FISCAL IMPACT None to the General Fund. This ordinance revises an existing ordinance. Applicants for projects that are subject to the ordinance pay the County's costs to administer its requirements through application fees. BACKGROUND/REASONS FOR RECOMMENDATIONS On May 6, 1997 the Board approved the revision of the County's transportation demand management ordinance and adopted Ordinance 97-12. The revision of the ordinance was designed to strengthen the County's transportation demand management(TDM)program in order to comply with the Measure C Transportation Improvement and Growth Mangement Program as well as the state's Congestion Management Program. Staff have recently reviewed this ordinance and revised the language and format of the ordinance so that it is consistent with the code requirements and the TDM policies of the General Plan. The code requirements are now consistent with the most recent TDM Ordinance adopted by the Board in 1997.(Ordinance No.97-12,Sections I and 11. 2. The language and organization of the Code was revised to reflect the intent and purpose of the ordinance as well as to define what circumstances and types of projects are subject to the ordinance (see Section 82-32.004); and 3. Text was added to provide guidance to the Department for addressing improvements for pedestrian, bicycle and transit access during the review of development applications, pursuant to the TDM section of General Plan's circulation element(see Sections 82-32.010(b)(c)(d)and 82.32-012(b)(c)(d)). To comply with CEQA, Department staff has found pursuant to adopted County CEQA Guidelines,that the TDM Ordinance is Categorically Exempt(Class 5—Minor Alterations in Land Use Limitations)from CEQA (see Exhibit C). On November 19, 2002 the County Planning Commission considered the most recent draft of proposed ordinance and recommended adoption of the ordinance by the Board of Supervisors. A copy of the Planning Commission Resolution and the staff report to the Planning Commission are attached and provide additional background information. REPEAL OF.TDM ORDINANCE. Sections 1, H and IV of Ordinance No. 97- 12 are repealed. SECTION D. TRANSPORTATION DEMAND MANAGEMENT. Chapter 82-32 of the County Ordinance Code is amended in its entirety, to read: CHAPTER.82-32 TRANSPORTATION DEMAND MANAGEMENT 82-32.002 Definitions. As used in this chapter, the following terms shall have the following meanings: (a)"Residential Project".means any residential development application containing thirteen(13)or more dwelling units that roust be approved through a public hearing process and has not received final approval. (b)"Non-Residential Project"means any non-residential or,mixed-case development application that must be approved through a public hearing process and has not received final approval,. Mon-Residential project also includes an application to expand an existing office or hxhistrial structure that has at least five thousand(5,000)square feet of gross floor area,by twenty-five(25)percent or more of the structure's gross floor area. (c)"Sponsor"means the owner or developer of a residential or nova-residential project. (d)"TUM"stands for"Transportation Remand Management." (Orris. 2003- §2,92-31 §3.) 82-32.004 Intent and Purpose. (a)The intent of this chapter is to further the transportation goals of the County General Plan., the Measure C Growth Management Program, Contra Costa County's Congestion Management Program, and the Bay Area Glean Air Plan,. (b)The purpose of this chapter is to implement the provisions of the general plan to promote a more balanced transportation system that takes advantage of all modes of transportation by: ORDINANCE NO. 2003- o 2 Page 1 (1)Incorporating pedestrian, bicycle,and transit access into improvements proposed in development applications. (2) Incorporating the overall intent and purpose of this chapter into the land use review and planning process. (3)Allowing requests for reductions in the off-street parking requirements for residential or non-residential projects that have a conceptual.TDM Program. (4)Providing information to residents on opportunities for walking,bicycling, rideshai-ing and transit. (Ord. 2003- §2. See Ords.97-12, 94-27, 94-26.) 82-32.006 TDM RpgWrements. The requirements of this chapter shall apply to all development projects, residential or non-residential. (Chds. 2003- _ § 2, 92-31 § 3.) 82-32.008 Off-street parking reductions. (a)A project may qualify for reductions in off-street parking requirements pursuant to this section. A sponsor requesting parking reductions shall submit a conceptual TDM program to the Community Development Department concurrently with the application for the project. If the tenant is known,the project sponsor and tenant shall jointly submit the conceptual TDM program. (b)Conceptual TDM Program. The conceptual TDM program shall identify TDM measures that can be demonstrated to attain the trip reductions necessary to qualify for the requested parking reductions. The department shall review the project's conceptual TDM program and make a recommendation to the division of the planning agency.hearing the project application. (c)The sponsor shall include in the tentative map, land use permit,or development plan application, any improvements that will provide access to public transit,ridesharing opportunities and non-motorized forms of travel. (d)If the project lies within a transit service area identified in the circulation element of the general plan, the sponsor shall consult with the transit service provider on the need to provide infrastructure to connect the project with the transit services. Evidence of compliance with this requirement may include correspondence from the local transit provider(s)regarding the potential need for installing bus turnouts,shelters or bus stops at the site. (e)Final TDM:Program. The design and implementation of the final TDM program shall be a condition of a project's approval. The sponsor and all subsequent owners of the project shall provide deed notification of mandatory participation in the final TDM program to all subsequent purchasers and owners of the project. '(Cards. 2003- § 2, 92-31 ; 3.) ORDINANCE NO. 2003-0 2 Page 2 82-32.010_ Residential Projects. (a) A sponsor of a residential project containing thirteen.