After hearing the appeal, it is recommended to deny the appeal and affirm the
determinations of the County Abatement Officer and direct the County Abatement
Officer to proceed and perform the work of abatement.
FISCAL IMPACT
$5,000, If the county does the abatement.
BACKGROUND/REASONS FOR RECOMMENDATIONS
On December 29, 2000, a complaint was received regarding storage of heavy
equipment and hazardous materials on the premises, On March 1, 2001, a site
inspection was conducted and the inspection revealed the following violations of the
County ordinance:
Title 8, Chapter 82-2.002 (Adoption of the zoning ordinance)
Title_ 8, Chapter 82-2,008 (Land Use enforcement— Uses permitted for zoning of an
A-2 lot)
Title 8. Chagter 82-4.221 (Maintaining a contractor's yard)
On September 18, 2002, the Building Inspection Department declared the property a
public nuisance and posted a Notice Order to Abate under Title 1, Chapter 14-6,
This appeal is being made under the provisions of this title.

The Clerk of the Board heretofore noticed the hearing before the Board of Supervisors to
consider the appeal of Thomas McNabb on an abatement action at 2150 Franklin Canyon Road,
Martinez, California(AIN 370-010-010).
Lonell Butler, Building Inspection Department, presented the staff recommendations and
described the project.
The public hearing was opened. The following person spoke:

5: Lander stag regulation,the Contra Costa County Department of Agriculture has
performed yearly inspections since 1987 in compliance with our state Pest Control
Business License and County Registration. The property has been inspected since 1990
by the Contra Costa Health Services Department, Hazardous Materials Programs,where
they perform and completed their routine "Hazardous Materials Release Response&
Inventory Program Business Plan Validation& Site Inspection.Report". The last
inspection and report was completed on March 9, 2002.
6: In May 2002,I moved nay primary office to 5063 Commercial Circle, Suite"C",
Concord, California.
7: Further to the above, I am in the process of establishing an aquatic nursery at the
referenced property. The equipment currently located on the property will also be used to
support(incidental use)the aquatic nursery that is being developed, a permitted use
within.an A-2 district per Article 84-38.402, section(1:) "nurseries".

2: To insure continued compliance, I sought support from the Community Development
Department,Contra Costa County for guidance on additional permits that may be
required. CCD staff informed me in:mid 2001 that I should apply for a land use change.
In a follow-up discussion with Mr. Butler of CCD, I was informed not to file for a land
use change as the CCD mould collect the money, and would not approve the change. As
such, a new business location was secured in May 2001.
3: Per discussions and written communications with various Contra Costa.County
Departments,I would life to be granted the same land use allowance as my neighbor,
Contra Costa Landscape(Dutra Road,Martinez, CA)was provided in mid 2002 by the
CCD.

yearly inspections since 1997 In compliance with our state Pest Control Business License, County
Registration. The property has been inspected since 1990 by the Contra.Costa Health Services
Department, Hazardous Materials:programs,where they perform and completed their routine
"Hazardous Materials release Response& inventory Program Business PlanValidation& Site
Inspection Report". The last inspection and report was completed on March 9, 2001.
Per our records, the required permits and approvals for the storage of hazardous materials(initial
reported violation) have been in place for the referenced property since 1987. In any event,to
insure continued compliance, I sought support from the Conununitty Development Department,
Contra Costa County for guidance on additional permits that may be required. I was informed by
CCD staff in mid 2001 that 1 should apply for a land use change, In a fall€wup discussion-Wirth
Mr. Butler of CCD, I was informed not to file for a land use change as the CCD would collect the
money, and:would not approve the change. As such, a new business location was Wired In May
2001. Regardless, l feel that l have been mi.s informed by CCD st4- and would lire to review
options for a land use change as was granted to Contra.Costa Landscape earner this year.

Appeal of Notice and Order=to Abate-September 16, 2002
To Whom It May Concern,
With this letter, I hereby Appeal the Order of Abatement issued on September 16, 2442.
My reasons are as follows;
1; In discussions and written communication with various staff of the CCD, I made it known
that I purchased the property at 2150 Franklin Canyon Road in 1987 to operate an agricultural
supply and service business(fest Control). In my discussions with various Contra Costa County
departments, they stated that allowable use on an A-2 Parcel included the storage of agricultural
chemicals as a merchandiser of agricultural supplies and services. This business has been
operating from the property since July 1987. Under state regulation,the Contra Costa County
Department of Agriculture has performed yearly inspections since 1987 in compliance with our
state fest Control Business License and County Registration. The property has been inspected
since 1990 by the Contra Costa Health Services Department, Hazardous Materials Programs,
where they perform and completed their routine "Hazardous Materials Release Response&
Inventory Program Business Plan Validation& Site inspection Report". The last inspection and
report was completed on March 9, 2002.
In any event, to insure continued compliance, I sought support from the Community Development
Department, Contra Costa County for guidance on additional permits that may be required. I was
informed by CCD staff in mid 2041 that I should apply for a land use change. In a follow-up
discussion with Mr. Butler of CCD, I was informed not to file for a land use change as the CCD
would collect the money, and would not approve the change. As such, a new business location
was secured in May 2441. Regardless, I feel that I have been mis informed by CCD staff, and
would like to continue to operate my business from the property under the same conditions that
my neighbors operate their businesses.

1. Cease and desist business operations from the property, remove all
heavy equipment, machinery and contractors vehicles from the
property.
If you fall to abate the public nuisance within the number of days specified, the
county may order this abatement by public employees, private contractor, or
other means. The cast of said abatement, if not paid, may be levied and
assessed against the property as a special assessment lien and may be
collected at the same time and in the same manner as ordinary county taxes are
collected, subject to the same penalties, procedures and sales in case of
delinquency.
YOU MAY APPEAL FROM THIS ORDER OF ABATEMENT, but any such
appeal must be brought prior to the expiration of the number of days specified
above for completion of abatement. The appeal must be in writing; specify the
reasons for the appeal; contain your name, address and telephone number; be
accompanied by an appeal fee of ONE HUNDRED TWENTY FIVE dollars
($125.00); and be submitted to the Clerk of the Board of Sup2rvisors at the
