CP# 01-36 The Board of Supervisors of Contra Costa County, as the governing body of the Contra Costa County Flood Control and Water Conservation District, RESOLVES THAT: On October 22, 2002 the Board adopted a Resolution proposing to establish Drainage Areas, 62, 72, 78, 87, 88, and 89 and to adopt drainage fee ordinances for the drainage areas. On December 3, 2002 , pursuant to the Board's Resolution of October 22, 2002, this Board held a hearing to consider the establishment of said drainage areas and the adoption of drainage fee ordinances. All written and oral objections presented concerning the proposed establishment of said drainage areas and adoption of new drainage fee ordinances were considered. This BoardFINDS that any valid written protests filed do not represent more than one-half of the assessed valuation of real property contained in the proposed drainage area. This Board also FINDS that no written petition for an election, signed by at least 25 percent of the registered voters within the proposed drainage area has been filed. The Board FINDS, pursuant to Government Code Section 66001 (a) as follows: The purpose of the fees described in this resolution is to generate monies to finance the construction of drainage improvements within the Grayson Creek Watershed. The fees will be used to finance the drainage improvements listed in the Engineer's Report, entitled "Contra Costa County Flood Control and Water Conservation District: Engineer's Report for The Establishment of Drainage Areas 62, 72, 78, 87, 88, and 89,"which is on file with the Clerk of the Beard. As discussed in more detail in said report and in the `Report on Impervious surface Drainage Fee Ordinance," dated January 5, 1982, the types of development that are subject to the fees will generate additional impervious surfaces and drainage within the drainage areas, thus creating a need to construct improvements. Use of the fees paid by each type of development will provide necessary infrastructure to mitigate adverse drainage impacts that would otherwise result from such development. The Board DETERMINES that this activity is not subject to the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3), and as defined in Article 20, Section 15378 (b) (4) of the CEQA Guidelines. The Board DIRECTS the Director of Community Development to file a Notice of Exemption with the County Clerk. AUTHORIZE the Chief Engineer to arrange for payment of a $25 fee to Community Development for processing, and a $25 fee to the County Clerk for filing the Notice of Exemption. W N V V M tri p. 4 ORDINANCE NO. 2002-35 AN ORDINANCE OF THE CONTRA COSTA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT ESTABLISHING DRAINAGE FEES IN THE CONTRA COSTA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT DRAINAGE AREA fit The Board of Supervisors of Contra Costa County as the Governing Body of the Contra Costa County Flood Control and Water Conservation District does ordain as follows: SECTION 1 Contra Costa County Flood Control and Water Conservation District Drainage Area 62 is established. SECTION 2 The Board hereby enacts the following as the Drainage Fee Ordinance for Drainage Area 62. SECTION I BOUNDARY MAP. The boundary map entitled "Drainage Area 62 Boundary Map," dated May 2002, on file with the Clerk of the Board of Supervisors, is established as the boundary for the Contra Costa County Flood Control and Water Conservation District Drainage Area 62 pursuant to Sections 12.2 and 12.3 of the Contra Costa County Flood Control and Water Conservation District Act (Chapter 63 of West's Appendix of the Water Code). SECTION 11 FINDINGS. This Board finds and determines that future subdivision and development of property within said drainage area will have a significant adverse impact on existing;and future developments within the Grayson Creek Watershed; that development of property within the drainage area, with its resultant increase in impervious surfaces, will require the construction of facilities described in the Grayson Creek Regional Improvement Plan; that the fees herein provided to be charged are uniformly applied on a square foot of impervious surface basis and fairly apportioned within said drainage area on the basis of benefits conferred on property upon which additional impervious surfaces in said drainage area are constructed; that the estimated total of all fees collectible hereunder does not exceed the estimated total costs of all drainage facilities included in the Engineer's Report; and that the drainage facilities planned are in addition to existing drainage facilities already serving the Grayson Creek Ordinance No. 2002-35 Page 1 of 5 Watershed at the time of the establishment of said drainage area. SECTION III EXEMPTIONS. The fee shall not be required for the following: 1) to replace a structure destroyed or damaged by fire, flood, winds or other acts of God, provided the resultant structure has the same, or less impervious surface as the original structure; 2) To modify structures or other impervious surfaces, provided the amount of ground coverage is not increased by more than 100 square feet; 3)To convey land to a government agency, public entity, public utility, or abutting property owner where a new building lot or site is not created as a result of the conveyance; or 4) Any lot or property for which drainage fees have been fully paid previously. SECTION IV FEE DEFERMENT. on lots greater than two acres in size, the property owner can defer the payment of the fee on the portion of the lot in excess of two acres that is