Barry, AICP, Director of Community Development DATE: October 15, 2002 SUBJECT: Montalvin Manor Redevelopment Plan Adoption SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS As the Board of Supervisors ADOPT Resolution designating Contra Costa County as the lead agency and the Contra Costa County Redevelopment Agency as the responsible agency for the preparation of a Redevelopment Plan for the Montalvin Manor Project Area; and As the Governing Board of the Contra Costa County Redevelopment Agency ADOPT Resolution designating Contra Costa County as the lead agency and the Contra Costa County Redevelopment Agency as the responsible agency for the preparation of a Redevelopment Plan for the Montalvin Manor Project Area. FISCAL IMPACT None. No General Funds are being used for redevelopment plan adoption expenses. BACKGROUND/REASONS FOR RECOMMENDATIONS On August 6, 2002 the Board of Supervisors designated by Resolution a Redevelopment Survey Area for the Montalvin Manor Redevelopment Project. Consideration of a Redevelopment Plan'will ultimately include preparation/certification of an Environmental impact Report(EIR)pursuant to Section 15050 of the California Environmental Quality Act("CEQA")Guidelines. The CEQA Guidelines require that when a project requiring an E1R is to be carried out or approved by more than one public agency(the County and the Redevelopment Agency),one of the public agencies must be designated the Lead Agency. Contact: Jim Kennedy 335-1255 prig: Redevelopment ATTESTED___ ocLq= 1 2oo2 cc: County Administrator JOHN SWEETEN County Counsel AGENCY SECRETARY AND THE CLERK Community Development-Advanced Planning OF THE BOARD Community Development-Transportation Planning P, Redevelopment Agency BY x , DEPUTY via: Redevelopment • Goldfarb & Lipman • Rosenow Spevacek Group W:BO.ARDORDERS\BOSRDA.montalvinmanor.rda.planadoption. 10 . 02 THE REDEVELOPMENT AGENCY OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on October 15, 2002,by the following vote: AYES: Supervisors Uilk ma, Gerber, DeSaulnier, Glover and Gioia NOES: None ABSENT: None ABSTAIN: None Resolution No.: BA 2002-6 SUBJECT: A Resolution authorizing staff to proceed with the preparation of a Redevelopment Plan for the proposed Montalvin Manor Redevelopment Project pursuant to the California Community Redevelopment Law ("CRL"), and authorizing staff to prepare any necessary environmental documentation for the redevelopment plan pursuant to the California Environmental Quality Act ("CEQA") The Contra Costa County Redevelopment Agency RESOLVES THAT: The Board of Supervisors of the County of Contra Costa (the "Board")by resolution adopted on August 6, 2002, designated a redevelopment survey area in the County of Contra Costa; and The County of Contra Costa and the Contra Costa Redevelopment Agency(the "Agency") desire to prepare for the Board of Supervisors consideration a redevelopment plan for a portion of the survey area(the "Plan"); and The Board of Supervisors desires to authorize and direct the Executive Director of the Agency to tape any and all further steps necessary to undertake the Plan adoption process in accordance with the CRL, and to prepare any and all required environmental documentation including an Environmental Impact Report ("EIR") for the Plan in accordance with CEQA; and Section 15050 of the California Environmental Quality Act Guidelines (the "CEQA Guidelines")requires that when a project requiring an EIR is to be carried out or approved by more than one public agency, one public agency(referred to as the "Lead Agency") shall be responsible for preparing the EIR for the project; and The County and the Agency are the public agencies involved in the preparation and adoption of the Plan for which the EIR shall be prepared, and both agencies have responsibilities related to approving and carrying out the Plan; and Pursuant to the standards set forth in Section 15051 of the CEQA Guidelines, the County and the Agency each have a substantial claim to be Lead Agency; and Section 15051 of the CEQA Guidelines provides that where two or more public agencies have a substantial claim to be the Lead Agency, the public agencies may by agreement designate one of the agencies as the Lead Agency; and The Board of Supervisors had determined that the County, as the legal entity responsible for approving and adopting the Plan in the first instance pursuant to the CRL, shall serve as the "Lead Agency" and the Agency shall serve as the "Responsible Agency," as defined in the CEQA Guidelines for the Plan EIR; and The Agency and the Board of Supervisors desire to provide further specific guidance to staff in the preparation of the Plan. 3201171162008.1 1 NOW, THEREFORE, BE IT RESOLVED that, the Board of Supervisors hereby approves the actions of the Agency to take all reasonable and necessary steps to prepare the Plan for the Board of Supervisors's consideration in accordance with the terms of the CRL and CEQA. BE IT FURTHER RESOLVED that, the Agency hereby consents to the designation of the Board of Supervisors as the Lead Agency for purposes of the preparation of the environmental documentation for the proposed Plan. BE IT FURTHER RESOLVED that, the Agency acknowledges in its consideration of the adoption of the proposed Plan pursuant to Health and Safety Code Section 33367, it shall serve as a Responsible Agency for the required environmental documentation within the meaning of Public Resources Code Section 21069.
