Kochly,,District Attorney 'N uosta DATE: January 21, 2003 37County SUBJECT Approval to Execute a Grant Award Agreement with the US Department of Justice for Funding of Community Gun Violence Prosecution Project in the Amount of$40,000 per Year for Three Years SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND ANIS JUSTIFICATION Approve and authorize the District Attorney to execute a grant award agreement, and any extensions or amendments thereof, pursuant to guidelines, with the US Department Justice for funding of a Community Gun Violence Prosecution.Project in the amount of 40,€104 per year for three years(Federal funds). FINANCIAL IMPACT: The grant funds 80%of the salary and benefit cost of an prosecutor, up to a maximum or S 40,000 a year, hired for the project or to backfill the position of an experienced prosecutor assigned to the project. REASONS FOR OMEN 3ATIO IBACKGU D, This project will target firearm-related crimes in the City of Richmond. By population,_Richmond represents only 10% of the County's population, yet it accounts for 28% of the violent firearm-related felonies prosecuted by the .District Attorney's Office. Of the thirty-rune homicides committed in 1999 which were solved and prosecuted, fifteen involved firearms; eight of these homicides by firearms were committed in Richmond. This grant will permit one experience gang attorney to concentrate on the firearm related violent crimes that occur in the City of Richmond. The position will concentrate on the most violent and notorious offenders in Richmond, as well as anyone trafficking in firearms in West County. The project attorney will vertically prosecute cases and will have increased interaction with, police detectives in areas of target selection., investigation strategy, legal advice, trial preparation, and feedback on prosecutions. This Contract is funded by the State of California High Technology Great The on- going maintenance for the system will be funded with money in the Sheriffs s Office budget. No additional funds will be required. III. BACKGROUND: The Message Switching,System connects Contra Costa County public safety agencies with the State criminal justice system and provides the mechanism for connection n with federal databases. The current Message Switching System is outdated and information requests have increased significantly resulting in delayed responses dire to the limited capabilities of the equipment. The operating system and software must be upgraded to meet the standards as required by the Department of Justice. IV. CONSEQUENCE OF NEGATIVE ACTION- Efficient and effective lair enforcement is greatly enhanced when vital information is quickly accessible to all agencies in the County. The Message Switching System is critical to providing the information needed for the enforcement of the law and the safety of the citizens of the County. A Request for Proposal (RFP) has been issued soliciting new firms, however, rates for the new contracts for FY 03 may significantly Increase. The County frequently requires temporary help to assist County agencies, departments, or offices during peak loads, temporary absences and emergency situations. It is in the economic Interest of the County to provide such temporary help by contract with temporary help firms since they Include all Insurance coverages In their rates, the reducing future County liabilities. Temporary help obtained under these contracts may not be used In place of employees In the case of a labor dispute or for more than 90 days for any single Instance of peak load, temporary absence or emergency situations as governed by State law.
