DETERMINE that the Freedom Detention Basile License Agreement between the District and the City is not subject to the California Environmental Quality Riot ( E A.) per the General Rule Of Applicability (Section 16061(b)(3), and APPROVE and AUTHORIZE the Chief Engineer, Or his designee, Fled Control and Water Conservation District, to execute a License Agreement with the City of Oakley (City)for the use Of the Freedom Detention Basin located in the City for the construction of the City's recreation facilities and public use, Oakley area. DIRECT the Director Of Community Development to file a Notice of Exemption with the County Clerk, and AUTHORIZE the Public Works Director to arrange for payment of a $25 fee to Community Development for processing, and a $25 fee to the County Cleric for filing the biotics of Exemption. IlL Reasons for Recommendations and B ound: The City desires to expand their Parks and Recreation facilities and the basin will accommodate the (Zlty's proposed improvements and activities without interfering with the primary function as a flood control basin. The District wishes to execute a License Agreement with the City of Oakley for the development of a common use park facility on the site of the existing Contra Gnats County Flood Control and Fater Conservation District stormwater detention basin at Freedom high School. The facility currently operates as a stormw ter detention basin and would be modified for use as a soccer complex during the dry season and a stormwater detention basin during the Bret season. An evaluation sof the project impacts will be conducted separately by the City of Oakley prior to issuance of a Flood Control District Encroachment Permit. The License Agreement will include language that requires the issuance of a Flood Control District Permit prior to development of the commonuse park facility. IVa Conseguences of Negative Action; if the License Agreement is not executed the City will lose 325,000.00 State grant for the construction of recreation facilities and public use of the Flood Control Basin. DESCRIPTION OF THE ACTIVITY: The purpose of the activity is to enter into a license agreement between the Contra Costa County Flood Control and Water Conservation District (District) and the City of Oakley. The District owns lard located on the northwest corner of Neroly Road and O Nara Avenue in the City of Oakley(APN 034-050-050). The City wishes to enter into ars agreement with the District in order to allow for possible development of a common use park facility on the site of the existing stormwater detention basin at Freedom High School. The facility currently operates as a storrnwater detention basin.
