APPROVE and AUTHORIZE the Auditor-Controller to issue a check in the amount of $181,400 to
Hofmann Lanai Development Company for reimbursement of excess funds paid into the Countywide
Landscape District from.Fiscal Year 2000-2001, Countywide. (Zone 61 Funds)
II. Financial ImpAct:
There is no impact to the County General Fund. All funds are from landscape assessments from
Countywide Landscape District,Zone 61.

III. Reasons for Recommendations and Background:
The Conditions of Approval for Subdivision Number 7686 (various phases) and Subdivision 8023
required the developer to annex to the Countywide Landscape District for the maintenance and operation
of landscape and park facilities. On November 2, 1999, the Board of Supervisors adopted a resolution
forming Zone 61 and authorizing the levy and collection of assessments. The assessments are based on
estimated maintenance costs for all facilities planned to be installed. Discovery Bay West is comprised
of four (4) major phases. Only two of the major phases and their associated landscape components have
been completed. The County has been collecting assessments since FY 00-01 based on the total of
1,759 units approved to be built. The developer has requested a refund for FY 00-01 for assessment
paid for the 902 parcels at $200 each in unbuilt Phases 3 and 4. The total amount paid for Phases 3 and
4 is $181,400 for FY 00-01. There is currently $396,565 in the Zone 61 fund. Repaying the developer
will leave a balance of$214,800. Expenses for this fiscal year are anticipated to be about$100,000.
IV. Consequences of Negative Action:
Developer can not be reimbursed for paid fees collected for unbuilt phases.
