Subject: Candidate Statement Regulations for the 3-2-04 Primary and 11-2-04 General Elections
WHEREAS, Elections Code 13307 provides that: Before the nominating period opens,the local
agency shall determine whether a charge shall be levied against the candidate for the
candidate's statement sent to each voter; and
That decision shall not be revoked or modified after the seventh day prior to the opening of the
nominating period; and that
A written statement of the regulations with respect to charges for shall be provided to each
candidate.
NOW THEREFORE, the Board of Supervisors RESOLVES the following:
1. Candidate statements for the Board of Supervisors and Superior Court.fudge shall not
exceed 250 words.
2. The format and structure of the candidate statements must comply with the 250 word
maximum limit, fit within the allotted space on the appropriate form provided by the elections
official, and meet the font size, darkness and uniform spacing specifications as determined
by the Elections Department.
3. Candidates for the above named offices who file a statement shall be required to pay in
advance to the Elections Department the estimated pro rata share as of the cost of
preparing, producing, and distributing the statement as shown on the attached table.
4. Such estimated advanced payment shall be made at the time of filing of the statement. The
candidate shall be given written notice that the estimate is just an approximation of the actual
cost, which varies from one election to another election and may be significantly more or less
than the estimate, depending on the actual number of candidates filing statements.
Accordingly the elections official is not bound by the estimate and may, on a pro rata basis,
bill the candidate for additional actual expenses or refund the excess paid depending on the
final actual cost.
5. The Elections Department shall not provide for the distribution of additional candidate
materials.
