regulations, coding systems, coding of diagnosis, and monitoring of all

rendered to Medicare patients, for the period. from March ", 2002
through February 28, 2003 .

,System.

BACKGAOLND/REASON(S)FOR RECOMMENDATION(S):
On June 4, 2002, the Board of Supervisors approved Contract #23--274-3 with ECHO Consulting
Services of California, Inc. for the period from July 1, 2002 through June 30, 2003, for the
provision of a hardware and software maintenance agreement supporting the Department's Mental
Health and Alcohol and Other Drugs Services Divisions.
Approval of Contract Amendment Agreement 23-274--4 will allow the Contractor to provide
additional hours of services through June 30, 2003,

RECOMMENDATION
1. APPROVE the Sixth Amendment authorizing extra work under the Consulting Services
Agreement dated November 16, 1999, with Daniel Rainey, Architect, for additional architectural
services for Remodel and Office Landscape Partition Modifications at 1305 Macdonald Avenue,
Richmond for the Employment and Human Services Department. The Sixth Amendment
increases the scope of services and increases the Payment Limit from $347,063 to $364,153.
2. AUTHORIZE the Director of General Services, or designee, to execute the Sixth Amendment to
the Consulting Services Agreement and to issue written authorizations for extra work, in addition
to the authorization for the Sixth Amendment, provided that the cumulative total extra cost for
such additional authorizations shall not exceed $25,000.
FINANCIAL. IMPACT
The project is financed with 2002 aeries A Lease Revenue Roads totaling $3,500,000. Debt service
payments are included in the FY 2002603 budget for the Employment & Human Services Department
(EHS). Debt service payments are allocated across all EHS programs as part of the Department's
general and administrative overhead casts. These casts are eighty percent (30%) funded by the
Federal and State and twenty percent (20%) funded by the County.
BACKGROUND
On November 10, 1999 the Board of Supervisors approved and authorized the Director of General
Services to execute the original Consulting Services Agreement. The agreement provides for
comprehensive architectural services including design, engineering, development of construction
documents, and construction administration services for the Remodel and Office Landscape partition
Modifications at 1305 Macdonald Avenue, Richmond for the Employmentand Human Services
Department.

The above project and time plans and specifications therefore having been previously
approved, Addenda No. 1 and No. 2, having been issued and approved, and bids having been duly
invited and received by the Director of General Services on November 21, 2002; and
The Contract Compliance Officer having reported that the lowest monetary bidder CJE
Construction Company("CJE") submitted a bid which did not demonstrate an adequate good faith effort
to comply with the requirements of the County's Outreach Program, and the Director of General
Services recommending rejection of said bid; and.
The Contract Compliance Officer having reported that the second lowest monetary bidder
Bravo Building Co. Inc. (66Bravo") submitted a bid which was non-responsive in that no good faith
documentation was submitted as required by the bid documents, and the Director of General Services
recommending rejection of said bid; and
The bidder listed first above, Albay Construction. Company ("Albay"), having submitted the
lowest responsive and responsible bid,which is $16,400 more than the lowest monetary bid; and
The Contract Compliance Officer having reported that Albay has documented an adequate
good faith effort to comply with the requirements of time County's Outreach Program; and
The Director of General Services recommending that the bid submitted by Albay is the
lowest responsive and responsible bid, and this Board concurring and so finding;
NOW, THEREFORE,the Board finds, determines and orders as follows:
The Board DETEILMINES that the bids submitted by the lowest monetary bidder (CJE)
and the second lowest monetary bidder(Bravo) are norm-responsive for failure to comply with the project
specifications and: requirements of the County's Outreach Program, REJECTS said bids, on those
grounds, and ORDERS that bath bid bonds be exonerated; and

for said work is awarded to Albay at the listed amount and at the prices submitted in said bid, and that
said contractor shall present sufficient payment and performance surety bonds as indicated above, and
that the Director of General Services, or designee, shall prepare the contract therefor; and.
The Board FURTHER ORDERS that after the contractor has signed the contract and
returned it, together with the bonds as noted above and any required certificates of insurance or other
required documents, and the Director of General Services, or designee, has reviewed: and found them to
be sufficient, the Director of General Services, or designee, is authorized to sign the contract for this
Board; and
The Board FURTHER ORDERS that in accordance with the project specifications and/or
upon signature of the contract by the Director of General Services, or designee, any bid bonds posted by
the bidders are to be exonerated and any checks or cash submitted for security shall be returned; and
The Board FURTHER ORDERS that the Director of General Services, or designee, is
authorized to sign any escrow agreements prepared for this project to permit the direct payment of
retention into escrow or the substitution of securities for moneys withheld by the County to ensure
performance under the contract,pursuant to Section 22300 of the Public Contract Code; and
Pursuant to Public Contract Code Section 4114, the Board DELEGATES its functions
under:Public Contract Code'Sections 4107 and 41.10 to the Director of General Services, or designee.
The Board DECLARES that, should the award of the contract to Albay be invalidated for
any reason, the Board would not in any event have awarded the contract to any other bidder, but instead;
would have exercised its discretion to reject all of the bids received. Nothing herein shall prevent the
Board from reawarding the contract to another bidder in cases where the successful bidder establishes a
Mistake, refuses to sign the contract or fails to furnish required bonds or insurance in accordance with
Public Contract Code Sections 5100-5107.

SUBJECT: CONTRACT AWARD RECOMMENDATION
Bids for the REMODEL OF FIDE STATION NO. 18 AT 145 SUSSEX STREET, CLYDE
FOR THE C'£BNTRA COSTA COUNTY FIDE PROTECTION DIS'T'RICT were received
and opened at the County Capital Projects Management Division Office on November 21, 2002.
The Contract Compliance Officer has reported that CJE/RTE (JET) ("CJE") of Concord, who
submitted the lowest monetary bid of$93,400, did not document an adequate good faith effort to
comply with the requirements of the County's Outreach Program. For this reason, it is
recommended that CJE's bid be rejected as noxi-responsive and that their bid bond be
exonerated.
The Contract Compliance Officer has also reported that Bravo Building Co., Inc. ("Bravo") of
Pittsburg, who submitted the second lowest monetary bid of$108,200 did not provide a goad
faith effort to comply with the requirements of the County's Outreach Program. For this reason,
it is recommended that Bravo's bid be rejected as non-responsive and that their bid bond be
exonerated.
It is recommended that the Board of Supervisors award the construction contract to the lowest
responsive and responsible bidder; Albay Construction Company("Albay") of Martinez who has
documented an adequate good faith effort to comply with the requirements of the County's
Outreach Program, and award the construction contract to Albay in the amount of$109,800.
Claudia J. Falconer, AIA, the Consulting Architect, estimated the construction cost to be
$88,000.
