DATE: October 7, 2003County , fir SUBJECT: Approval of Agreement to Use Property with City of Antioch SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: APPROVE and AUTHORIZE the Fire Chief to execute an Agreement to Use Property (non-monetary)between Contra Costa County Fire Protection District and City of Antioch for the Fire District's use of certain city properties in Antioch for conducting firefighting training exercises. FISCAL IMPACT: None. BACKGROUNDIREASC?NS FOR RECOMMENDATION: The City of Antioch plans to demolish the city properties in the near future, and this provides the Fire District with an excellent opportunity to conduct firefighting training exercises involving both destructive training activities (e.g., cutting holes in roof and walls to practice ventilation procedures)and non-destructive training activities (e.g., practicing interior search and rescue operations). This agreement sets forth the terms and conditions under which the Fire District can use the property for training purposes and contains an indemnification provision in favor of the City of Antioch. County Risk Management has reviewed and approved the indemnification provision. THE PARTIES AGREE AS FOLLOWS: 1. DISTRICT shall have the right to use the above-described properties for its training activities from September 22, 2003 to October 31, 2003 between 8:00 a.m. and 6:00 p.m. The training activities may include making holes in roofs and in the interior of the structures,but shall be non-destructive and will not involve burning. Any holes created in the roofs or exterior of the structures will be secured with plywood or other acceptable covering by DISTRICT at its cost. 2. The parties agree that DISTRICT shall not be liable for damage of the structures, as CITY intends to demolish the structures for a street widening project after the training is completed. 3. DISTRICT shall conduct the training exercises in as safe a manner as possible. CITY shall not be responsible or liable for any injury, death, or property damage during the training, including DISTRICT personnel. DISTRICT agrees to save, defend, indemnify and hold harmless CITY from any and all claims, costs and liability arising or occurring or resulting from DISTRICT's use of the property. DITRICT's liability extends only until the completion of its training exercises, and it shall have no liability after it has terminated the training and vacated the premises. If. Financial Impa : There will be no impact on the County General Fund. The Consulting Services Agreement is for $180,000. Reasons for Recommendations and Background: The construction contract for the Buchanan Field Airport Electrical Upgrades Project was awarded to the lowest responsible bidder on August 12, 2003. Construction activities began on September 22, 2003 and the Consulting Services Agreement is from September 1, 2003 to June 30, 2004. The construction management services include construction engineering,project management,and construction inspection. Summit Associates was selected for the contract from a field of eight consulting firms. IV. Consequences of Negative Action: If the Consultant Services Agreement with Summit Associates is not approved, it may not be possible to complete construction of the approved project.
