SUBJECT: Approval of Contract with California Department of Forestry and Fire
Protection for Station Coverage
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
1. APPROVE and AUTHORIZE the Acting Interim Fire Chief, East Contra Costa Fire
Protection District, to execute a three-year contract with the California Department of
Forestry and Fire Protection to provide fire protection services in the Marsh Creek area
for the period of November 15, 2002 through June 30, 2005 in the amount of
approximately $192,400 per year.
2. FIND that the project is exempt from the provisions of the California Environment Quality
Act pursuant to section 15301-Class I.
3. DIRECT Community Development Department to file a Notice of Determination with the
County Clerk.
FINANCIAL IMPACT:
Approximate $400,000 annual savings.
BACKGROUND:
East Contra Costa Fire Protection District's Station 51, located at the Marsh Creek Detention
Facility, primarily serves the Marsh Creek area, including the residentially populated Morgan
Territory Road area. This geographic area is also a "state response area", necessitating that
the California Department of Forestry and Fire Protection (CDF) operate a station during the
fire season in this area. The CDF station, a.k.a. Sunshine Station, is located on Marsh Creek
Road and approximately 1 mile closer to the more concentrated residential area off Morgan
Territory Road.

CDF `offers a cooperative fire program, the "Amador Plan", wherein CDF will provide
comprehensive fire protection and other related emergency services, including protection of
life and property, in state responsibility areas where there are economic and social benefits to
"the people of the state." The Amador Plan offers 12 month fire protection service, including:
• 3-person crews (East Contra Costa currently provides 2-person crews)
• Fire personnel trained to respond on a wide variety of incidents, such as:
• Structure fires
• Hazardous materials incidents
o Medical aid
• Vehicle and boating accidents
• Floods
o Evacuations
• Direct access to state resources such as:
• State Air Management Unit,
o Heavy equipment (bull-dozers, etc.),
a Handcrews
• Improve accessibility to government grants
CDF charges are primarily based on the cost of staffing their Sunshine Station during the
non-fire season. CDF will continue the excellent level of service that the residents of the
Marsh Creek area have been receiving from the East Contra Costa Fire Protection District
and the estimated $400,000 annual savings will assist in implementing the transition plan of
the newly consolidated district.
Residents and landowners have been notified by mail and a notice of the proposal was
published in the Contra Costa Times. Attached is a copy of the notice.
NOTICE OF A
PROPOSED CONTRACT
The East Contra Costa Fire Protection District is proposing that the District enter
into an agreement with the California Department of Forestry and Fire Protection
(CDF) to provide fire protection services in the area currently being served by the
District's Station #51 located at the Detention Facility off Marsh Creek Rd. CDF
is the largest multi-purpose fire protection organization in the United States and
currently provides service to over 100 county, city, and special districts statewide.
CDF fire personnel are highly trained to respond to a wide variety on incidents
such as; structure fires, hazardous materials incidents, medical aid, vehicle and
boating accidents, floods, evacuations, and much more. CDF operates Sunshine
Station#16 located on Marsh Creek Road during the fire season.
This agreement will extend CDF operations at the Sunshine Station to 12 months
per year, 24 hours per day, 7 days per week. The specific benefits to the Marsh
Creek area are.
• 3-person crews (East Contra Costa FPD utilizes a 2-person crew)
• Direct access to state resources such as the State Air
Management Unit; heavy equipment (bull-dozers, etc.); hand
crews, and fire engines
• CDF's Sunshine Station is closer to the residential areas around
Morgan Territory Road and more visible than the East Contra
Costa FPDs Station #51
The proposed agreement will be evaluated yearly and the East Contra Costa Fire
Protection District will continue to utilize Station #51 as a storage facility and
could be reactivated in the future.
An informational meeting for residents and landowners of the Marsh Creek area
will be held at 7:00 p.m. on November 11, 2002 at Station #51, 12040 Marsh
Creek Rd. The Contra Costa County Board of Supervisors will consider the
proposed contract at its regularly scheduled meeting November 12, 2002 at 10
a.m.

with certainty that there is no possibility that the proposal will have a significant adverse affect on the environment. Further, CEQA
Guidelines Section 15301 provides an exemption for projects which involve a minor alteration of a public facility that has negligible or
no expansion of use beyond that existing at the time of the lead agency's determination.

On this day, the Board of Supervisors considered accepting the report from the County
Administrator on approval of contract with California Department of Forestry and Fire
Protection for Station Coverage.
Richard J. Seithel, Special Districts Analyst,presented the report and recommendations.
The Board discussed the matter of approving a contract with the California Division of
Forestry to provide fire protection service in the Marsh Creek and Morgan Territory
areas.
Following persons presented testimony:

The Board took the following actions:
• APPROVED contract with the California Division of Forestry to provide fire
protection service in the Marsh Creek and Morgan Territory area;
• INCLUDE that the project is also exempt from the provision of the California
Environmental Act pursuant to section 15061 (b)(3);
• DIRECTED the East Contra Costa Fire Protection District to report back to the
Board of Supervisors within 12 months to measure performance;
• DIRECTED Community Development Department to prepare a feasibility study
regarding the placement of a water tender unit and to include number of calls
(inquiries)within 90 days.
• DIRECTED Community Development Department to file Notice of Exemption
with the County Clerk;
