RECOMMENDATIONS
ADOPT Resolution of Abandonment terminating the creation of a Mello-Rods Community
Facilities District for the Renaissance/Club Sport Project, Pleasant Hill BART Station Area.
FISCAL IMPACT
No General Fund impact. Costs incurred to date by the County are covered by the property
owner/developer deposit.
BACKGROUND/REASONS FOR RECOMMENDATIONS
On September 10, 2002 the Board of Supervisors took action to initiate the establishment of a
Mello-Roos Community Facilities District for the Renaissance/Club Sport development at the
Pleasant Mill BART Station. The actions of the Board included an adoption of a Resolution of
Intention to establish a community facilities district and a Resolution of Intention to incur bond
indebtedness. The action of the Board was in response to an application filed by the developer-
WC Walnut Creek, LLC. The proposal conformed to County adopted financing policies for
Mello-Foos Community Facilities Districts..
Since that action the developer has been advised by its primary lender that the amount of
special tax they would allow would not permit a viable transaction, therefore the developer has
opted to utilize another form of financing to cover the public infrastructure costs associated with
the project. In order to remove documents that have already been recorded on the property
pursuant to the actions taken to date, the Board must adopt a Resolution of Abandonment
terminating the proceedings and authorizing staff to undertake various activities to remove the
recorded documents from the property.

A RESOLUTION OF ABANDONMENT OF PROCEEDINGS TO FORM THE COUNTY OF
CONTRA COSTA COMMUNITY FACILITIES DISTRICT NO. 2002-1 (RENAISSANCE
CLUBSPORT PUBLIC IMPROVEMENTS)
RESOLVED, by the Board of Supervisors (the "Board of Supervisors") of the County of
Contra Costa (the "County„) that:
WHEREAS, on September 10, 2002, this Board of Supervisors adopted resolutions of
intention to establish the County of Contra Costa Community Facilities District No. 2002-1
(Renaissance ClubSport Public Improvements) ("CFD 2002-1") and to incur bonded
indebtedness of the proposed CFD 2002-1; and
WHEREAS, on September 12, 2002, a map of the boundaries of the proposed CFD
2002-1 was recorded in Book 72 at Page 9 of Maps of Assessment and Community Facilities
Districts in the office of the County Recorder of the County; and
WHEREAS, the proponent of the formation of the CFD 2002-1, WC Walnut Creek
L.L.C., has informed the County that it no longer wants to pursue the formation of CFD 2002-1,
due to changing economic circumstances;and
WHEREAS, this Board of Supervisors now desires to abandon the proceedings to form
CFD 2002-1.
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
1. The proceedings to form CFD 2002-1 are hereby abandoned.
2. The Clerk of the Board is hereby directed to record a certified copy of this Resolution
with the County Recorder, including the Certificate of the Clerk of the Board attached hereto as
Exhibit A.
I hereby certify that the foregoing Resolution was duly adopted by the Board of
Supervisors of Contra Costa County, California, at a regularly scheduled meeting thereof, held
on the 15"day of October, 2002, by the following vote of the Board:
AYES: Supervisors Uilkema, Gerber, DeSaulnier, Glover and Gioia

The undersigned Clerk of the Board of Supervisors of the County of Contra Costa
hereby certifies as follows:
1. Attached hereto is a true and correct copy of a resolution of abandonment of
proceedings to form the County of Contra Costa Community Facilities District No. 2002-1
(Renaissance ClubSport Public Improvements) ("CFD 20021"), which was duly adopted by
the Board of Supervisors of the County of Contra Costa (the "County„) on October 15, 2002;
and
2. The resolution of intention to establish CFD 20021 was adopted by the Board of
Supervisors of the County on September 10, 2002; and
3. The map of the proposed boundaries of CFD 2002-1 was filed with the County
Recorder of the County on September 12, 2002, and was recorded by said County Recorder in
Book 72 at Page 9 of Maps of Assessment and Community Facilities Districts; and
4. Pursuant to Section 3117 of the California Streets and Highways Code, the County
Recorder shall index the Resolution of Abandonment in the book containing the index of the
maps of assessment and community facilities districts.