not a required part of the pending development. The deferment of fee is conditional on the property owners granting, as collateral, the development rights to the Board of Supervisors for said area of deferred fee until such time as the fee is paid. SECTION V. BUILDING PERMITS. Except as permitted under Section III and IV, the Contra Costa County or the city official having jurisdiction shall not issue any building permit for construction within the drainage area until the required drainage fee has been paid. For initial construction the fee shall be as set forth in Section VII. For single family residential swimming pools on lots for which the drainage fee has not been paid, the fee shall be $450 per pool. For other construction, modifications or replacements to an existing facility that cause an increase in impervious surface, including, but not limited to, driveways, walks, patios, etc., the amount of net increase in impervious surface shall be subject to a fee of$0.51 per square foot, but not to exceed the amount required under Section VII. SECTION VI SUBDIVISIONS. Except as permitted under Sections III and IV, the subdivider shall pay the drainage fee on the entire proposed subdivision or on each individual unit for which a final or parcel map is filed prior to recordation of said map. Town house, condominium, and cluster housing type subdivisions creating individual lots less than 4,000 square feet shall be treated as multifamily residential and the lot size used in determining the "square feet of land per unit" shall be the lot size prior to subdividing. Except as noted above, the fee.for all other subdivisions shall be calculated on an individual lot basis. The fee amount shall be as set forth in Section VII. The drainage fee for the portion of these facilities in excess of 400 square feet shall be calculated using the square foot fee in Section V, and it shall be in addition to the above fee amounts. For the purpose of this ordinance, subject to Section VI, lot size shall be (1)for existing lots, that land shown on the latest equalized assessment roll as a lot; or (2)for new subdivision lots, that land shown on the final or parcel map as a lot. The fee amounts under"Single Family Residential" shall apply to lots containing only one dwelling unit. For multifamily residential (including mobile home parks)the "square feet of land per unit" shall be the quotient obtained by dividing the lot size in square feet by the number of dwelling units proposed to be on the lot. SECTION VI11. FEE PAYMENT. The official having jurisdiction may accept cash or check, or, when authorized by the District's Chief Engineer, other consideration such as actual construction of a part of the planned drainage facilities by the applicant or his principal. All fees collected hereunder shall be distributed into the appropriate accounts. Each $0.51 collected will be deposited into the Grayson Creek Regional Improvement Plan Fund. Monies in said funds shall be expended solely for land acquisition, construction, engineering, administration, repair maintenance and operation or reimbursement for the same, in whole or in part, of planned drainage facilities within the drainage area, or the Grayson Creek Regional Improvement Plan. Said monies may also be used to reduce the principal or interest of any indebtedness of the drainage area, or the Grayson Creek Regional Improvement Plan Fund. SECTION IX. CREDIT. Drainage fees previously paid shall be credited as follows: A Where drainage fees have been paid under a former drainage fee ordinance based on acreage, fees shall not be required under Section VII for any part of the total area for which the fee was paid, except in the case of a resubdivision. B Where drainage fees have been paid under this ordinance or another drainage fee ordinance based on impervious surface, fees shall not be required under Section VII for the total impervious surface area for which the fee was paid. However, fees shall be payable under Section VII for any additional impervious surface area. C Where drainage fees have been paid other than pursuant to an adopted drainage Ordinance No. 2002-35 Page 4 of 5 fee ordinance, the dollar amount of the fee paid for the development site in question shall be credited against the fees payable under Section VII. SECTION X. REVIEW!! OF FEES. Project cost estimates shall be reviewed every year that this ordinance is in effect. The fee schedule shall be adjusted annually on January 1 to account for inflation using the Engineering News Record Construction Cost Index. Such adjustment shall not require further notice or public hearing. SECTION XI. EFFECTIVE DATE. This ordinance becomes effective 60 days after passage, and within 15 days of passage shall be published once with the name of supervisors voting for and against it in the Contra Costa Times, a newspaper published in this area. SECTION 111 EXEMPTIONS. The fee shall not be required for the following: 1)to replace a structure destroyed or damaged by fire, flood, winds or other acts of God, provided the resultant structure has the same, or less impervious surface as the original structure, 2)To modify structures or other impervious surfaces, provided the amount of ground coverage is not increased by more than 100 square feet; 3)To convey land to a government agency, public entity, public utility, or abutting property owner where a new building lot or site is not created as a result of the conveyance; or 4)Any lot or property far which drainage fees have been fully paid previously. SECTION IV FEE DEFERMENT. on