BACKGROUND f REASONS FOR RECOMMENDATIONS On August 21, 2002, an application was submitted to nominate a Valley Oak tree for Heritage statin. The San Ramon Valley Regional Planning Commission heard the item on February 19, 2003 and voted to recommend that the Board designate the tree as a Heritage oak. The tree meets the minimum size requirement for Heritage trees of 72 inches in circumference. The tree is located on a developed property in the Alamo area. The tree has a circumference of 203 inches. Nomination of the tree is appropriate. Because of the size and location of the tree, the tree is considered a code protected tree. Nomination of the tree to heritage status will provide additional protection for the tree, which is an excellent specimen of the oak trees of Alamo. Designation of the tree would require approval of a tree permit for alteration or removal of the tree. CONCLUSION The tree is a majestic oak and staff recommends that the Board designate the tree as a Heritage tree in order to require approval of a tree permit prior to altering the tree in the future. THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on September 0, 2003 by the following vote: AYES: S'EMSORS G101A, MCRA, GREMM and De-SALUM NOES:NM ABSENT: SUMVISM FMM& D. aOM ABSTAIN: NM RESOLUTION NO. 2003-517 SUBJECT: DESIGNATION OF ONE VALLEY OAK AS A HERITAGE TREE The Beard of Supervisors of Contra Costa County RESOLVES as follows: On August 21, 2002, David Whippy (Applicant & owner) filed an application with the Community Development Department, County File #HT020003, to nominate one (1) Valley oak tree within the unincorporated area of Alamo for Heritage tree status pursuant to the Heritage Tree Preservation District (Chapter 816-4); For purposes of compliance with the California Environmental Quality Act (CEQA), staff determined that the proposed action is Categorically Exempt insofar as CEQA exempts actions taken by regulatory agencies aimed at assuring the maintenance, restoration, enhancement or protection of the environment (Class 8); After notice was issued as required by law, on Wednesday, February 19, 2003 a hearing was scheduied before the San Ramon Valley Regional Planning Commission, at which time all interested were afforded the opportunity to testify before the Commission; the Commission, having fully considered all written and oral testimony on this matter, recommended to the Board of Supervisors the nomination of the subject tree as reported in Commission resolution #23- 2003; After notice was issued as required by law, on September 9, 2003 a hearing on the recommendation of the San Ramon Valley Regional Planning Commission was scheduled before the Board of Supervisors, at which time all interested were afforded the opportunity to testify; The Board having fully considered all written and oral testimony on this matter; RESOLVED, that the Beard of Supervisors finds that the proposed nomination of the one Valley Oak tree would be consistent with Chapter 816-4 of the Ordinance Code, which pertains to the nomination of Heritage trees and with policy 8-28 of the General Plan, which encourages efforts to identify and protect the County's mature oak trees; Further, pursuant to Ordinance Code Section 816-4,404(e), the property owner is requested to appropriately mark the designated trees so as to provide continuing notice to the public of the Heritage tree status, i hereby certify that this is,a true and correct copy of an action taken and entered on the Minutes of the Board of Supervisors on the date shown. INTRODUCTION DAVID WHIPPY (Applicant & Owner), County File #HT020003: The applicant/property owner requests a nomination for a heritage tree pursuant to the Heritage Tree Preservation Ordinance for one Valley Oak tree with a trunk 651/2 inches in diameter (203 inch circumference) measured 41/2 feet above natural grade. The property is located at #2848 Miranda Avenue in the Alamo area. (R-20) (ZA: Q-15) (CT: 3461.02) (Parcel #193-060-025) II. RECOMMENDATION Adopt a motion recommending to the Board of Supervisors that the nominated tree be designated for heritage status pursuant to Chapter 816-4 of the Ordinance Code. III. GENERAL INFORMATION A. General Plan: Single-Family Residential Low-Density (SL). B. Zo. nin : R-20, Single-Family Residential. C. CEQA Status: Categorical Exemption — Class 8: Actions by Regulatory Agencies for Protection of the Environment. IV. AREA AND SITE. DESCRIPTION The subject property is over one acre in size and is accessed via a road easement from Miranda Avenue, in Alamo. The parcel is flat with a single- family residence, vegetation and the nominated heritage tree just inside a 45- foot wide storm drainage easement. V. STAFF DISCUSSION A. Appropriateness of Nomination: Nominations for heritage trees can be accepted for trees on any parcel in the unincorporated area. Heritage trees include, but are not limited to trees with a circumference of at least 72 inches measured 4'-6" above natural grade. The applicant stated that the tree has a circumference of 203 inches, thereby meeting the size requirement. The tree is a majestic oak located on the south- eastern portion of applicant's property within a 45-foot wide storm drain easement. The site plan was routed to the Contra Costa Public Works Department, Flood Control Division who responded that no conflicts could be seen with the designation of the heritage tree and the storm drainage easement. B. Alamo Improvement Association: In a letter dated October 22, 2002, the AIA recommended approval of the heritage tree nomination and commended the applicant in taking such action and interest in preserving the character of Alamo. C. Suitable Marking of Trees. Upon designation, heritage trees should be marked to notify the public of their heritage status. The applicant shall be responsible for suitably marking the trees. VI. CONCLUSION Based upon the above discussion, staff recommends that the San Ramon Valley Regional Planning Commission forward a recommendation to the Board of Supervisors that they approve the heritage tree nomination.
