SHIU, PUBLIC WORKS DIRECTOR DATE: October 1, 2002 SUBJECT: APPROVE and AUTHORIZE the Public Works Director to execute an amendment to the July 17, 2002 Rental Agreement with Richard S. Narez, Trustee, in connection with the State Route 4 East, Railroad to Loveridge Road Project. Project#4860-6X4287 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION 1. Recommended Action: APPROVE and AUTHORIZE the Public Works Director to execute an amendment to the July 17, 2002 Rental Agreement. The amendment allows a lump sum payment of rent in advance for the months of October, November and December 2002, for the 2300 sq. ft. covered yard. Tenant Location Lump Sum Richard S. Narez, Trustee 95 Bliss Ave. $3,900.00 (2300 sq. ft. in covered yard) If. Background and Reasons for Recommendations: A. The County may acquire the land and improvements located at 95 Bliss Avenue, Pittsburg, for use as right of way for the State Route 4 East/Railroad Avenue to Loveridge Road Widening Project.The improvements consist of a covered yard,office space and yard space. B. As the units become available,the County entered into a rental agreement with the property owner to minimize relocation costs that may mature for future occupants, since the County cannot prevent the units from being occupied again prior to purchase of the property. Background and Reasons for Recommendations: (Continued) C. The owner is in agreement with the County's objectives of having the units remain vacant, the County paying rent on the units as they become vacant, and securing the premises against vandalism, trespassers, or other unauthorized occupants. D. The County will be renting the 2300 sq. ft. covered yard through at least December 2002. This amendment ensures the County's contractual obligation to pay rent and saves time of administrating a short-term rental payment due on the last day of each month. 111. Financial Impact: Payments required are to come from the State Route 4 Fast f Railroad Avenue to Loveridge Road Widening Project fund which is 100% reimbursable from the Contra Costa County Transportation Authority. IV. Consequences of Negative Action: The County could be liable for additional relocation expenses if the project proceeds and the property is acquired for the project.