lots greater than two acres in size, the property owner can defer the payment of the fee on the portion of the lot in excess of two acres that is not a required part of the pending development. The deferment of fee is conditional on the property owners granting, as collateral, the development rights to the Board of Supervisors for said area of deferred fee until such time as the fee is paid. SECTION V. BUILDING PERMITS. Except as permitted under Section III and IV, the Contra Costa County or the city official having jurisdiction shall not issue any building permit for construction within the drainage area until the required drainage fee has been paid. For initial construction the fee shall be as set forth in Section VII. For single family residential swimming pools on lots for which the drainage fee has not been paid, the fee shall be $450 per pool. For other construction, modifications or replacements to an existing facility that cause an increase in impervious surface, including, but not limited to, driveways, walks, patios, etc., the amount of net increase in impervious surface shall be subject to a fee of$0.51-per square foot, but not to exceed the amount required under Section VII. Except as permitted under Sections III and IV, the subdivider shall pay the drainage fee on the entire proposed subdivision or on each individual unit for which a final or parcel map is filed prior to recordation of said map. SECTION Vill.'FEE PAYMENT. The official having jurisdiction may accept cash or check, or, when authorized by the District's Chief Engineer, other consideration such as actual construction of a part of the planned drainage facilities by the applicant or his principal. All fees collected hereunder shall be distributed into the appropriate accounts. Each $0.51 collected will be deposited into the Grayson Creek Regional Improvement Plan Fund. Monies in said funds shall be expended solely for land acquisition, construction, engineering, administration, repair maintenance and operation or reimbursement for the same, in whole or in part, of planned drainage facilities within the drainage area, or the Grayson Creek Regional Improvement Plan. Said monies may also be used to reduce the principal or interest of any indebtedness of the drainage area, or the Grayson Creek Regional Improvement Plan Fund. SECTION IX. CREDIT. Drainage fees previously paid shall be credited as follows: A Where drainage fees have been paid under a former drainage fee ordinance based on acreage, fees shall not be required under Section VII for any part of the total area for which the fee was paid, except in the case of a resubdivision. B Where drainage fees have been paid under this ordinance or another drainage fee ordinance based on impervious surface, fees shall not be required under Section VII for the total impervious surface area for which the fee was paid. However, fees shall be payable under Section VII for any additional impervious surface area. Portions of the drainage areas are also located in unincorporated Contra Costa County. All of the proposed drainage areas are in the Grayson Creek Watershed. Drainage Area 62 Drainage Area 62 encompasses a small portion of Pleasant Hill and is mainly situated in unincorporated Contra Costa County. The southerly boundary is the ridge line between Lafayette and unincorporated Contra Costa County. The north, east, and west boundaries also follow ridge lines of the Grayson Creek watershed. The north border is located south of Martinez and runs along an imaginary westerly extension of Slater Avenue, and the west border follows the ridge line of the Grayson Creek Watershed in unincorporated Contra Costa County. The proposed drainage area is 1272 acres. The majority of this area is located in Briones Regional Park, and a smaller portion of the drainage area is residential. The topography of Drainage Area 62 ranges from very flat to very hilly. Engineer's Report Drainage Areas 62, 72, 78, 87, 88, and 89 May 2002 Page 2 Drainage Area 72 Drainage Area 72 is located in the southern portion of Martinez, the western portion of Pleasant Hill, and the unincorporated areas of the County. The proposed drainage area is bound by ridge lines on all sides. The southern boundary follows the ridge line that approximately runs along an imaginary westerly extension of Slater Avenue, and the eastern boundary extends from the intersection of Grayson Creek and the Contra Costa Canal to Falls Court. The west side of Drainage Area 72 is the ridge line that extends along the Grayson Creek watershed boundary. The majority of the 1448 acres in this area is developed, with some open space areas. The topography of Drainage Area 72 ranges from very flat to very hilly. Drainage Area 78 Drainage Area 78 is located in Pleasant Hill. The drainage area is west of the Interstate 680/State Route 242 Interchange and is bound by the Grayson Creek Flood Control Channel on the west. It is bound on the east by Interstate 680 and Contra Costa Boulevard. The northern boundary runs between Baylor Lane and Audrey Lane, and the southern boundary runs south of Gregory Lane. Encompassing roughly 344 acres, the majority of this drainage area is residential development. The topography of Drainage Area 78 is relatively flat. Drainage Area 87 Drainage Area 87 is located in Martinez, Pleasant Hill, and unincorporated areas of Contra Costa County. The northern boundary is predominantly in Martinez, running along Muir Road near Sweetwater Drive. The eastern boundary follows the ridgeline that starts near the Grayson Creek Flood