Recommended Action: AUTHORIZE the Public Works Director,or designee,to execute a Consulting Services Agreement Amendment No.1 effective October 1, 2003 with Vali Cooper & Associates, Inc. for construction management services. It. Financial lmpact: There will be no impact on the County General Fund. The Consulting Services Agreement Amendment limit increase is $50,000 for a new total of $30,000 and shall be paid for by (44% Metropolitan Transportation Commission Funds, 43% Redevelopment Agency Funds, 10% Community Development Block Grant, 3% Local Road Funds). Reasons for Recommendations and Backaround: Additional funding is needed to pay the contractor for increases in contract quantities. To achieve a more stable pavement surface, quantities were increased above the engineer's estimate. Thus, because more material was used per square yard of pavement, costs were higher than estimated. IV. Consequences of Negative Action: The lack of approval would prevent successful completion of this contract and preclude payment to the contractor for required work. Project No. 4660-6X4287 Pittsburg Area The Board of Supervisors of Contra Costa County RESOLVES THAT: Contra Costa County acquired certain real property on August 7, 2001 in the City of Pittsburg, for highway purposes. A portion of said property located at 75 Bliss Avenue, Pittsburg, described in Exhibit "A" attached hereto, is DETERMINED to be surplus and no longer necessary for County or other public purposes. The parcel was purchased with Contra Costa Transportation Authority (CCTA) funds. This Board hereby APPROVES and AUTHORIZES the exchange of said property to Mario J. Hernandez, pursuant to Streets& Highways Code Section 960 and the Board Chair is hereby AUTHORIZED to execute a Grant Geed. The County is acquiring approximately 1 acre of land and improvements located at 107 Bliss Ave, Pittsburg, for the State Route 4 East Project on behalf of the Contra Costa Transportation Agency. The total compensation for the acquisition is $1,258,000. Mario J. Hernandez has received a cash payment of $436,000 and by this exchange will receive additional land and improvements with an estimated fair market value of$847,000.The remaining balance of $25,000 shall be paid to the County by Mario J. Hernandez as agreed upon in the Right of Way Contract. The Real Property Division is DIRECTED to cause said Grant Deed to be delivered to the grantee. The Board of Supervisors ADOPTED the Mitigated Negative Declaration/Finding of No Significant Impact on March 27, 2001. Reasons for Recommendations and Background: These 'property rights pertaining to the property located at 107 Bliss Avenue in Pittsburg, are required for the State Route 4, Railroad Avenue to Loveridge Road project in accordance with the approved plans and specifications. The total value of compensation for the necessary property rights is $1,258,000. This compensation will be achieved by two separate transactions. One will be a cash payment, and the other will be a property exchange. A cashpayment of $436,000 was withdrawn from deposit with the State for a pending eminent domain action. The property exchange transaction is valued at $847,000 (to be approved under separate board resolution dated October 28, 2003). The remainder balance of $25,000 will be paid to the County by Mario J. Hernandez as agreed upon in the Right of Way contract. 1V. Consequences of Negative Action: The project will not have sufficient land rights to allow construction in accordance with the approved plans and specifications.
