FISCAL IMPACT Adoption of the CIP for Parks and Sheriff Facilities and the approval of the Biennial Compliance Checklist (Checklist) qualify the County to receive its Fiscal Year 2000/2001 allocation of Measure C-1988 "return to source" revenue, estimated to be approximately $1.8 million. To comply with CEQA, Department staff has found pursuant to adopted County CEQA Guidelines, that the CIP for Parks and Sheriff Facilities is not a project subject to CEQA (see Exhibit A). This follows from the general rule that CEQA applies only to projects that have the potential to cause significant adverse effects to the environment. No significant physical change in the environment will result in the adoption of this CIP. All capital facilities programmed are either fully committed, constructed, awaiting occupancy, or undergoing separate environmental review. Projects that may be funded in the future, consistent with this CIP, which are as yet undefined will be subject to separate environmental review. Under the provisions of Section 15061(b)3, of the State and County CEQA guidelines, it can be seen with certainty that there is no possibility that adoption of the CIP for Parks and Sheriff Facilities could have a significant effect on the environment. The CIP for Parks and 'Sheriff Facilities (see Exhibit B) was prepared as part of the County's Development Mitigation Program. The CIP is authorized by Implementation Measure 4-n of the County General Plan. Any capital projects sponsored by the County and necessary to maintain adopted levels of performance.must be identified in a five-year CIP. Funding sources for the complete cost of the improvements, and phasing, if any, must also be identified in the CIP. The CIP demonstrates that development anticipated between 2002 and 2008 will maintain compliance with the performance standards for parks and Sheriff facilities. Table 6 of the CIP shows no expansion or acquisition of facilities is proposed for the seven-year period for patrol and investigation facilities. The existing"surplus" capacity is expected to be sufficient to accommodate population growth during this period, but not for much longer. It is likely that future updates of the CIP will need to identify construction or acquisition of additional facilities. The portion of the Development Mitigation Program that demonstrates compliance with traffic performance standards is described in the 2001 County Road Improvement Program adopted by the Board on December 4, 2001. Monitoring data during 2000/2001 indicate that the reporting intersections in the unincorporated area operate at Level of Service A or B and satisfy the County's traffic performance standards. These monitoring locations include all signalized intersections on non-regional routes maintained by the County. Projects in the County Road Improvement Program will maintain compliance with traffic performance standards in the unincorporated area in the future based on near-term growth forecasts. This Program also identifies improvements on Routes of Regional Significance in a manner consistent with the County's obligations specified in the Authority's Countywide Comprehensive Transportation Plan. Compliance with the other performance standards (i.e., fire, water, flood control, and sanitary facilities) must be demonstrated by the developer prior to granting final discretionary approvals of such development. The County General Plan provides the policies and programs that enable the County to comply with the Measure C-1988 Growth Management Program. The Checklist (see Exhibit C)was completed based on these policies and programs. The Authority requires that the Board review and approve the completed Checklist, and find that the County's policies and programs conform to the Measure C-1988 Growth Management Program. CONSEQUENCES OF NEGATIVE ACTION Failure to adopt the CIP for Parks and Sheriff Facilities or approve the Checklist will prevent the County for qualifying for its Fiscal Year 2001/02 allocation of"return to source" funds. INRODUCTION This document is Contra Costa County's Capital Improvement Program(CIP) for providing park and Sheriff facilities in the unincorporated area of the County. A companion document, the County Road Improvement Program, describes transportation projects to mitigate the transportation impacts of new development as well as to facilitate access to housing opportunities for all income levels. Both documents respond to the requirements of the Contra Costa Transportation Authority's Biennial Compliance Checklist, which is used to measure how well individual jurisdictions are complying with the requirements of the growth management program of Measure C-88. The Measure C-88 growth management program requires local jurisdictions to develop a five- year capital improvement program to meet and maintain adopted performance standards. It is Contra Costa Transportation Authority policy that all capital improvement programs be amended annually,taking into account changes in project costs, funding sources,project development and timing. Jurisdictions can avoid annual updates by developing longer range capital improvement programs. The County has elected to use a seven-year horizon for the CIP. Because the CIP is based on a seven-year horizon, 2002-2008, growth estimates for that time period are presented in Section II. Section III of the CIP reviews the performance standards, which were established by the Growth Management.Element in the Contra Crista County General Plan, and describes the status of County's compliance with these standards based on the estimated population growth. Section IV describes the program facilities needed to meet the demands of future growth as dictated by the performance standards set forth in the Growth Management Element. H. POPULATION ESTIMATES Table 1 provides an estimate of past population growth in the unincorporated area since adoption of the County's Growth Management Element in 1991. It also describes projected population growth for the seven-year period of the CIP, 2002-2008. These forecasts are based on ABAG's Projections 2000, as adjusted by the Community Development Department to reflect the actual growth recorded on the unincorporated area between 1991-2001. These performance standards are applied to all development that was approved since the adoption of the County General Plan in January 1991. The standards are established for the entire unincorporated area; therefore,the following evaluation is on a countywide basis. Park Facilities: The growth management standard for park facilities is three acres of neighborhood parks per 1,000 population. Table 2 evaluates this standard as of 2001. This evaluation is based on population growth for the 1991 0 2001 time period and the park acreage opened during that period. Since January 1991,the County has opened approximately 119 acres of new park facilities that meet the neighborhood park classification. Actual park construction exceeded the growth management standard by 30 acres. These facilities represent a broad range of accomplishments, including contribution to joint school/park facilities,pro-rated credit for park facilities of cities or special districts funded