Control Channel at the northern Pleasant Hill border and ends at the intersection of Sweetwater Drive and Muir Road. The southerly and westerly boundaries of Drainage Area 87 are the ridge lines between Martinez and Pleasant Hill. Engineer's Report Drainage Areas 62, 72, 78, 67, 88, and 89 May 2002 Page 3 Drainage Area 87 contains approximately 891 acres. Most of the proposed drainage is developed, mainly consisting of residential family homes, parks, and commercial facilities. The topography of Drainage Area 87 is predominantly hilly with some flat areas. Drainage Area 88 The majority of Drainage Area 88 is located in Martinez and unincorporated areas of Contra Costa County, with a small fraction of the area lying in Pleasant Hill. The eastern boundary is the Grayson Creek Flood Control Channel, and the western boundary crosses State Route 4 and approximately follows the ridge line along Glacier Drive and Milano Way. The proposed drainage area is bound by a ridge line on the south that runs from the Grayson Creek Flood Control Channel at the northern Pleasant Hill border to the intersection of Fountainhead Court and Muir Road. The drainage area is bound on the north by State Route 4 and the ridge line that runs just south of the Contra Costa Canal. The proposed drainage area contains approximately 444 acres, almost all of which is developed. Nearly all of the development in the area is residential, and the topography of the area ranges from relatively flat to hilly. Drainage Area 89 Drainage Area 89 is located within Pleasant Hill, with a small fraction of the area in unincorporated Contra Costa County. The boundary on the east of the drainage area is the Grayson Creek Flood Control Channel. The southern border follows the ridge line extending from the west fork of Grayson Creek to the Contra Costa Canal. The boundary on the west of Drainage Area 89 follows the ridge line from the intersection of Grayson Creek and the Contra Costa Canal to Falls Court. The northern border of the proposed drainage area runs along the ridge line that approximately follows an imaginary extension of Golf Club Road from Falls Court to Spar Court. Containing approximately 1038 acres, the majority of Drainage Area 89 has been developed. The development in the area is comprised of residential family homes, parks, and educational facilities. The topography of Drainage Area 89 is relatively flat, with a few hilly areas. The specific locations of the Drainage Areas are shown on Contra Costa County Flood Control and Water Conservation District Drawings FD-13080, FD-13081, FD-13082, FD- 13083, FD-13084, and FD-13085, which are attached to this report. III REASON FOR THE DRAINAGE AREA FORMATION Currently, formed Drainage Areas 16, 44B, and 46 support the Grayson Creek Watershed. These drainage areas encompass the upper end of the Grayson Creek Watershed, while Drainage Areas 62, 72, 78, 87, 88, and 89 encompass the lower end of the Grayson Creek Watershed. The proposed drainage facilities in Drainage Area 46 are considered regional improvements since they reduce the flow into Grayson Creek and therefore benefit the downstream drainage areas. A regional fee for the Grayson Creek Regional Improvement Plan will be based on the fee for Drainage Area 46. By forming downstream drainage areas, new development fees will be collected to help alleviate regional costs for the Grayson Creek Improvement Plan. While almost all of the necessary drainage facilities in the proposed drainage areas have already been constructed, the existing drainage facilities in the upper end of the Grayson Creek Watershed are inadequate. The majority of the needed improvements are located in Drainage Area 46. By improving drainage facilities in the upper end of the watershed, the downstream Drainage Areas 62, 72, 78, 87, 88, and 89 also benefit. Therefore, fees from new development in the newly formed areas are needed to improve the Grayson Creek Watershed. IV DRAINAGE FEE ORDINANCE AND CALCULATION Section 12.2 of the Contra Costa County Flood Control and Water Conservation District Act provides authority for the collection of drainage fees. These fees and the conditions for collection are set forth in the draft drainage fee ordinances attached. Engineer's Report Drainage Areas 62, 72, 78, 87, 88, and 89 May 2002 Page 5 The fee collected from new development in Drainage Areas 62, 72, 78, 87, 88, and 89 will be the same as the Drainage Area 46 fee of $0.51 per square foot of impervious surface. Most of the drainage facilities in Drainage Areas 62, 72, 78, 87, 88, and 89 have already been constructed, so the fees will mitigate regional costs in the Grayson Creek Watershed by improving drainage facilities in the watershed. The majority of the needed drainage facilities are located within Drainage Area 46. Please refer to Appendix A for the calculation of costs in Drainage Area 46. V FUTURE UPDATING OF PROPOSED FEES The standard impervious surface drainage fee ordinance includes a paragraph in Section X authorizing annual fee updates using the Engineering News Record Construction Cost Index. The updates will occur annually on January 1. VI CALIFORNIA ENVIRONMENTAL QUALITY ACT The proposed action of establishing Drainage Areas 62, 72, 78, 87, 88, and 89 and adopting drainage fee ordinances does not constitute a project under California Environmental Quality Act (CEQA). These activities are not subject to CEQA pursuant to Article 5, Section 15061 (b) (3), and these activities are not a project as defined in Article 20, 15378 (b) (4) of the CEQA Guidelines.
