AUTHORIZE the Chair of the Board of Supervisors to sign letters to our federal legislative delegation supporting 5. 1917 and H.R. 3, ich would restore$27.7 billion to the federal budget for fiscal year 2003, offsetting a reduction in transportation funds in the President's proposed budget for fiscal year 2003; and 2. AUTHORIZE the Chair of the Board of Supervisors to sign letters to our state legislative delegation supporting California State Senate Joint Resolution 36,which would support the efforts of the House of Representatives and the U.S. Senate to restore this federal funding. FISCAL IMPACT None to the General Fund. S. 1917(Jeffords, I-Vermont)and its identical House bill, H.R, 3694 (Young, R-Alaska) would restore the federal transportation spending level that was guaranteed in the Transportation Equity Act for the 21" Century (TEA-21). The funding restoration would include $663 million for California transportation projects in federal FY 2003. BACKGROUND/REASONS.FOR RECOMMENDATIONS The Transportation,Water and Infrastructure Committee on February 25 reviewed 5. 1917 and H.R. 3694 and recommended the Board adopt positions of support on the bills. Both bills are identical. The President's budget for FY 2003 cut $27.7 billion from transportation due to the recession and lower-than-expected gas tax revenues, which are used as part of the formula to determine highway maintenance and construction funding through TEA-21. The Senate and House bills are co-sponsored by Senator Barbara Boxer and Representative Ellen Tauscher, respectively, The bills don't specify the source of the funds to be used to restore the budget, but the Highway Trust Fund has been suggested as a possible source. This fund, traditionally used to offset federal budget deficits, currently totals about $18.3 billion. The cutback wouldn't necessarily delay Bay Area transportation projects because federal funds for FY 2003 haven't yet been programmed, meaning no spending decisions have been made for those funds. If the funding cuts go deeper or last longer than one year, some Bay Area projects could be delayed from starting up. The Bay Area's loss in the cutback totals somewhere between$120 million to$140 million, which is about 13 percent of the Bay Area's annual transportation budget, according to the Metropolitan Transportation Commission. These bills would restore the federal transportation spending level that was guaranteed in the Transportation Equity Act for the 21"t Century(TEA-21). This federal legislation is a welcomed response to the President's proposed federal budget for 2003,which would cutback federal funding by$9.1 billion from the current funding levels-a 30%reduction. The Bay Area's loss in the proposed cutback totals somewhere between$120 million to$130 million,which is about 13%of the Bay Area's annual transportation budget,according to the Metropolitan Transportation Commission. It is too early to identify the specific projects that could be affected the President's proposed budget,but federal funding is a critical source of revenue to widen Highway 4 and I-680,as well as to make upgrades to local roads. The proposed budget will also hamper efforts to stimulate economic activity and to counter the effects of existing job losses and sluggish economic conditions. It is our understanding that H.R. 3694 and 5.1917 will restore federal highway program funding levels to those anticipated by federal statute for 2003 and,if necessary,use the$18.5 billion unobligated balance in the federal Highway Trust Fund. The Board appreciates your co-sponsorship of H.R.3694 and we are happy to pledge our support for its success.
