WHEREAS, Article 3 of the Transportation Development Act (TLA), Public Utilities Code (PUC) Section 99200 etsem, authorizes the subinission of claims to a regional transportation planning agency for the fianding of projects exclusively for the benefit and/or use of pedestrians and bicyclists; and WHEREAS, the Metropolitan. Transportation Commission (MT C), as the regional transportation planning agency .for the San Francisco day region, has adopted MTC Resolution No. 875, revised, entitled `Transportation Development Act, Article 3, Pedestrian/Bicycle Projects,i9 which delineates procedures and criteria for submission of requests for the allocation or"TDA Article 399 funding, and I hereby certify that this is a true and correct copy of an action taken and entered or the minutes of the Board of Supervisors on the date shown. January 28, 2003 PAGE. 2 WHEREAS, MTC Resolution No. 875, devised requires that requests for the allocation of TDA Article 3 ending be submitted as part of a single, countywide coordinated claire from each county in the San Francisco Bay region; and WHEREAS, the CONTRA COSTA COUNTY desires to submit a request to MTC for the allocation of TDA Article 3 hands to support the projects described. in Attachment B to this resolution, which are for the exclusive benefit and/or use of pedestrians and/or bicyclists; now, therefore,be i.. RESOLVED, that the CONIT RA COSTA COUNTY declares it is eligible to request an allocation of TDA Article 3 (ands pursuant to Section 99234 of the Public utilities Code, and furthermore, be it. RESOLVED, that there is no pending or threatened litigation that might adversely affect the project or projects described. in Attachment B to this resolution, or that might impair the, ability of the CONTRA COSTA COUNTY to carry out the project; and furthe ore,be it. Pedestriian/Bievele Proiect Fundiniz Findings page I of 2 1 n That the CONTRA COSTA COUNTY is not legally impeded fron- submitting a request to the Metropolitan Transportation Commission for the allocation o-LETran;portation Development Act (TDA) Article 3 funds, nor is the CONTRA COSTA COUNTY legally impeded from undertaking the project(s) described in Attachment B of this resolution. I That the CONTRA COSTA COUNTY has committed adequate staffing resources to complete the project(s) described on Attachment B. 3. A review of the project(s) described in Attachrnent B has resulted in the consideration of all pertinent matters, including those related to environmental and right-of-way permits and clearances, attendant to the successful completion of the project(s). 4. issues attendant to s-ccuring environmental and right-of4ay permits and clearances for the prqjects described in Attachment B have beers reviewed and will be concluded in a manner and on a schedule that will not j copardize the deadline for the use of f-he TDA funds being requested. 5. That the project(s) described in Attachment B comply with the requirements of the California Environmental Quality Act (CEQA, Public Resources Code Sections 21000 et seq.), and that the CONTRA COSTA COUNTY is in possession of the document(s), or will have by June 2003, supporting such compliance, said document(s)having been made available to for , public review and stain-ped by the County Cler1k or County Recorder of the county in which the claimant is located. 6. That as portrayed in,the budgetary description(s) of the project(s) in Atlaclihment B, the sources of f-anding other than TDA are assured and adequate for completion of the project(s). 7, That the project(s) described in Attachment B are for capital construction and/o.-design engineering; and/or for the maintenance of a Class I bikeway-which is closed to motorized traffic; and/or for the purposes of restriping Class 11 bicycle lanes; and/or for the developmCnt or support of a bicycle safety education programs and/or for the development of a comprehensive bicycle and/o.-pedestrian facilities plan, and an allocation of TDA Article 3 funding for such a plan has not been received by the CONTRA COSTA COUNTY w-.-*tb-:.n the prior five fiscal years. 8. Reasons for Recommendations and BgSKground, On Jure 10, 1997, the Board approved ars amendment to the Marsh Creep load Precise Alignment Plan, as recommended by the Contra Costa County Planning Commission and County staff. The amendment affected 2.48 riles of Marsh Creek Road from the Clayton city limits at Pine Lane to Morgan Territory Read. The amendment was in response to a request by TRAN PAC and TRANSPLAN to ensure that the County General Man policy of a two-lane roadway was carried out. Before the amendment, the Precise Alignment Plan showed a four-lane configuration. The amendment resolved this inconsistency by changing it to a two-lane configuration. A map entitled "A Precise Section of the Streets and Highways Plan, Contra Carta County, 'precise Alignment, Marsh Creels Road„ has been prepared to reflect the amended Precise Alignment. Flan approved by the Board on June 10, 1997. In order to finalize the reap, it is nee sant that the title page be signed by the Board Chair and attested by the Clerk of the Bard. Staff recommends that the Board authorize that action and declare that the reap is effective nuns pro tunc as of June 10, 1997. IV.
