RECOMMENDATION: APPROVE and AUTHORIZE the Sheriff, or designee, to sign a contract with the State of California Commission on Peace Officers Standards and Training (P.O.S,T.) to accept an amount not to exceed $44,500 for the presentation of P.O.S.T. certified Emergency Vehicles Operations Course training by the Law Enforcement Training Center during the period of July 1, 2003 through June 30, 2004. 11. FINANCIAL IMPACT: This contract agreement will allow the Office of the Sheriff's Law Enforcement Training Center to recover costs associated with the presentation of Emergency Vehicles Operations Course training. Ill. BACKGROUND: In January of 2001, the Office of the Sheriff took over the operation of the Law Enforcement Training Center. One of the courses required by P.O.S.T. is the Emergency Vehicles Operations Course training. P.O.S.T. provides funding on an annual basis for agencies that present this training. Kochly, District Attorney Costa DATE: August 12, 2003 srt-�` ount SUBJECT: Approval to Submit an Application and Execute a Grant Award Agreement with the State Department of Insurance for Funding of Automobile Insurance Fraud Prosecution Program in the Amount of$424,315 for the Period July 1, 2003 through June 30, 2004 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: Approve and authorize the District Attorney to submit an application and execute a grant award agreement, and any extensions or amendments thereof, pursuant to State guidelines, with the State Department of Insurance for funding of the Automobile Insurance Fraud Prosecution Program in the amount of$ 424,315 for the period July 1, 2003 through June 30, 2004 (State funds-budgeted). FINANCIAL IMPACT: The grant application will fund salaries and benefits for 1.5 FTE attorneys, an investigator, and one-half FTE clerk assigned to the program. The Automobile Insurance Fraud Prosecution award is allocated from a trust fund financed by an assessment per insured vehicle, payable by the insurer. Of the assessment amount, approximately one-half is earmarked for distribution to District Attorneys for enhanced prosecution of automobile insurance fraud. Supplantation is prohibited. Expenditures and revenue for grant positions are included in the District Attorney's 2003/04 budget. REASONS FOR RECD}MMENDATIONIBACKGROUND: The State Legislature has determined that one of the significant factors driving up the cost of auto insurance is fraud. While fraud is recognized as a growing problem across the country, California is an area of concerted criminal activity in insurance fraud. Although originally the problem was contained in the Los Angeles area, recent statistics confirm that the problem is rapidly becoming a Statewide concern. However, resources committed to fighting fraud were limited. In 1989, the legislature enacted, through SB 2344 and SB 1103, statutes which provided resources for enhanced automobile insurance fraud investigation and prosecution. That investment has resulted in increasing the number of prosecutions for automobile insurance fraud Statewide. The implementation of mandated carrier-based special investigation units and the Automobile Insurance Claims Depository will operate to uncover large numbers of fraudulent claims which had gone undetected before the existence of those programs. CONSEQUENCES OF NEGATIVE ACTION: Failure to approve the recommendation will result in the inability of the District Attorney to apply for State funds designated for use by Contra Costa County in the prosecution of automobile insurance fraud. A county which fails to submit the application shall not be considered for funding, and their undistributed funds shall be returned to the Department of Insurance to be reprogrammed. Approval of this Standard Agreement #24-760-11 will enable the County' s clients to continue participating in comprehensive rehabilitation plans that provide job skills development, career counseling, coaching in job application skills, job development and placement, and follow-up services through June 30, 2006 . Nine certified and sealed copies of this Board Order should be returned to the Contracts and Grants Unit for submission to the State Department of Rehabilitation. The.