partially by County revenues or land-dedication, and linear parks that serve the local area. See Appendix A for a description of these park facilities. The growth management standard for Sheriff facilities is 155 square feet of patrol and investigation facilities per 1,000 population. The definition of this standard was amended in 1997 by the Board of Supervisors to include support facilities within the definition of Sheriff patrol and investigation_functions. This amendment was adopted due to the fact that the definition of Sheriff facilities included only the patrol and investigation facilities and excluded many other support facilities. Since 1991, a large amount of the square footage constructed by the Sheriff included these ancillary facilities.The modification of these standards to include support facilities was intended to assure the County's continued adherence of the standard of Sheriff facilities within the General Flan. Table 3 evaluates compliance with the performance standard as of 2001. The evaluation is based on population growth for 1991-2001 time period and the square footage of Sheriff facilities opened during that period. The population growth between 1991 and 2001 created a demand for 4,589 square feet of patrol, investigation and support facilities. Since 1991,the County has opened 8,181 square feet of facilities that serve patrol,investigation and support activities. Actual Sheriff facility construction exceeded the growth management standard by 3,592 square feet. IV. SEVEN-PEAR PROGRAM FOR PARD.AND SHERIFF FACILITIES The Measure C-88 growth management program requires that capital improvement programs include approved projects,their estimated costs and a financial plan for providing the improvements. This section describes a seven-year program of projects to maintain a compliance with the County's adopted growth management standards for park and Sheriff facilities. Park Facilities: The projected growth during the 2002-2008 time period will generate the need for 51 acres of neighborhood and community parks. Table 4 describes the park facilities programmed for construction during the 2002 to 2008 time period. Nearly 35 acres of neighborhood parks are programmed for construction. By adding the acreage from Table 4 to the current "surplus" of 30 acres,programmed park construction will exceed the performance standard by approximately 14 acres based on the growth projected to occur in the unincorporated area by 2008. The formula utilized to evaluate this need for facilities in 2008 is detailed in Table 5. Parks are financed largely by park dedication fees assessed against new development in the unincorporated area. These fees amount to $1,350 per dwelling unit in eastern Contra Costa and $2,000 per dwelling unit elsewhere. County regulations allow these fees to be satisfied through direct payments,dedication of land, or dedication of improved park facilities to the County. Unless otherwise indicated,the parks shown on Table 4 occur on County-owned parcels or land dedicated by developers to the County. Expenditures are for park improvements only. In 1996,the Board of Supervisors approved an implementation program for County parks, recreation and trail facilities that included a review of the park dedication fee structure. As of January 2002, that review has not occurred. In 2001, the County departments providing staff support for park development have formed the Parks,Creeks, and Trails Committee. They meet regularly to address park issues. That committee has reviewed all information in Table 4,Table 5 and Appendix A of this update. In December 2001,the Board of Supervisors directed this committee to report to the Board's Ad Hoc Committee on Open Space. Sheriff Facilities: The projected growth during the 2002-2008 time period will generate the need for 2.,520 square feet of Sheriff facilities to serve patrol and investigation activities. The surplus square footage resulting from Sheriff facilities opened as of 2001 is 3,592 sq. ft. This"surplus" of facility capacity is sufficient to serve all growth projected to occur in the unincorporated area by 2008,with approximately 972 sq. feet of capacity remaining by that time. Table 6 shows that there is no construction or acquisition of additional facilities planned by 2008. Existing capacity is expected to be sufficient to accommodate population growth for the next seven years,but probably not more than that. Due to the fact that there is no future construction programmed and past years surplus capacity will be utilized, it may be difficult to demonstrate compliance with the growth management standard in future years. In 1997, the Board of Supervisors approved a recommendation of their Finance Committee to request the Sheriff, in cooperation with the County Administrator, to prepare a master plan that addresses the long term needs for patrol and investigation activities in the unincorporated area and to evaluate potential revenue sources to fund implementation of the master plan. This master plan, when completed, could help guide future updates of the CIP. Fees are currently in place for new development in the unincorporated area to provide ongoing support for Sheriff operations. The fees do not cover additional facilities that may be needed in the future. The master plan for patrol and investigation facilities could examine potential revenue for such facilities. Since 1991, a significant inventory of space for patrol and investigation activities has been made available on a short-term basis to the Sheriff through donations or leases. These facilities total 2,662 square feet and are listed in Appendix C. The Sheriff recommends that this space not be claimed by the Board for the purpose of meeting the growth management standard for Sheriff facilities. BACKGROUND/REASON FOR RECOMMENDATION The County's current Housing Element was adopted by the Board of Supervisors in 1992 and certified by the Califomiia Department of Housing and Community Development Department (HCD) in 1995.The approved Housing Element was subsequently included without significant change in the reconsoildation of the County General Plan in 1996. As required under California Government Code Section 65580- 65589.5, the County must update and adopt a revised Housing Element for submission to HCD by December 31, 2001,The Housing Element update must be consistent with the County General Plan, satisfy all State regulations and HCD guidelines, and include the following components: • A review and assessment of the County's experience in implementing the currently approved Housing Element; • An assessment of current and future housing needs and an inventory of resources and constraints relative to meeting those needs; • A statement of County goals, objectives, and policies with respect to development of housing in the County. The planning period for the Housing Element update begins January 1, 2002 and ends on ,June 30, 2006.The geographic area to be covered includes the unincorporated area of the County. For example, negotiated agreements with the developers of the Dougherty Valley require 25%of the 11,000 housing units developed to be affordable to low- and moderate-income households.
