1. RECOMMENDATION:
APPROVE and AUTHORIZE the Sheriff, or designee, to execute a Contract Amendment
and Extension on behalf of the County with Lori Brown to provide additional Senior Level
Library Services at the Contra Costa County adult detention facilities and to increase the
payment limit by $29,0401 to a new payment limit of$43,560 and extend the contract term
to a new expiration date of March 31, 2004.
II. FINANCIAL IMPACT:
NONE. This contract is fully paid from the Inmate Welfare Fund.
Ill. BACKGROUND:
Maintaining a Detention library that can provide an adequate supply of reading material for
the recreational enjoyment of inmates is an important component of the mission of the Inmate
Welfare Fund. Qualified personnel with knowledge of library practices and policies are critical
to the success of the program. The Contractor is the senior level librarian with responsibility
for researching, ordering and maintaining an adequate supply of reading material for the
recreational or reference use of all inmates. The Office of the Sheriff is working to create a
permanent position for this function. During that process, it is critical that the Contractor's
current contract be extended to ensure the inmate library services are continued.

SUBJECT: Contract for Tobacco Laws Enforcement Position
SPECIFIC REQUEST(S)OR RECOMMENDATIONS)&BACKGROUND AND JUSTIFICATION
1. RECOMMENDATION:
APPROVE and AUTHORIZE the Sheriff, or designee, to sign a contract on behalf of the
County with James McCauley to enforce compliance with smoking regulations for the period
of October 1, 2003 through June 30, 2004, in the amount of$35,100.00.
II. FINANCIAL IMPACT:
NONE. Funding for this position is provided by a State grant managed by Health Services.
Ill. BACKGROUND:
The Office of the Sheriff executed a memorandum of understanding with Health Services on
May 24, 2001. This agreement commits our office to enforce compliance with Labor Code
section 6404.5, which addresses smoking in the workplace, and Penal Code section 308a,
which addresses the sales of tobacco products to, and smoking by, minors. This agreement
obligates us to provide 4290 hours of service over the three year period (September 1, 2001
through June 30, 2004) of the grant; an average of 130 hours per month. James McCauley
is a retired deputy sheriff with extensive experience in Vice Unit of the Investigation Division
and has been in the position for the past two years. His knowledge and expertise are particularly
applicable to the Tobacco Laws Enforcement Position and will provide continuity to the project.

I. RECOMMENDED ACTION:
Approve and authorize the Chief Information Officer of Department of Information Technology or his designee to execute on
behalf of the County an agreement amendment with Zeiger Engineers,Inc., which provides for engineering design services to
replace the uninterruptible power system at the County's Central Data Center,to increase the payment limit from$24,995 to
$49,000 and extend the contract period to December 31,2003.
II. FINANCIAL IMPACT:
Funds are budgeted for these services. DoIT will recover these costs through user charges.
III. REASON FOR RECOMMENDATION AND BACKGROUND:
When the Data Center was constructed in 1989,one of the essential functions was the installation of an auxiliary power source
that would support the center if PG&E power is lost. This system consists of a generator,a UPS and batteries to support the
UPS. The[TPS and batteries need to be replaced,as the manufacturer is withdrawing support for the equipment. The Data Center
supports users countywide and if the Data Center is not operational they cannot access their data to do their jobs.
Zeiger Engineers,Inc.has been retained to assist DoIT with the development of an updated auxiliary power system requirements
document and then the development of an RFP to acquire the necessary replacement equipment for the auxiliary power system.
The requirements document is intended to provide redundant power systems that will provide primary and backup systems to
insure that the Data Center will have a constant source of power.
IV. CONSEQUENCES OF NEGATIVE ACTION:
DoIT does not have the technical ability to develop this plan and the RFI'. Without the assistance of the consultant DoIT can not
have an updated power system in place so users can count on continuing service.

