RECOMMENDATIONS
ACCEPT report from the Community Development Director on key steps and milestones for
placing an Urban Limit Line Voter Initiative on the November 2, 2004 Election Ballot, and as
necessary, provide staff with direction.
FISCAL IMPACT
None at this time. However, depending on the Board's direction to staff there could be costs
incurred by both the Community Development Department and County Counsel in the future.

BACKGROUND / REASONS FOR RECOMMENDATION

At the November 4, 2003 meeting the Board postponed a decision on a ballot measure for the March
2, 2004 Primary Election that would establish a new procedure to require voter approval for the
expansion of the Urban Limit Line by more than ten acres. If approved,this ballot measure would have
enacted an ordinance amending the County General Plan and the 65/35 Land Preservation Plan
Ordinance to require voter approval by majority vote for expansion of the Urban Limit Line by more ten
acres. At the request of Supervisor Federal Glover,the Board decided to postpone submitting a ballot
measure to the County Registrar for the March 2, 2004 ballot, and Board members, instead, indicated
their preference to consider submitting a ballot measure for the November 2,2004 General Election.
Board members also stated their preference that the ballot measure, in addition to establishing a new
procedure requiring voter approval for expansion of the Urban Limit Line, should address several
issues, such as adjusting the Urban Limit Line boundary to conform with city limits, extending the term
of the Urban Limit Line beyond 2010, making the Urban Limit Line binding on cities, and linking the
Urban Limit Line to the extension of the Measure C-1988'/2 cent sales tax and its growth management
program. Several Board members commented that in light of the Shaping Our Future(SOF)effort and
the Board's adoption of the SOF Principles of Agreement it would be advisable to engage the cities
and stakeholders in a dialogue with the aim toward reaching a consensus on the ballot measure prior
to submitting it to the County Registrar for the November 2004 General Election.
In the Board's discussion on November 4, 2003 it was suggested that the Board return to this matter in
December to review steps and milestones necessary to submit a ballot measure to the County
Registrar for the November 2004 General Election. The table below outlines the key steps and
milestone dates to accomplish this objective:

(1) An EIR would need to be prepared if substantial evidence is identified or presented to support a fair argument that
the project would result in a physical change to the environment. It is doubtful that an EIR can be completed prior to
latest date for Board consideration to approve final Ballot Measure Language in early August.
