GILBERT, DIRECTOR OF GENERAL SERVICES i, f` COSTA DATE: SEPTEMBER 9, 2003 COUNTY SUBJECT: FIRST ADDENDUM TO LEASE FOR THE PREMISES AT 3685 MT.'DIABLO BOULEVARD, SUITE 120 FOR THE BUILDING INSPECTION [DEPARTMENT (T00609) SPECIFIC REQUEST(S)OR RECOMMENDATIONS)&BACKGROUND AND JUSTIFICATION RECOMMENDATION APPROVE and AUTHORIZE the Director of General Services, or designee, to EXECUTE the First Addendum to the Lease dated November 14, 2000 with METCALF FAMILY LIVING TRUST for the premises at 3685 Mt. Diablo Boulevard, Suite 120, Lafayette and EXERCISE the option to extend for continued occupancy by the Building Inspection Department, under the terms and conditions more particularly set forth in the First Addendum to Lease. FINANCIAL IMPACT The exercise of the option was anticipated and sufficient funds budgeted in the Building Inspection Department approved FY 200312004 budget. The option is for a term of three years, effective January 1, 2004 through December 31, 2006. The rental rate for the first year is $2,787.50 per month, a decrease in monthly rent of $223.00 per month over the previous rate. The rental rate for the second year is $2,843.25 per month and the rental rate for the third year is $2,899.00 per month. BACKGROUND The Building Inspection Department has occupied the leased premises since January 1, 2001. The Lease term ends December 31, 2003 and the County has an option to extend the Lease for one additional two year term at negotiated market rental rates. The rental rate negotiated is a decrease over the previous rate. The Lessor has agreed that the County could have a three year extension as requested by the Building Inspection Department. The First Addendum provides for a three year extension at the specified monthly rates. This First Addendum shall be deemed incorporated into and made a part of the Lease. The terms, covenants, and conditions of this First Addendum shall supersede the provisions of the Lease. Except as so modified, all the terms and conditions of the Lease as amended shall remain in full force and effect. In the event of any inconsistency or conflicts between the provisions of the Lease and this First Addendum, the provisions of this First Addendum shall apply. Basic Lease provisions: DESIGNATION OF PREMISES: Suite 120, consisting of approximately one thousand one hundred fifteen(1,115)rentable square feet. MONTHLY RENTAL INSTALLMENTS: Months 1 — 12: $2,787.50 per month Months 13—24: $2,843.25 per month Months 25—36: $2,899.00 per month TAXES AND OPERATING EXPENSE BASE: 2004 base year. LEASE TERM: Three(3)years. TERM COMMENCEMENT DATE: January 1, 2004 IMPROVEMENTS: EXTENSION: County will be granted an Extension.Option pursuant to the terms of A.8 of the Lease.
