BACKGROUND/REASONS FOR RECOMMENDATIONS On December 29, 2000, a complaint was received regarding storage of heavy equipment and hazardous materials on the premises, On March 1, 2001, a site inspection was conducted and the inspection revealed the following violations of the County ordinance: Title 8, Chapter 82-2.002 (Adoption of the zoning ordinance) Title_ 8, Chapter 82-2,008 (Land Use enforcement— Uses permitted for zoning of an A-2 lot) Title 8. CCD staff informed me in:mid 2001 that I should apply for a land use change. In a follow-up discussion with Mr. Butler of CCD, I was informed not to file for a land use change as the CCD mould collect the money, and would not approve the change. As such, a new business location was secured in May 2001. 3: Per discussions and written communications with various Contra Costa.County Departments,I would life to be granted the same land use allowance as my neighbor, Contra Costa Landscape(Dutra Road,Martinez, CA)was provided in mid 2002 by the CCD. My reasons are as follows; 1; In discussions and written communication with various staff of the CCD, I made it known that I purchased the property at 2150 Franklin Canyon Road in 1987 to operate an agricultural supply and service business(fest Control). In my discussions with various Contra Costa County departments, they stated that allowable use on an A-2 Parcel included the storage of agricultural chemicals as a merchandiser of agricultural supplies and services. This business has been operating from the property since July 1987. Under state regulation,the Contra Costa County Department of Agriculture has performed yearly inspections since 1987 in compliance with our state fest Control Business License and County Registration. The property has been inspected since 1990 by the Contra Costa Health Services Department, Hazardous Materials Programs, where they perform and completed their routine "Hazardous Materials Release Response& Inventory Program Business Plan Validation& Site inspection Report". The last inspection and report was completed on March 9, 2002. In any event, to insure continued compliance, I sought support from the Community Development Department, Contra Costa County for guidance on additional permits that may be required. I was informed by CCD staff in mid 2041 that I should apply for a land use change. In a follow-up discussion with Mr. Butler of CCD, I was informed not to file for a land use change as the CCD would collect the money, and would not approve the change. As such, a new business location was secured in May 2441. Regardless, I feel that I have been mis informed by CCD staff, and would like to continue to operate my business from the property under the same conditions that my neighbors operate their businesses.
