Gilbert, Director of General Services DATE: February 20, 2003 SUBJECT: Authorization to Issue Bid Addenda for Job Order Contract to Apply County's SBE Program to Job Orders Less Than $50,000 SPECIFIC REQUEST{S} OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION(S) APPROVE and AUTHORIZE the Director of General Services to issue one or more bid addenda for the Job Order Contract to provide that the requirements of the County's Small Business Enterprise (SBE) Program will apply to individual job orders with a value less than $50,000. FINANCIAL IMPACT No direct financial impact. BACKGROUN'DIREASON'S FOR RECOMMENDATION(S) On December 17, 2002, the Board authorized the Department of General Services to solicit bids for the pilot Job Order Contracting (JOC) Program. The JOC Program involves one or more annual contracts up to $3 million each for repair, remodeling, and other repetitive work to be done according to unit prices. Pursuant to the Board's authorization, the Department of General Services currently is soliciting bids for one annual JOC contract with a maximum value of$1.5 million. The deadline for submitting bids is March 13, 2003. The JOC program has been developed to compliment the County's Outreach Program, which applies to construction contracts $50,000 and more, and the Small Business Enterprise (SBE) Program, which applies to construction contracts $25,000 and less. For construction contracts $25,000 and less, the SBE Program requires that at least 50% of the dollar value of such contracts be awarded to SBEs. Since its adoption in 1998, the Outreach Program has applied to construction contracts $50,000 and more (i.e., has had a $50,000 minimum). When the SBE Program was adopted in 2000, it was established with a $50,000 maximum for professional/personal services contracts, as well as purchasing. However, due to limitations in the public bidding statutes, the SBE Program was established with a lower maximum—$25,000--for construction contracts. As a result, for construction contracts, there presently is a gap between the maximum for the SBE Program ($25,000) and the minimum for the Outreach Program ($50,000). Under the bidding statute applicable to the JOC Program (Public Contract Code Section 20128.5), the County has the ability to apply the SBE Program to a higher dollar amount (e.g., $50,000)! By applying the SBE Program requirements to individual job orders (projects) between $25,000 and $50,000, the County could close the gap described above, thus increasing opportunities for qualified SBEs and enhancing and bringing uniformity to the Outreach Program and SBE Program. Staff recommends that the Board authorize the issuance of one or more bid addenda to provide that the SBE Program requirements will apply to individual job orders with a value less than $50,000. CONSEQUENCES OF NEGATIVE ACTION Job orders between $25,000 and $50,000 would not be subject to requirements of the Outreach Program or the SBE Program. THIS SUPERSEDES ALL PREVIOUS BOARD RESOLUTIONS PERTAINING TO WELFARE&INSTITUTIONS CODE 5000 et seq. KNOWN AS THE LANTERMAN-PETRIS-SHORT ACT. THE CONTRA COSTA COUNTY BOARD OF SUPERVISORS HEREBY RESOLVES THAT: 1. This resolution supersedes all previous Board resolutions, and or amendments,pertaining to the Welfare and Institutions Code Section 5000 et seq., and the Lanterman-Petris-Short Act. II. Under California Law, Welfare and Institutions Code Section 5000 et seq., provision is made that the Board of Supervisors designate facilities that are authorized to involuntarily detain persons in order to provide evaluation and treatment services, and intensive treatment, and that such facilities be approved by the State Department of Mental Health. The Board designates the following hospitals as facilities for involuntary psychiatric detention: A: Contra Costa Regional Medical Center 2500 Alhambra Avenue,Martinez,California 94553 B: Mt. Diablo Medical Pavilion of John Muir/Mt.Diablo Health System 2740 Grant St.,Concord,California 94520 III. Under California Law,Welfare and Institutions Code Section 5150,provision is made that the following persons may, upon probable cause, take a person into custody, or cause the person to be taken into custody, and place the person in a facility designated by the county and approved by the State Department of Mental Health as a facility for 72-hour evaluation and treatment. The persons who may take such actions include: I. Peace officers,including park peace officers and regional park peace officers; 2. A member of the attending staff of the evaluation facility(so designated by the county)who is authorized to admit a person involuntarily. [California Code of Regulations, Title 9, Section 823 et seq.] 3. As designated by the Local Mental Health Director, professional staff of Contra Costa Health Services' Mental Health Division, including Psychiatrists, Psychologists, Clinical Social Workers, Marriage and Family Therapists, Registered Nurses, Licensed Vocational Nurses, and Licensed Psychiatric Technicians [California Code of Regulations,Title 9, Section 622 et seq.] IV.
