Rupf, Sheriff Costa DATE: September 5, 2003 County SUBJECT: Agreement with the City of Walnut Creek SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION 1. RECOMMENDATION: APPROVE and AUTHORIZE the Sheriff, or designee, to execute an agreement with the City of Walnut Creek to allow the use of the Clarke Memorial Swim Center by members of the Volunteer Dive Team. AUTHORIZE the Sheriff, or designee, to sign the City's Hold Harmless and Insurance Agreement permitting use of the facility. 11. FINANCIAL IMPACT: NONE. There is no cost for the use of the facility. Ill. BACKGROUND: The Emergency Services Division of the Office of the Sheriff manages a dive team, consisting of twelve (12) specially trained and experienced volunteer divers. This group of volunteer divers has a need to occasionally use public swimming pools to practice their skills and develop new techniques for underwater recovery. The City of Walnut Creek can make available one of their pools, which is suitable for the dive team's needs. The permit process, which will allow the dive team use of the pool, includes an indemnification provision that inures to the benefit of the City of Walnut Creek. The Office of the Sheriff requests approval of the indemnification contained in the Hold Harmless and Insurance Agreement(attached) in the City of Walnut Creek's permit package. The Risk Management Division of the Office of the County Administrator has reviewed the indemnification provision and found it to be acceptable. HOLD HARMLESS AND INSURANCE AGREEMENT By my signature below, I hereby agree to and represent the following: Contra Costa County/office of the Sheri f9s a condition of use of City of Walnut Creek facilities on the date(s)of to be determined , hereby agrees to, and shall, defend, indemnify, and held harmless the City of Walnut Creek, its officials, officers, directors, employees, volunteers and agents from and against any or all loss, liability, expense, claim, costs, suits and damages of every kind, nature and description, directly or indirectly, arising from usage or activities for which Use Permits are granted. Contra Costa County will take full responsibility for seeing that use of City facilities is in full adherence and compliance with all applicable City rules and conditions, and the requirements of State Law. On the date(s)of to be determined , commencing at 12:01 a.m. and expiring at 12:00 midnight, Contra Costa County will at its sole expense, maintain in full force and effect a policy or policies of comprehensive general liability insurance written by one or more responsible insurance companies licensed to do business in California, that will insure Contra Costa County , and the City of Walnut Creek as an additional insured, against liability for injury to persons or property and for death of any person or persons with respect to usage or activities under the permit. Each such policy shall be subject to approval by City of Walnut Creek as to form and as to insurance company. The comprehensive general liability insurance policy limits of such insurance shall not be less than $1,000,000 combined single limit.
