The contractor encountered additional costs when the roadway was extended wider than the plans were originally designed. IV. FINANCIAL IMPACT: The estimated contract cost of the project is$665,000, funded by Federal Highway Bridge Rehabilitation and Replacement Program (80%) and Local Road Funds (20%). III. REASONS FOR RECOMMENDATIONIBACKGROUND: The project is needed to replace a bridge that is classified as"functionally obsolete"and to provide a durable replacement structure using modern bridge construction materials. The Public Works Director will file with the Board of Supervisors the Plans and Specifications for the project at the time the project is advertised. The general prevailing rates of wages, which shall be the minimum rates paid on this project, have been filed with the Clerk of the Board and copies will be made available to any interested party upon request. The Board reviewed and approved the project on December 14, 1999 and found, on the basis of the initial study and all comments received, that there is no substantial evidence that the project will have a significant effect on the environment and adopted the Negative Declaration in compliance with the California Environmental Quality Act. A Notice of Determination was filed with the County Clerk on December 16, 1999. A detour road will be constructed adjacent to Bailey Road to allow for the construction of the new bridge in the same location as the existing bridge. The detour road will be built west of the existing Bailey Road between Monroe Way and Myrtle Drive and will be in effect for approximately 22 weeks. IV. CONSEQUENCES OF NEGATIVE ACTION: If the project is not approved for advertising, it will not be constructedand Federal funding may be jeopardized. TO.: BOARD OF SUPERVISORS FROM: MAURICE M. Reasons for Recommendations and Background: Applying for and obtaining grants allows the County to construct more improvements than would be possible without obtaining grants. The North Richmond Curb Ramps project consists of installing curb ramps at intersections in the North Richmond Mousing Authority area. The curb ramps are needed to facilitate the movement of people in wheel chairs, and mobility impaired pedestrians along the streets of North Richmond. IV. Consequences of Negative Action: Failure to approve the submittal of these applications will eliminate a potential funding source and possibly delay the construction of the projects. The County has been awarded a grant of$7,000 from the Metropolitan Transportation Commission (MTC). Ill. Reasons for Recommendations and Background: Contra Costa County has been awarded a grant of $7,000 by MTC for Traffic Engineering Technical Assistance (TETAP)to study optimum traffic operations at the intersection of Livoma Road and Wilson Road, in the Alamo area. The grant is in the form of a $7,000 credit with an expert traffic consultant, retained by MTC.The value to the County greatly exceeds the underlying $7,000 dollar value as MTC retains the traffic consultants for the overall grant program. In addition to the consulting services,the County gains value from the administrative time and cost provided by MTC to advertise, interview, select and administer the consulting services contract. Execution of the Indemnification Agreement is a requirement for the grant award. The agreement waives the Counties right to file a claim against MTC and agrees to indemnify and hold harmless MTC from third party claims resulting from or in connection with the traffic engineering services under contract to MTC. IV. Consequences of Negative Action: Failure to approve the agreement will result in forfeiture of the grant funding. INDEMNIFICATION AGREEMENT Between METROPOLITAN TRANSPORTATION COMMISSION And CONTRA COSTA COUNTY THIS AGREEMENT is made and entered into as of the7nt day of_ January_ ,2003, by and between the Metropolitan Transportation Commission, a regional transportation planning agency established pursuant to California Government Code § 66500 et seq., (herein called "MTC'), and CONTRA COSTA COUNTY(herein called"COUNTY"). WITNESSETH WHEREAS, MTC has entered into technical services agreements with a number of traffic engineering firms under which such firms will provide traffic engineering assistance to various Bay Area cities(herein called"the Project"); and WHEREAS, COUNTY is participating in the project by receiving traffic engineering assistance from one of MTC's consultants ("the Traffic Engineering Consultant"); NOW, THEREFORE,the parties hereto agree as follows: 1.0 WAIVER OF MTC LIABILITY COUNTY waives all claims by COUNTY against MTC, its commissioners, officers,and employees for damages, loss,injury and or liability, direct or indirect, resulting from COUNTY's participation in the Project and/or the services provided to COUNTY by the Traffic Engineering Consultant under contract to MTC. 2.0 INDEMNIFICATION AND DEFENSE COUNTY agrees to indemnify,hold harmless and.defend MTC, its Commissioners,officers, and employees from any and all third party claims,demands, lawsuits, liability, loss and/or damage(including any and all cost and expenses in connection therewith), resulting from or in connection with provision of traffic engineering services to COUNTY by the Traffic Engineering Consultant under contract to MTC,to the extent such claims, demands,etc. are not covered by the Traffic Engineering Consultant's indemnification of MTC in its contract with MTC.
