SUBJECT: AUTHORIZATION FOR GENERAL PLAN AMENDMENT STUDY FOR
THOMAS/DENOVA LLC PARCEL (APN: 099-152-010) AT EVORA ROAD AND
WILLOW PASS ROAD (COUNTY FILE #GP 03-0001) (SUP. DIST. V)

RECOMMENDATIONS
1. AUTHORIZE a General Plan Amendment study for a 2.36 acre site (APN: 099-152-
010)at Evora Road and Willow Pass Road as requested by Thomas/DeNova LLC to
change the General Plan land use designation from Agricultural Lands (AL)to Light
Industry(LI)and rezone to a Light Industry(L-l')zoning district.
2. ACKNOWLEDGE that granting authorization for this request does not imply any
support for the application to amend the General Plan, but only that this matter is
appropriate for study.

FISCAL IMPACT
None. If authorization is granted the applicant shall pay fees to cover the cost for a General
Plan Amendment and associated application fees.
BACKGROUND/REASONS FOR RECOMMENDATION
The Community Development Department has received correspondence from
Thomas/DeNova LLC requesting a General Plan Amendment study for a parcel located in
an unincorporated area of Concord along Evora Road north of State Route 4 nearthe Town
of Clyde.
The subject site is a 2.36-acre vacant parcel located at the intersection of Willow Pass Road
and Evora Drive(APN: 099-152-010). This site is owned by Thomas/DeNova LLC and it is
currently designated Agricultural Lands(AL)under the General Plan.Thomas/DeNova LLC
is proposing to change the land use designation on this vacant site from Agricultural Lands
(AL) to Light Industry ('LI). The subject site adjoins a larger 62.7-acre parcel that is
designated as Light Industry(LI)under the General Plan.Thomas/DeNova LLC acquired the
62.7-acre parcel from Lesher Property. Thomas/DeNova LLC has an approved Land Use
Permit from the County allowing the development of 98,404 sq.ft.distribution center for the
Frito Lay Company on approximately 15 acres of the 62.7-acre parcel (formerly known as
Lesher Property)that adjoins the subject site.Thomas/DeNova LLC also has an approved
grading permit for the entire 62.7-acre parcel (formerly known as Lesher Property),which
identifies future building pads for the Frito Lay Company Distribution Center,three other
building pads on the former Lesher Property.The approved grading permit also identifies a
building pad on the subject site for the General Plan Amendment Study request(APN:099-
152-010). Thomas/DeNova LLC desires to join the subject site of the General Plan
Amendment Study request with the 62.7-acre parcel(formerly known as Lesher Property)to
establish a contiguous area of Light Industry designated land use over a totalof 65 acres
and to provide additional access from the Light Industry designated land to Highway 4.
The subject site of the General Plan Amendment study request(APN: 099-152-010)was
originally conveyed to the Lesher Property by PG&E. PG&E has extensive land holdings to
the east that are part of the Los Medanos Underground Gas Storage Facility. When the
parcel was conveyed to Lesher Property it was done without benefit of a subdivision or lot
line adjustment,and,therefore,it retained the AL designation under the General Plan for the
original land area that make up the PG&E holdings.A map of the subject parcel attached as
Exhibit"A"is included with this Board Report. The subject parcel is located within the Urban
Limit Line.
Staff believes the request for a study is reasonable and recommends that it be authorized.
Authorization of this study does not imply any support for the application to amend the
General Plan, but only that this matter is appropriate for study.

Dear Ms. Kutsuris:
Thomas/DeNova LLC is the owner of the referenced parcel,which was previously owned
by the Lesher Trust, and is adjacent to another 62.7 acres, also owned by
Thomas/DeNova and previously owned by Lesher. The 62.7 acres is shown in the
County General Plan as Light Industry. The subject parcel of 2.36 acres was conveyed to
Lesher by PG&E, which owns a large abutting parcel to the east. Unfortunately, this
transfer was without benefit of a subdivision or lot line adjustment. Accordingly, the
parcel was not recognized as a legal separate parcel and was included in the General Plan
category applicable to the entire PG&E holding, i.e., Agriculture.
The development of the Thomas/DeNova site is underway as you know and the subject
parcel is an important component of the plans for the Light Industrial site,especially with
regard to access and egress. Accordingly, we wish to request that Contra Costa County
amend the General Plan to apply the Light Industry category to the subject parcel. We
understand that the Board of Supervisors must first authorize the Community
Development Department to prepare such an amendment. This letter, accompanied by
our check for$750,is to request you too, in turn,request that authorization from the
Board.
It will be our intent to further resolve the technical deficiencies with this parcel by
submitting an application for a General Plan Amendment, once authorized, as well as a
Rezoning and a Lot Line Adjustment to combine this parcel with the adjoining
Thomas/DeNova parcel.
