Kramer, County Assessor =`0` Costa , +/ County *11�DATE: -January 7, 2003 FPO— SUBJECT: PARTICIPATION IN THE STATE-COUNTY PROPERTY TAX ADMINISTRATION GRANT PROGRAM SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: ADOPT a resolution electing to participate in the State-County Property Tax Administration Grant Program beginning in FY 2002-03 through FY 2006-07 as recommended by the Assessor. FISCAL IMPACT: This action would allow the County to participate in the State-County Property Tax Administration Grant Program, which provides$2,022,000 annually in funding to offset costs associated with enhancing and maintaining property tax administration programs. REASONS FOR RECOMMENDATIONIBACKGROUND: On November 23, 1995, the Board approved the County's participation in the State-County Property Tax Administration Loan Program. The loan program was initiated under Assembly Bill 818, and made available over $2 million to the County in fiscal years 1995-96, 1996-97 and 1997-98. Subsequent Assembly Bills extendedthe program through fiscal year 2001-02. Since fiscal year 1995-96, the Assessor's Office has received $2,022,000 annually in funding in the form of a loan, which was repaid through the completion of certain work requirements contractually agreed upon with the State. Assembly Bill 589, enacted in October of 2001, created the State-County Property Tax Administration Grant Program that provides the same level of funding beginning with fiscal year 2002-03 through 2006-07, and requires completion of work requirements to be eligible for funding in future years. The Assessor's Office plans to use the revenue received from the State to fund appraisal and support positions, overtime,consultants and automation projects to: enhance the County's property tax administration system; reduce backlogs in changes in ownership, new construction and Proposition 8 restorations; perform mandatory and non-mandatory audits; and defend assessment appeals. Participation in the State-County Property Tax Administration Grant Program is not automatic. Once the Board adopts a resolution electing to participate in the grant program, the County must then negotiate a contractual agreement with the State department of Finance on the terms and conditions of the grant. CONSEQUENCES OF NEGATIVE ACTION: Denial of this action would prevent the County from participating in the State-County Property Tax Administration Grant Program and from receiving $2 million in funding for the Assessor's Office. CONTINUED ON ATTACHMENT: X YES SIGNATURE: "' i rRECOMMENDATION OF COUNTY ADMINISTRATOR RE MME DATION OF BOARD COMMITTEE __4eAPPROVE _OTHER SIGNATURE(S): � ACTION OF BO D January 7. 2003 APPROVED AS RECOMMENDED X OTHER THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this order on January 7, 2003 ,by the following vote: AYES: Supervisors Uilkema, Gerber, DeSaulnier, Glover and Gioia NOES: None ABSENT: None ABSTAIN: None SUBJECT: Revenue and Taxation Code Section 95.35 RESOLUTION NO.":,2003/21 THE CONTRA COSTA COUNTY BOARD OF SUPERVISORS in its capacity as governing Board of the County of Contra Costa and all districts of which it is ex-officio governing Board RESOLVES THAT: WHEREAS, Revenue and Taxation Code Section 95.35 provides that upon recommendation of the Assessor, and by resolution of the Board of Supervisors, the County may elect to participate in the State-County Property Tax Administration Grant Program, administered by the State; and WHEREAS, the County elects to participate in the State-County Property Tax Administration Grant Program administered by the State; and WHEREAS, the Program originally known as the State-County Property Tax Administration Loan Program allowed County participation for each of the fiscal years 1995-96 through 2001-02, inclusive; and WHEREAS, the County may elect to participate in the State-County Property Tax Administration Grant Program for fiscal years 2002-03 to 2006-07 inclusive; and WHEREAS, the County finds it necessary to apply for this grant to continue enhancing its property tax administration system; and WHEREAS, the supplemental resources provided by the grant will increase the Assessor's value enrollment capabilities; and WHEREAS, in order to participate in the State-County Property Tax Administration Grant Program,the County must enter into an agreement with the State; and WHEREAS, the Contra Costa County Assessor believes he can satisfactorily meet the conditions contained in the agreement; and WHEREAS, the funds obtained through the Program shall be used to increase assessment productivity by funding Assessor positions, overtime, and increased automation as listed in Exhibit A of the agreement; and WHEREAS, the funds obtained through the Program .chnll not hP rieprl to cimrtilant fl,. WHEREAS, it is in the best interest of the Contra Costa County to take advantage of the State-County Property Tax Administration Grant Program because it provides much needed funding. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CONTRA COSTA AS FOLLOWS: The County hereby elects to participate in the State-County Property Tax Administration Grant Program, as provided in Section 95.35 of the Revenue and Taxation Cade, for fiscal year 2002-03. This resolution shall remain operative until rescinded, but in no event beyond June 30, 2007, unless otherwise permitted or authorized by lave.
