SUBJECT: RATIFY the decision of Richard D. Short, Kleinfelder, Inc., General Manager of the Blackhawk
Geologic Hazard Abatement District(GHAD)to execute a contract with Engineered Soil Repairs
in the amount of $207,299 for emergency repair of landslide damage on the common slope
bordering 923 and 929 Eagle Ridge for the period October 3, 2003 through completion of
project; and APPROVE and AUTHORIZE Richard D. Short, Kleinfelder, Inc., General Manager
of the GHAD to execute contract change orders as may be required up to 10% of the contract
amount or$20,730, Danville area. (District III) Project No. 7760-6X5147
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
RATIFY the decision of Richard D. Short, Kleinfelder, Inc., General Manager of the Blackhawk
Geologic Hazard Abatement District (GHAD) to execute a contract with Engineered Soil Repairs in the
amount of$207,299 for emergency repair of landslide damage on the common slope bordering 923 and
929 Eagle Ridge for the period October 3, 2003 through completion of project; and APPROVE and
AUTHORIZE Richard D. Short, Kleinfelder, Inc., General Manager of the GHAD to execute contract
change orders as may be required up to 10%of the contract amount or$20,730.
IL Fiscal lmpact:
There is no impact to the County General Fund. The funding is 100% Blackhawk GHAD. The proposed
contract is consistent with the adopted Fiscal Year 2003/2004 program budget.

III. Reasons for Recommendation and Background:
During the winter of 1998, a shallow landslide occurred on the common slope behind 923 and 929 Eagle
Ridge, Danville, California. Subsequently, Engeo, Inc., San Ramon, California was retained to observe
the slope failure and make preliminary recommendations. Engeo Inc. observed that the slope failure was
actually larger than anticipated involving the upper area of the slope behind 923 and 929 Eagle Ridge.
The unstable area, measured 250 feet wide by 40 feet high. A repair scheme was recommended that
included excavating and rebuilding the slope with a geogrid reinforced fill and a subdrainage system. At
the risk of further slope movement the repair was deferred. Engeo Inc. was requested to update their
repair recommendations in February 1999. Again, the CHAD deferred repair. In August 2000, the
GHAD addressed the worsening slope conditions with a request that Engeo Inc. prepare detailed slope
repair and keyway construction plans and specifications. The repair was again deferred. By the winter of
2002/2003 the slope movement had extended further onto the homeowners rear yard area creating a
sense of alarm with the homeowners.
The slope repair project was included in the Fiscal Year 2003/2004 budget with an estimated cost of
repair of$250,000. The delay of the slope repair has caused a deterioration of the slope and created a
condition highly likely to cause severe damage to valuable property consisting of the rear yard area
improvements at 923 and 929 Eagle Ridge unless mitigation measures are taken immediately before the
upcoming rainy season.
License Agreements providing the GHAD with sufficient rights to enter upon and repair the landslide
have been executed with the Blackhawk Home Owners Association(HOA) as well as the three affected
homeowners. The License Agreements with the three homeowners provide for the CHAD to partially
reimburse the homeowners the cost of repairing and/or replacing landscaping and other improvements
damaged by the landslide in accordance with the GHAD's interim policy on "Funding for the Repair
and/or Replacement of Landscaping;and other Improvements Damaged by Landslides."
Board Resolution 98/329 defines exceptions to procedures related to advertising and awarding of CHAD
maintenance and repair contracts. Section I.D.2 Emergencies authorizes the CHAD General Manager to
waive the standard contract and bidding award procedures when in the reasonable judgment the project
is necessary to prevent or mitigate an emergency.
IV. Consequences of Negative Action:
Without Board approval, the GHAD will not be able to compensate emergency response contractors and
consultants for the repair and further jeopardize upslope structures at 923 and 929 Eagle Ridge Drive.
