County. All AHFC members are appointed by the Board of Supervisors to serve a three-year term. In June 2003, seats for the West County cities, the County, and the Community expired. The East County cities seat has been vacant since June 30, 2002. Consistent with County policy, an open recruitment process was conducted to fill all vacancies. Four applications have been received. The applications for the County and the Community representatives will be forwarded to the IOC committee for consideration. Applicants for the city representative positions are endorsed by the appropriate cities and forwarded to the Board of Supervisors for approval. Lori Trevino,a City of El Cerrito employee, has been an active member of the committee representing the West County cities. She has provided valuable insight during her review of applications for funding and would like to continue to serve. Community Development staff surveyed the cities of El Cerrito, Hercules, Pinole and San Pablo to seek support to re-appoint Ms. Trevino to the AHFC as the West County Representative. All four jurisdictions indicated support for her reappointment to a new three-year term. James Como, an employee with the Federal Reserve Bank of San Francisco, applied to represent the East County cities. CDD staff contacted the cities of Antioch, Brentwood, Oakley, and Pittsburg to seek support of his appointment to the committee. All four jurisdictions support this applicant. kkh/word/B0S-AHFC1 THE REDEVELOPMENT AGENCY OF CONTRA. COSTA COUNTY, CALIFORNIA Adapted this Order on October 14, 2003,by the following vote: AYES: S JPMSI(#MS GIOTA, UlI MA, GR E MMM, GIOUR and;I)eSAUUUM NOES:Nth ABSENT: N ABSTAIN: INE Resolution No.: 2003/632 SUBJECT: Resolution of the Redevelopment Agency of the County of Contra Costa approving subordination of disposition and development requirements to refinancing for the Park Regency development in the Pleasant Hill BART Station Redevelopment Project Area. The Contra Costa County Redevelopment Agency RESOLVED THAT: The Agency and Park Regency Partners (the "Owner")have entered into a Disposition and Development Agreement(the "DDA")pursuant to which Owner developed an 892 unit apartment development(the "Development")in the Pleasant Hill BART Station Redevelopment Project Area. The DDA has affordability restrictions that require that 134 of the units in the Development be rented at affordable housing costs to persons and families of low and moderate income. The County of Contra Costa has previously issued bonds for the financing of part of the costs of constructing the Development and obtained other private financing for the remainder of the costs of construction of the Development. The Owner desires to refinance the existing debt for the Development so as to lower the financing costs for the Development. In connection with that refinancing, the County will issue new bonds and Owner will refinance the other private financing for the Development. US Bank National Association will be the trustee for the bonds and Fannie Mae will provide the credit enhancement for the bonds. The private financing will be provided by ARCS Commercial Mortgage Co. L.P. The Owner has requested that the Agency agree to subordinate the affordability restrictions in the DDA to the interests of the holders of and credit enhancement providers for the new bonds and the holders of interests in the other private financing for the Development so as to facilitate the refinancing of the Development. Owner has provided to the Agency information indicating that there is no economically feasible alternative means of refinancing the debt for the Development, without subordination, on terms comparable to those that Owner will obtain with its proposed refinancing. 320\01%173020.1 Resolution No. 2003/632 The Agency and the County are desirous of going forward with the refinancing for the Development because, as part of the refinancing, Owner has agreed to and the Agency has approved the Fourth Amendment to the DDA, which provides for all 134 affordable units in the Development to remain affordable to low income persons and families until 2021. Prior to the Fourth Amendment, in 2007, the Owner could have converted 60%of the affordable units to ones that were affordable at the moderate income level rather than at the low income level. The Agency hereby finds that there is no economically feasible alternative means of refinancing the debt for the Development, without subordination of the DDA, on terms comparable to those that Owner will obtain with its proposed refinancing. The Agency hereby authorizes the Executive Director or his designee to execute such agreements or other documents as are necessary in the judgment of the Executive Director or his designee to effectuate subordination of the DDA to the interests of the lenders and credit enhancement providers for the proposed refinancing, provided that such agreements or other documents shall include written commitments (such as those described in subsection(a)(4) of Health and Safety Code Section 33334.14) from the lenders and/or credit enhancement providers designed to protect the Agency's interest in the event of a default by the Owner under the bond and loan documents for the refinancing. The Council consists of 13 members and the internal Operations Committee (10C) reviews nominations to all seats except those designated for County managers and labor organizations. On October 6, 2003, the IOC considered four nominations to fill vacant seats, but is presently recommending only three nominees for appointment. A fourth nominee is not recommended at this time because the seat to which he was nominated has not yet been posted as vacant in accordance with the law. September 7,2003 Contra Costa County Affirmative Action Office 6151 tine Street, I0`b door Martinez,California 94553-1229 Dear Ms, Kuevor: I would like to thank you for taping the time to review my application pertaining to a seat on the Advisory Council on EEC?. As you will note from a review of my resume,I am in charge of the `technical' side of ABM Industries'Affirmative Action compliance(ABM Industries is the largest full facility services contractor listed on the New York Stock Exchange with over 62,000 employees). I work closely with the EEC)Compliance Officer, where together we centrally manage Affirmative Action compliance from the Headquarters'office in San Francisco. I enjoy a great degree of latitude and trust at ARM regarding the selection of Affirmative Action Software, the structuring of EEC)Job Groups, the correlation of Job Titles to Census Codes, and the selection and weighting of regional Labor Areas relevant for Branch Office locations. With the recent technical emphasis in my experience,it can be easy to overlook the eclectic skills and wisdom I have gained in the areas of Psychology,Employee Relations,Business, and even Religion. Though not your typical experience repertoire for this vacancy, I believe I bring a strong portfolio of personal, business, and educational perspectives which merit serious consideration. I will be on vacation the week of September S,but wilt be returning Monday, September 15. 1 look forward to hearing from you. Sincerely, Victor Creisler Manager,Software Support ABM Industries . . . . . . . . . . . . . . . . . . . . . . . . . . . . i CONTRA COSTA COUNTY JVISORY BOARDS, COMMISSIC s OR COMMITTEES APPLICATION FORM Name of advisory board applying for Advisory Council on Equal Employment opportunity Application Form must be typed or hand printed.