(13)or more dwelling units shall prepare and implement a TDM program that includes at least the following: (1) Owner-Occupied Units. Upon a residential dwelling being sold or offered for sale,the sponsor shall notify and offer to the buyer or prospective buyer, as soon as it may be done, materials describing public transit,ridesharing,and non-motorized commuting opportunities available in the vicinity of the project. Such.information shall be transmitted no later than the close of escrow. (2)Mental Units. Upon a residential gelling being rented or offered for rent,the sponsor shall notify and offer to the tenant or prospective tenant,materials describing public transit,ridesharing, and non-motorized commuting opportunities in the vicinity of the development. The materials shall be approved by the Community Development Department. The materials shall be provided no later than the time the rental agreement is executed. The sponsor and all subsequent owners of the project shall provide deed notification of mandatory participation in the TDM program to all subsequent purchasers and owners of the project. (b) A sponsor shall include in the tentative map or development plan application, all improvements that will provide access to public transit,ridesharing opportunities and non- motorized forms of travel. (c)A sponsor whose project lies within a local transit service area identified in the circulation element of the genera plan shalt consult withh the local transit service provider on the need to provide infrastructure to connect the project with transit services. Evidence of compliance with this requirement may include correspondence from the local transit provider(s) regarding the potential need for installing bus turnouts,shelters or bus stops at the site. (d) A sponsor of a project that is estimated to generate 100 or more A.M. or P.M. peak- hour trips (based upon the trip generation rates from the ITE Trip Generation, 6#' edition 1997,or the most current published edition)shall prepare.a traffic study that demonstrates hove the project will provide the necessary infrastructure to meet the traffic level of service standards and the performance standards as outlined in the growth management element of the general plan. The study shall be subject to the approval of the Community Development Department and shat, at a minimum: (1)Include a Traffic Impact Analysis if the project could cause;a signalized intersection or a freeway ramp to exceed the applicable standards, including identifying mitigation measures to be implemented(which may include payment of fees),as necessary for the intersection or ramp to operate in conformance with applicable standards. ORDINANCE NO. 2003-0 2 Page 3 (2)Identify any Routes of Regional Significance and/or Intersections with Fmdings of Special Circumstances that would be affected by the project. (These routes and/or intersections will require alternate mitigation applicable to the appropriate Action Plan in the Measure C Growth Management Program.) (3)Identify any arterial or collector roads in the circulation element of the general plan that may be affected by the project. (a)A sponsor shall include in the tentative map or development plan application,all improvements that will provide access to public transit,ridesharing opportunities and non- motorized forms of travel (b)A sponsor whose project lies within a local transit service area identified in the circulation element of the general plan shall consult with the local transit service provider on the need to provide infrastructure to connect the project with transit services. Evidence of compliance with this requirement may include correspondence from the local transit provider(s) regarding the potential,need for installing bus turnouts,shelters or bus stops at the site. A sponsor who is dissatisfied with the number of peak- hour trips as calculated pursuant to section 82-32.010(d)or section 82-32.012(c)may conduct a study to determine the trip generation rate for the project. The study is subject to the approval of the Community Development Department. (Ord.2003-�§ 2.) SECTION III. PRIOR ORDINANCES. Projects approved under any previously adopted TDM or Transportation Systems Management ordinance shall continue to comply with and operate under such ordinances. As to such projects,the previously adopted TDM or Transportation Systems Management ordinance shall remain in full force and effect. SECTION IV. EFFECTIVE IVE DATE. This ordinance becomes effective thirty days after passage,and within fifteen days after passage shall be published once with the names of the Supervisors voting for and against it in the Contra Costa Times,a newspaper published in this County. These strategies are intended to promote the incorporation of pedestrian, bicycle and transit access into the site plans of development applications where appropriate; and WHEREAS, after notice was lawfully given, a public hearing was scheduled before the County Planning Commission on Tuesday,November 19,2002 whereat all persons interested might appear and be heard; and WHEREAS, on Tuesday,November 19, 2002,the County Planning Commission fully reviewed, considered and evaluated all the testimony and evidence submitted in this matter; and WHEREAS,the County Planning Commission discussed why the Transportation Demand Management Ordinance would apply to non-residential project applications proposing to expand an office or industrial structure that has at lease five thousand (5,000)square feet of gross floor area,by twenty-five(25)percent or more of the structure's gross floor area; and WHEREAS, for purposes of compliance with provisions of the California Environmental Quality Act and State and County CEQA guidelines,the project is Categorically Exempt(Minor Alterations in Land Use Land Use Limitations class 5; and NOW,THEREFORE, BE IT RESOLVED that County Planning Commission of the County of Contra Costa recommends for adoption to the Board of Supervisors of the County of Contra Costa the Proposed Transportation Demand Management Ordinance. INTRODUCTION TRANSPORTATION DEMAND MANAGEMENT ORDINANCE,. County File #ZT020005: A proposal to amend the County Ordinance Code to require development applications and land use permits for Residential and Non- Residential Applications to meet the code requirements and the Transportation Demand Management Policies of the General Plan. 11. RECOMMENDATION Adopt a motion: A. Finding that the proposed ordinance is consistent with the General Plan; and B. Recommending that the Board of Supervisors adopt the Transportation Demand Management Ordinance. 