'` Costa DATE: December 16, 2008 °� , n County SUBJECT: FILING FEE INCREASE FOR "IM.02.0 COURTHOUSE CHILDREN'S WAITING ROOM SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMM'EN'DATIONS: RESOLUTION NO, 20031696 1. OPEN public hearing regarding proposed increase of filing fees to support the Courthouse Children's Waiting Room; 2. CLOSE public hearing; 3. ADOPT increase to filing fees by five dollars ($5.00), effective January 1 2004, until the sunset of the authorizing statute; 4. PROVIDE that the increase be in addition to the total filing fee, as defined in Government Code §26820.6, and as applicable to §26820.4, §26826, §26827, or any other fee authorized by this code; and 5. FIND that this fee as defined by Government Code §26826.3(a), defrays the costs, excluding capital outlay, of establishing and maintaining children's waiting rooms in court facilities. FISCAL IMPACT: The fees paid by parties to litigation in will be increased by $5.00 on January 1, 2004. These actions will have no effect on the County General Fund. BACKGROUND: Government Code §26826.3 declares it the policy of the state that each court shall endeavor to provide a children's waiting room in each courthouse for children whose parents or guardians are attending a court hearing as a litigant, witness, or for other court purposes. The statute authorizes the Board of Supervisors, after giving notice and holding a public hearing on the proposal, to impose a surcharge of not less than two dollars ($2.00) and not more than five dollars ($5.00) on certain filings to defray the expense of a children's waiting room, excluding capital outlay, in any county that has or elects to establish such service. Costs defrayed by the fee may include personnel, heat, light, telephone, security, rental of space, furnishings, toys, books, or any other item in connection with the operation of a children's waiting room. The Superior Court requests the Board of Supervisors to authorize a five-dollar ($5.00) increase in court filing fees for: 1) a complaint, petition, or other first paper in a civil or probate action or special proceeding; 2) a first paper on behalf of any defendant, respondent, intervenor, or adverse party; 3) a motion for change of venue from another court; or 4) a first paper on behalf of any party in a proceeding under§98.2 of the Labor Code.
