SUBJECT: Accept Grant Deed from Pulte Homes, and Adopt the Previously Certified City of
Brentwood Negative Declaration for the Project, Brentwood area. [SCH#01103070]

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
!. Recommended Action:_
A. ACCEPT the Grant Creed dated July 29, 2002 from Pulte Hames Corporation.
B. DIRECT the Real Property Division to have the above referenced Grant Deed recorded in the office
of the County Recorder.
C. ADOPT the previously certified City of Brentwood Negative Declaration for light of way conveyance
to the Flood Control district from Pulte Homes for the purpose of completing real property
transactions in compliance with the California Environmental Quality Act, and
D. DIRECT the Director of Community Development to file a Notice of Determination, and
E. AUTHORIZE the Public Works Director to arrange for payment of a $25.00 fee to Community
development for processing,and a$25 fee to the County Clerk for filing the Notice of determination.

Ill. Reasons for Recommendations and Background:
The developer for Subdivision 8017, Pulte Homes, is offering by grant Deed parcels G, H, J, and I as
shown on said Final Map filed December 17, 1096,Map Book 39Q Page 27,Contra Costa Records. These
parcels need to be accepted by the Contra Costa County Flood Control and Water Conservation District for
access and maintenance purposes in this portion of Dry Creek.
IV. Consequences of Negtive Action:
The District will not have sufficient land rights for access and maintenance of Dry Creek.

Project Description, Common Name (if any) and Location: Right of Way Conveyance to the Flood Control
District from Pulte Homes/DA 106 Project. The developer for Subdivision 8017, Pulte Homes, is offering by
Grant Deed of Development parcels G, H, J, and.I as shown on the Final Map 390 M 29 along dry Creek. {See
Figure 3}These parcels need to be accepted by the Contra Costa County Flood Control and Water Conservation
District for access and maintenance purposes in this portion of Dry Creek.
In 1994, the City of Brentwood published the Blackhawk/Nunn Project Environmental Impact Report. The
Brentwood City Council adopted the Environmental Impact Report on April 23, 1996. The Contra Costa County
Board of Supervisors plans to adopt the City of Brentwood's Environmental Impact Report to address the necessary
Flood Control District real property transactions associated with the project. Project Location: The proposed
project is located along Dry Creek between Arlington Way and Claremont Drive. (See Figures 1-3)
Pursuant to the provisions of the California Environmental Quality Act:

X) An Environmental Impact Report was prepared and certified {SCH##91103070 }
{ ) The Project was encompassed by an Environmental Impact Report previously prepared
for {SCH## }.
{ } A Mitigated Negative Declaration was prepared following identification of a potentially significant impact. The
Mitigated Ng Dec{certified by the City of Brentwood}is being adopted by the Board of Supervisors.
Copies of the record of project approval and the Negative Declaration or the final EIR may be examined at the office of the
Contra Costa County Public Works Department.
{ } The project will not have a significant environmental effect with the incorporation of mitigation into the project
description. The Board of Supervisors is adopting the certified Mitigated Neg Dec.
