Specific Request(S)or Recommendation (S) & Background and Justification RECOMMENDATION M APPROVE and AUTHORIZE the Community Services Director or designee to execute and submit State Standard Agreement #02B-5159, Amendment No. 3 (County Contract #39-806-17) with the California State Department of Community Services and Development to extend the contract period from December 31, 2002 to March 31, 2003 with no change in the maximum reimbursable amount of $719,457 for continuing Low-Income Home Energy Assistance Program Services (LIHEAP). FINANCIAL- IMPACT: This contract is Federally funded through the California Department of Community Services and Development. Funding for this contract is included in the Contra Costa County Community Services Department's FY 2002-03 Budget. There is no net County cost to this contract. REASONS FOR RECOMMENDATION51BACKGROUND: On February 5, 2002 the Board of Supervisors approved the 2002 Low-Income Home Energy Assistance Program (LIHEAP), State Standard Agreement 0213- 5159 (and subsequent amendment #1 on May 21, 2002 and #2 on October 1, 2002) with the California Department of Community Services and Development. Approval of State Standard Agreement 028-5159, Amendment No. 3 will provide for continuing Low-Income Home Energy Assistance Program services to program eligible families and individuals in Contra Costa County throug"arch 31, 2003. Approve and authorize the Health Services Director to execute and submit to the State Department of Health Services the FY 2002-03 Standard Appropriation funds. Financia impact: The Health Services Department estimates that the County will receive an allocation of State revenues as follows: For County Administration services $ 40,255 For Non-County operated services 362,293 Total estimated FY 02-03 revenues 4 2 54 Discussion 1Background: Senate Bill SB-2132, Chapter 826, Statues of 2000 appropriated $24,803,000 of Preposition 99 Tobacco Tax money from the Cigarette and Tobacco Produces Surtax Fund and redirected it to reimburse physicians for uncompensated emergency services rendered by physicians in hospital emergency departments. SB-2132 is separate from the California Healthcare for the Indigents Program (CHIP) and is referred to as the "Emergency Medical Services Appropriation (EMSA)" The State Department of Health Services administers SMSA through a Standard Agreement that each County is required to execute in order to receive its SMSA funding allocation. Contained within the Standard Agreement are assurances by the County regarding the expenditure of these funds. Some of these requirements are as follows: 1. These funds shall not be used to reimburse for physician services provided by physicians employed by county hospitals. 2. These funds shall not be used to reimburse physicians who provide services in a primary care clinic. 3. These funds may only be used to reimburse physicians for emergency services rendered to indigents in Fiscal Year 2002-03. Public Health Foundation Enterprises, Inc., will pay the County on a fee for service basis for the personnel time, supplies, and food samples utilized in the testing.
