RECOMMENDED ACTION: DETERMINE that the Tri-Valley Transportation Development Fee(TVTDF)Area of Benefit Adjustment activity is not subject to the California Environmental Quality Act (CEQA)pursuant to Article 5, Section 15061 (b)(3)of the CEQA Guidelines, Alamo area, and DIRECT the Director of Community Development to file a Notice of Exemption with the County Clerk,and AUTHORIZE the Public Works Director to arrange for payment of a$25 fee to Community Development for processing, and a$25 fee to the County Clerk for filing the Notice of Exemption. The recommended action will lead to an increase in funding for specified transportation projects. The funds collected will be deposited in a trust fund account specific to the improvements to be funded by the TVTDF Area of Benefit. III. REASONS FOR RECOMMENDATION/BACKGROUND: The purpose of this activity is to adjust the traffic mitigation fee for the Tri-Valley Area ofBenefit,which is a program to mitigate the impacts of development in the Tri-Valley area (Alamo, Danville, San Damon, Lublin, Pleasanton, Livermore, Alameda Cougy). The Tri-Valley Transportation Development Council recommends the fee adjustment. The Tri-Valley Transportation Council(TVTC)includes Contra Costa and Alameda counties,and the cities of Danville, San Damon, Dublin, Pleasanton and Livermore. The TVTC was formed to address transportation issues of common interest. In 1998, the TVTC unanimously recommended to its member jurisdictions the adoption of a uniform development fee, known as the TVTDF. All participating jurisdictions supported this recommendation by adopting ordinances establishing uniform development fees in the Tri-Valley area dedicated to specified regional transportation projects. IV. CONSEQUENCES OF NEGATIVE ACTION: Delay in approving the activity may result in the loss of potential revenues and would be inconsistent with the Joint Exercise of Powers Agreement,which established the Tri-Valley Development Fee.
