IMPACT. The Dispute Resolution Program is fully revenue offset by funds generated from ars eight dollar filing fee on civil actions in the Superior Court. No County general funds are involved. REASONS FOR RECOMMENDATION/BACKGROUND: The Dispute Resolution Program Act of 1086 (Business and Professional Code Sections 465,et seq.)provided for the establishment and funding, at County option, of local dispute resolution services as an alternative to formal court proceedings. The Act authorized participating counties to increase Superior, Municipal and Justice Courts filing fees from one to three dollars for the purpose of funding the local dispute resolution programs. The Dispute Resolution Advisory Committee was created by the Board to consider implementation strategies and funding guidelines appropriate for Contra Costa County, From 1989 through 1998, the Advisory Committee solicited proposals for funding under the Dispute Resolution Programs Act of 1986. The purpose of the funding is to encourage the establishment and use of local dispute resolution services as an alternative to formal court proceedings. The program operates under the provisions of the Dispute Resolution Programs Act. The Committee formed a County Dispute Resolution Network, which is composed of a representative from each of the funded program agencies. It meets periodically and coordinates County-wide training, advertisement and services. In 1998, the State reissued the California Dispute Resolution Program Act and authorized counties to allocate up to $8.00 from filing fees to generate new revenues for these local programs. Effective January 1, 1999,the dispute resolution portion of the civil filing fee in Contra Costa County increased from $3.00 to $8.00. The increase was approved by the Board of Supervisors pursuant to a request by the Superior Court. The Dispute Resolution Advisory Committee received eight applications in response to a Request for Proposals issued on November 22, 2002. The Committee met on January 9, 2003,to consider funding of the County's dispute resolution programs. The Advisory Committee voted to fund the seven programs at the specified levels. The following is a brief description of each program: STAND! (formerly Battered Women's Alternatives)The Teen Conflict Management Program will provide an alternative school-based and community accessible relationship violence/dispute resolution program to adolescent youth in schools throughout Contra Costa County. The program teaches skills to resolve conflicts non-violently throughout their lifetime. California Community Dispute Services will act as a mediating structure between the justice system (courts, police, probation,and other agencies)and the community—alternatives include facilitation, mediation,and arbitration services. Train and/or provide support services to volunteers, provide general public relations and outreach efforts to educate the community. Center for Human Development/Conflict Resolution Panels will provide direct conflict resolution services including education, information, conciliation, referrals, and mediation in at least 27 cases each month, serving approximately 900 individuals. Train 50 community members in conflict resolution;conduct at least 12 presentations to community groups,businesses, law enforcement agencies,and governmental agencies to educate them about conflict resolution and CRP's services; provide for-fee conflict;resolution training to at least 4 organizations; and conduct at least 5 for-fee mediations. Probation Department The Juvenile Mediation Program provides an alternative forum for victims of juvenile crime and juvenile offenders to reconcile their differences with the hope of increasing the minor's awareness of the consequences of their unintended or intended unlawful acts. The program will continue to operate under the direction of the Victim/Offender Juvenile Mediation Advisory Panel that is chaired by Judge Lois Haight, the Presiding Judge of the Juvenile Court. The Congress of Neutrals — Small Claims Mediation The goal of the project is to increase access to civil justice, reduce the caseload of the clerks and judges at the Superior court, and assist litigants of modest means by developing and implementing limited jurisdiction civil case Alternative Dispute Resolution procedures. Center for Human Development— Small Claims Mediation will provide direct conflict resolutions services and mediations in at least 20 cases each month for litigants in the Walnut Creek Small Claims Court. They will also provide specialized Small Claims Court training to experienced volunteer mediators and work with judges and clerks to maintain operational procedures that result in a uniform and efficient referral system. Center for Human Development—Guardianship Mediation will conduct confidential'mediation sessions in at least 240 cases involving contested guardianship issues referred by the Probate Court. ... Barry, AICP Community Development Director DATE: January 21, 2003 SUBJECT: CONTRACT WITH KEVEN ORMISTON FOR TECHNICAL ADMINISTRATIVE COMPUTER CONTRACT SERVICES SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Authorize the Community Development Director, or his designee,to execute a contract with Keven Ormiston for Department Computer and Information Technology Support in the amount of$57,500.00 for the period of February 1, 2003 through July 31, 2003. FISCAL IMPACT No impact to County General Fund, Costs are covered by the Community Development Department budget from the overhead rate included as part of the land development application processing fees. BACKGROUND/REASONS FOR RECOMMENDATIONS In Spring, 2001,when the permanent IT staff person working within the Community Development Department transferred to another position within the County, Mr. Ormiston took on the responsibilities for the Department's IT operations. Over the pas(year, Mr. Ormiston completed, with assistance from DOIT,the setup and implementation of a CD IT Network including transitioning to digital file storage, photocopying and printing; linking to countywide GIS mapping programs; internal development of multiple data bases for tracking CDBG and Affordable Housing information, land use applications, contact information for projects and the various committees staffed by the department; and augmentation of the services provided through the Department's website. BACKGROUND This agreement involves producing a set of record drawings in CAD format for the Pittsburg Health Center to combine Tenant Improvements, Central Plant, Diagnostic Imaging, and the District Office remodeling projects into one consolidated drawing set. The final set will include the most critical and effective changes made to the facility since the bid documents were issued. Services include developing and incorporating strategic plans, architecture, and models which govern the conversion from Oracle to SQL Server, developing database structure, load scripts and other process to convert and transfer data from Oracle to SQL Server, performing benchmark testing to assure adequate SQL Server performance, and developing benchmark and select reportingtool. BACKGROUND: Hall Kinion & Associates, Inc. was chosen as a result of a competitive solicitation conducted in Fall 2002. Hall Kinion is a listed vendor on the California Multiple Awards Schedule (CMAS) vendor list, from which public agencies may draw professional services. Hall Kinion was selected based on the contractor's experience with information technology systems in human services agencies. This time and materials contract will provide project management support to the department's CafWIN project team. Ca1WIN is a State mandated automated system that will replace 3 legacy systems currently in operation. Services provided under this contract will include the development and maintenance of the project plan, development of a risk management strategy, changecontrol process, communications plan, and the mentoring of project staff in project management best practices.
