RECOMMENDATION: APPROVE and AUTHORIZE the Director of Redevelopment to
execute a contract with Ninyo and Moore, in the amount of $300,000 to provide a
predevelopment assessment for the Rodeo Waterfront, for the period 'December 15, 2003
through December 31, 2005.
FINANCIAL IMPACT: NO General Funds are involved. The Contractor will be funded through
U.S. Environmental Protection Agency (EPA) grant funds, Community Development Block
Grant (CDBG) funds, and Rodeo Redevelopment Project Area funds.

BACKGROUND: The Rodeo Waterfront is critical component of Rodeo's revitalization
effort. The Waterfront was identified as a priority for Redevelopment during the
Redevelopment Pian Adoption process. The County adopted the Rodeo
Downtown/Waterfront Specific Plan (Specific Plan) in 1991 that outlined broad goals and
policies for revitalization that include capitalizing on Rodeo's waterfront location as a major
focal point, visitor attraction, community gathering place and amenity to commercial and
residential uses.
In 2001, the Agency brought together representatives from the Rodeocommunity,
regulatory agencies, developers, and other interested parties to identify the barriers to
implementation of the Specific Plan. The primary obstacles included uncertainty related to
environmental contamination, the regulatory environment and const associated with
dredging the marina, and the economic feasibility of a revitalization plan.
The Redevelopment Agency has secured funding from the US Environmental Protection
Agency (EPA) and the County Community Development Block Grant Program (CDBG) to
further study the environmental contamination and the marina siltation. The Agency issued
an RFP for a Predevelopment Assessment team on September 17, 2003 that included an
environmental consultant, a marina engineer, and an economic consultant. The goal of the
Predevelopment Assessment is to provide necessary resources needed to create a
development plan for a revitalized waterfront that is a regional destination with an active
marina, waterfront recreation activities, retail opportunities, and parks. 'Through written
proposals and an interview process, a selection team chose Ninyo and Moore as the team
leader for the waterfront predevelopment assessment. The consultant team also includes
Moffat and Nicol Engineers for the marina study and Keyser Marston as the economic
consultant.
Ninyo and Moore was selected because of their strong understanding of the relationship of
this project to the overall community revitalization goals, project management skills, and
working relationship with the Environmental Protection Agency Brownfields program.
The Scope of Work for the Predevelopment Assessment process includes:
o Project management;
o A community outreach program;
a Phase I and If Environmental Assessment;
o Preparation of an environmental remediation plan;
o A marina study which will evaluate the feasibility and process to dredge the Rodeo
marina and a plan to maintain the marina in a sustainable manner; and
o A detailed economic strategy to implement the team's recommendations.
