streets within Gale Ranch Phase 11 that have been constructed and open to public traffic, but have yet to accepted by the County. I have attached a map that identifies roadways that meet these criteria as of the date of this letter. The MOD for Dougherty Valley references the City of San Ramon as the provider of police services for Dougherty Valley, and costs for these services are covered by the CSA M-29 fee assessment. However, we have been informed by your office that there will be no cost assessed to Shapell or our homeowners for the interim enforcement provided by the CHP. (a) Any city or county may, by ordinance or resolution, find and declare that there are privately owned and maintained roads as described In the ordinance or resolution within the city or county that are generally held open for use by the public for vehicular travel and which so connect with highways that the public cannot determine that the roads are not highways. Upon enactment by a city or county of the ordinance or resolution, this code shall apply to the privately owned and maintained road, except as provided in subdivision (b).