FISCAL IMPACT
The funding for the Environmental Impact Report will be drawn from $50,000 contributed by labor
group interests with the balance a net cost to the County General Fund. The proposed FY 2004
Budget for the Community Development Department includes this item.The Community Development
Department also expects to incur administrative costs for preparation of the Environmental Impact
Report pursuant to County Ordinance Code Section 26-2.2804.
BACKGROUND/REASON FOR RECOMMENDATION
On December 3, 2002,the Board of Supervisors directed the Community Development Department to
prepare an Environmental impact Report for the proposed Contractor Safety Amendment to the
Contra Costa County Industrial Safety Ordinance, County Ordinance Code Chapter 450-8.
Pursuant to this directive the Community Development Department on March 31, 2003 issued a
Request for a Statement of Qualifications from twelve (1 2)environmental consulting firms to prepare
the Environmental Impact Report. The Department has identified the firm of Environmental Science
Associates(ESA)as the most qualified environmental consultant to prepare the Environmental Impact
Report. Staff is seeking authorization from the Board of Supervisors to enter into a contract with
Environmental Science Associates, in an amount not to exceed $125,000.00, to prepare the
Environmental Impact Report for the proposed Contractor Safety Amendment to the Industrial Safety
Ordinance..

RECOMMENDATION
1. APPROVE the Fifth Amendment to the Consulting Services Agreement dated April 25, 2002
with RMW Architecture and Interiors in the amount of $2,075, increasing the payment limit from
$75,380 to $77,455 for the Health Center Expansion Project, 3545 Lone Tree Way, Antioch for
the Health Services Department.
2, AUTHORIZE the Director of General Services, or designee, to execute the Fifth Amendment to
the Consulting Services Agreement and to issue Written authorizations for extra Work, in addition
to the authorization for the Fifth Amendment, provided that the cumulative total extra cost for
such additional authorizations shall not exceed $2,000.
FINANCIAL IMPACT
The estimated total project cost for the Antioch Health Center Expansion is $402,000. Project
expenses are funded with band money.
BACKGROUND
On April 25, 2402, the Director of General Services executed a Consulting Services Agreement with
RMW Architecture and Interiors to provide field investigation and site analysis, architectural
programming, conceptual design, structural investigation and a preliminary cost estimate for the
Health Center Expansion at 3505 Lone Tree Way, Antioch for the Health Services Department,
The First Amendment increased the scope of services to include design development, construction
documents, bid phase support, construction administration, and extended the completion date to
completion of construction.

The Second Amendment increased the reimbursement limit to cover the cost of additional plotting
and reproduction of the design drawings.
The Third Amendment provided additional services that included attendance and participation at five
additional construction phase meetings and follow-up for a total of 11 meetings.
The Fourth Amendment provided additional services to design and document a space plan revision in
the proposed break room area and a new utility sink in the janitor closet.
The Fifth Amendment increases the reimbursable expenses from $3,200 to $5,275 to cover the cost
of additional plotting of drawings modified during construction, overnight delivery of drawings,
duplication, and postage during the construction support phase.

I. Effective Date and Parties: Effective September 9,2003,RMW Architecture and Interiors(herein called"Consultant"),a California Corporation,
and the County of Contra Costa(herein called"County"),a political subdivision of the State of California,mutually agree as follows:
2. Purpose: On April 25,2002, the parties entered into a contract entitled "Consulting Services Agreement,"referred to as the "Agreement," which
covers the Health Care Expansion at 3505 Ione Tree Way, Antioch for the Health Services Department . The Agreement has previously been
amended as follows: First Amendment dated August 6,2002, Second Amendment dated October 31,2002,Third Amendment dated January 16,
2003 and Fourth Amendment dated February 26,2003. The parties desire to further amend the Agreement to expand the scope of service and to
increase the payment limit accordingly.
3. Amendments to A"reement:
A. In the Agreement,Section 1(c),change the Payment Limit from$75,380.00 to$77,455.00,an increase of$2,075.00. This change shall apply
to additional charges during construction.
B. In Appendix B,Paragraph F,increase the reimbursement limit from$3,200.00 to$5,275.00 to cover the cost of additional plotting of drawings
