RESOLU'T'ION NO. 2002/64
SUBJECT: Exonerate Deferred Right of Way Improvement Agreement for Bear Creek Road,
Subdivision MS 15-97 (cross-reference MS 7-01) Antone E. Pereira Trust and
Antone E. Pereira Martinez area. (District II)
On September 22, 1998, the Board authorized the Public Works Director to execute a
Deferred Right of Way Agreement with the Antone E.Pereira Trust and Antone E.Pereira for right
of way dedication along Bear Creek Road as required by the conditions of approval for MS 15-97.
The aforesaid Deferred Right of Way Agreement was recorded on November 9, 1998
Recorder's Document Number 98-0279330-00 of Official Records and became an encumbrance
against Assessor's Parcel No. 365-020-033.
The Public Works Director now informs this Board that the requirements outlined in said
agreement have been satisfied by Offer of Dedication for Roadway Purposes as shown on the Parcel
Map for MS 7-01.
The Board hereby FINDS that the conditions of the above-mentioned Deferred Right ofWay
Agreement are satisfied.
NOW THEREFORE BE IT RESOLVED that the aforesaid Deferred Right of Way
Agreement is EXONERATED.
T hereby certify that this is a true and correct copy of an action
taken and entered on the minutes of the Board of Supervisors on
the date shown.