111. BACKGROUND The revisers ordinance is intended to address the following issues. The proposed Transportation Demand Management (TDM) ordnance repeals section I, 11 and IV of Ordinance No. 97-12 and amends the Chapter 82-32 of the County Ordinance Code entirely. The County code does not fully reflect the requirements of the existing TDM Ordinance adopted by the Board of Supervisors in 1997. The amended TDM ordinance revises Chapter 82-32 of the County code to correctly reflect the requirements of this ordinance. Portions of the language of the ordinance have been revised to include additional efforts identified in the Transportation and Circulation Elementof the County General Plan that promote TDM strategies. These efforts include the incorporation of pedestrian, bicycle and transit access into site plans of development applications. In addition staff have also been able to draw on our past experience to better describe in the ordinance the type of development applications that should be subject to the ordinance. Page 1 of 5 V. OVERVIEW OF ORDINANCE The existing TDM Ordinance 97-12 imposes requirements on residential and non- residential development applications. The modifications to the language of the TDM Ordinance are intended to clarify the intent and purpose of the ordinance as well as to identify instances in which the requirements should be applied during the review of development plans and applications. The language of the ordinance has also been revised so that the code reflects the requirements of the ordinance and the TDM policies in the General Plan. A copy of the Board action and the text of the proposed ordinance are attached. Below please find a brief summary of some key provisions of the proposed ordinance. • The proposed ordinance establishes new requirements and standards that would regulate how residential and non-residential development projects incorporate pedestrian, bicycle, and transit access improvements into their development plans and applications. • The requirements would apply to the following types of development; 1. Residential development applications containing thirteen (13) or more dwelling units and must be approved through a public hearing process. The existing ordinance requires residential developments to provide information to residents on opportunities for walking,bicycling, ridesharing and transit. 2. Non-residential or mixed-use development applications that must be approved by a public hearing process. Non-residential projects also include any existing office or industrial structure of at least five thousand (5,000) square feet of gross floor area that applies to expand its area by twenty five(25)percent or more. 3. Any project, residential or non-residential, requesting reductions in off-street parking requirements. The existing ordinance requires sponsors of projects that apply for such reductions to submit a conceptual Transportation Remand Management Plan (TDM) to the Community Development Department concurrently with the application. The plan shall identify measuresthat can be demonstrated to attain trip reductions necessary to qualify for parking reductions. Page 2 of 5 V. GENERAL PLAN CONSIDERATIONS Section 65860 of the Government Code requires that a zoning ordinance be compatible with the County General Plan. The following General Plan policies are most pertinent to the proposed ordinance: LAND USE POLICIES 5-18 New development (including redevelopment and rehabilitation projects) shall provide adequate off-street parking, or contribute funds and/or institute programs to reduce parking demand. 5-19 New subdivisions should be designed to permit convenient pedestrian access to bus transit and efficient circulation patterns. 5-21 All efforts to use alternative transportation systems to reduce peak period traffic congestion shall be encouraged. 5-22 Use of alternative forms of transportation, especially transit, shall be encouraged in order to provide necessary services to transit-dependant persons and to help minimize automobile congestion and air pollution. 5-23 Improvement of public transit shall be encouraged to provide for increased use of local, commuter and intercity public transportation. 5-25 Planning and provision for a system of safe and convenient pedestrian ways, bikeways and regional hiking trails shall be continued as a means of connecting facilities, residential areas, and business districts, as well as points of interest outside the communities utilizing existing public and semi-public right-of-way. VI. CEOA DETERMINATION For the purposes of compliance with the California Environmental (duality Act, staff has determined that the proposed ordinance is Categorically Exempt (Class 5 Minor Alterations in Land Use Limitations). V. DISCUSSION The proposed ordinance would aid in meeting the General Plan Transportation and Circulation Element goals, policies, and implementation measures. Specifically, the General Plan describes TDM measures as 1) involving lower capital costs; 2) providing incentives designed to modify travel demand; 3) Page 3 of 5 implemented by local government or the private sector, and 4) giving all travel modes equal consideration in providing access to development. The County currently promotes TIM strategies with its existing ordinance. New residential development is obligated to provide information on the various transportation services available in the vicinity. Any development is allowed reductions in off-street panting if specific conditions are met. The revised ordinance institutes new development review procedures to ensure appropriate consideration is given to pedestrian, bicycle and transit access in site plans. This is achieved through requiring sponsors of a project to include in the tentative map, land use permit, or development plan application, any improvements that will provide access to public transit, ridesharing opportunities and non-motorized forms of travel. The revised ordinance also incorporates existing Measure C-88 traffic study requirements. Any development subject to this requirement will need to evaluate its impact on the transportation system, and determine if any additional efforts to promote pedestrian,bicycle or transit access are warranted. For these reasons, the Department recommends that the proposed ordinance should be adopted as proposed.
