Uilkem a COUNTY Supervisor,District 11 DATE: December 16,2003 SUBJECT: Board Workshops on Indian Gaming SPECIFIC REQUEST(S) OR RECOMMENDATION(S)& BACKGROUND AND JUSTIFICATION RECOMMENDATION($): REQUEST the County Administrator to schedule two Board workshops on the issue of Indian gaming. BACKGROUND/REASON(S)FOR RECOMMENDATIONS) Indian gaming is becoming an increasingly important issue for local government. A May 2003 CSAC survey, with responses from 54 counties, indicated that there were 34 counties impacted by tribal gaming with 54 casinos in operation and 26 proposed. However, there were only 18 local agreements for mitigation of off- reservation impacts and health and safety services provided by the counties. The survey also reported that the eight counties who conducted comprehensive impact analyses indicated that the fiscal impacts were approximately $2.00 million, including $182.5 million of one-time costs and $16.7 :million in ongoing annual costs. Only five of the counties received mitigation payments, $16.5 million in one-time payments and $4.9 million in annual payments. Indian gaming in California is governed by a complex structure of federal, state and tribal law. The Federal Indian Gaining Regulatory Act of 1988 requires compacts between states and tribes to regulate the scope and conduct of casino style gambling by tribes. The first compacts in California were executed in September 1999. Since that time, tribal gaming has rapidly expanded and created a number of significant economic, social, environmental,health, safety and other impacts which are largely felt at the local level. In the past few months, Indian gaming has been an issue in both East and West County with proposals in Antioch and San Pablo. While no casinos have yet been proposed in the unincorporated areas of the County, nonetheless Indian gaming anywhere in the County could increase the demand for County services. Consequently, it would be prudent for the Board of Supervisors to understand the issues and policy options. The County Administrator has indicated that his office can coordinate workshops for the Board on Indian gaming as early as January.
