BACKGROUND
The East Bey Regional Park District is proposing to acquire a 280-acre parcel on the south side of
Orwood Read, in the Knightsen area, for development of a future park. The site borders on
waterways in the Delta area, and thus has potential for water related recreation facilities.
The District referred the proposed acquisition to the County for purposes of determining compatibility
with the County General Plan. On July 8, 2002, the matter was presented to the East County
Regional Planning Commission, after allowing for public testimony, the Commission unanimously
voted to find that the proposed acquisition consistent with the General Plan. At that time,
Commissioners also expressed concern on potential impacts that might result from the development
of a park facility at that site, and tasked staff to bring back a proposed resolution reflecting the
Commission's concerns.
On September 9, 2002, the Commission considered and adopted a resolution identifying the
Commission's concern on development of a park facility at this site. The Commission requested that
the Board of Supervisors direct that copies of the resolution be forwarded to East Bay Regional Park
District and other potentially interested entities.

RESOLUTION OF THE EAST COUNTY REGIONAL PLANNING
COMMISSION, COUNTY OF CONTRA COSTA, STATE OF
CALIFORNIA, CONCERNING THE PROPOSED ACQUISITION
AND DEVELOPMENT OF THE FALLMAN PROPERTY IN THE
KNIGHT EN AREA BY THE EAST BAY REGIONAL PARK
DISTRICT
On July 8, 2002, the East County Regional Planning Commission considered the
General Plan conformance of a proposed acquisition by the East Bay Regional Park
District(EBRPD) of two parcels, Assessor Parcel Numbers (APN 015-180-009 and 015-
180-011, totaling 280(+/-) acres in an unincorporated area ofKnightsen along Orwood
Road (ref Exhibit A—attached);
Staff indicated that the County General Plan designates the site as Delta Resource
and Recreation(DR), and is located outside of the Urban Limit Line; the affected parcels
are zoned General Agricultural (A-2) and Heavy Agricultural (A-3)Districts; and these
parcels are referred to as the "Fallman Property."
Staff advised the Commission that the EBRPD's Master Plan identifies the need
for more public access to the Sacramento-San Joaquin Delta; that the District's interest in
the property sterns from its approximate 1,000 feet of water access to the Delta along
Werner Dredger Cut; and that the District would develop the property for water-based
recreation and possibly camping; still, the District anticipates that park development is
not projected for ten years, and that in the interim,the District would utilize the property
in its current agricultural use.
Whereas, after allowing for anyone wishing to testify on the matter, the
Commission unanimously voted to find the proposed acquisition in conformance with the
County General Plan.
Notwithstanding the determination that the proposed acquisition conforms to the
general plan, the Commission commented that nearby waterways are presently used by
boaters from Orwood Marina Resort and Discovery Bay, and that Indian Slough is the
primary access to the main Delta from Discovery Bay. The Commission noted that:
• The waterways in this area are subject to periodic congestion at narrower
segments;
• The Orwood Marina Resort had recently added a third boat launch,which has
noticeably increased boat traffic in the vicinity;

• There will be a 330-slip boat marina as part of Villages III and IV of the
Discovery Bay West development and that eaters at the Werner-Dredger Cut;
and
• The boats from the Discovery Bay West marina will also rely on Indian Slough
to access the main Delta.
The Commission requested that staff to prepare a draft resolution reflecting the
Commission's concern with development of this site for public purposes.
The Commission having considered all evidence and testimony submitted in this
matter;
RESOLVED, that development of a parr at the Fallman Property by the East Bay
Regional Park.District may result in significant impacts that should be considered and
mitigation measures appropriately identified prior to any adoption of a park development
plan by the District for this site. Potential impacts that should be considered include:
1. Increased Boat Traffic and Limitations of Existing Waterways—The impacts
of increased boat traffic on Werner Dredger Cut and Indian Slough from an
additional boat launch facility should be studied and appropriately mitigated.
2. Vehicular Access--A new regional park facility on the Fallman Property
would presumably rely on Orwood Road for vehicular access. This road is a
narrow two-lane road built to rural-highway standards and the Orwood Road
Bridge that crosses the Werner Dredger Cut has limited capacity. The bridge
may not be sufficient to accommodate an increase in park-related traffic,
particularly from vehicles towing boats and trailers or from recreational
vehicles. The impacts of increased vehicular traffic along Orwood Road from
a regional park facility must be properly mitigated. EBR.PD will need to
evaluate how a future regional park that includes a boat launch facility and/or
overnight camping on the Fallman Property would increase traffic on Orwood
Road.
3. Levee Maintenance—A new regional park facility on the Fallman Property
could increase the need for maintenance of the levee system serving Orwood
Tract. The impacts on levee maintenance on Orwood Tract from a regional
park facility must be properly mitigated. EBRPD will need to evaluate how a
future regional park that includes a boat launch facility and/or overnight
camping on the Fallman Property would increase maintenance of the levee
system for Orwood Tract.
4. Public Safety—A new regional park facility on the Fallman Property would
introduce public activities or function in an area of the County that has
traditionally been agricultural and somewhat remote from public safety
providers. A park in this location could place new demands on certain public
safety functions, such police and fire protection and emergency medical

services. EBRPD will need to evaluate how a future regional parr that
includes a boat launch facility anchor overnight camping on the Fallman
Property would rewire new or additional public safety services, such as police
and fire protections and emergency medical services.
This resolution shall be forwarded to the Board of Supervisors for acceptance with a
request for it to be forwarded to the East Bay Regional Park District, Knightsen Town
Advisory Council, Town of Discovery Bay, and Delta Protection Commission.
The decision of the East County Regional Planning Commission on this
resolution was given by motion of the Planning Commission on September 9, 2002
by the following vote:
AYES: Commissioners—Day, Dell, Harper and MacVittie
NOES: Commissioners—None.
ABSENT": Commissioners---Ashe.
ABSTAIN: Commissioners—None.
